(AP) — The South Dakota House passed a bill Wednesday that would make xylazine, an animal sedative that is being mixed with fentanyl and then used by some people, a controlled substance. The measure, which passed unanimously in the Republican-held House and now goes to the Senate, would establish penalties of up to two years in prison and fines of up to $4,000 for possession and use of xylazine. Xylazine in humans can cause health problems including difficulty breathing, dangerously low blood pressure, a slowed heart rate, wounds that can become infected and even death, according to the Centers for Disease Control and Prevention. Last year the Office of National Drug Control Policy designated the combination of fentanyl and xylazine as an “ emerging threat.”The South Dakota Health Department and Republican state Attorney General Marty Jackley brought the bill in South Dakota. He was headed to Burger King, where he works as a cook for about $15 an hour, often on the 5 p.m.-to-midnight shift. It is a five-minute drive from the homeless shelter where he lives. But Hernandez, 45, doesn’t have a car. So he bikes—on wheels given to him by Roberta Harmon , a street minister recognizable by her white heart-shaped glasses and fiery red hair who fixes up old bicycles for homeless people who need them to get to jobs.

Senate Republicans repeatedly said this week that a short-term spending bill may be necessary to keep the government open, a harsh reality for House Speaker Mike Johnson, who is balancing a looming shutdown deadline with the demands of hardline Republicans. The last temporary spending bill Congress passed, in November, established a laddered schedule of funding deadlines, the first on Jan. 19 and the other on Feb. 2. Meanwhile, eyes are on Johnson to follow through on the hardline Republican demands he was elected to champion. If not, he could meet the same fate as his predecessor, former House Speaker Kevin McCarthy, R-Calif., who was ousted in part for conceding to Democrats to avoid a government shutdown. While following through on the hardline demands would earn Johnson points with some House Republicans, it makes negotiating with Democrats harder, adding time to budget talks that he does not have.

(AP) — South Dakota Republican Gov. Kristi Noem has requested guidance from the state’s Supreme Court about conflict-of-interest rules for lawmakers, several weeks after a South Dakota state lawmaker resigned and agreed to repay $500,000 in federal COVID-19 relief that she received for her day care business. Doing so violated a state Supreme Court advisory warning state lawmakers that it is unconstitutional for them to accept federal pandemic funding. Noem, Attorney General Marty Jackley and two Republican lawmakers have sent letters to the court seeking clarity on what else is illegal, the Sioux Falls Argus Leader reported Thursday. Legacy automakers are pivoting to electric vehicles in response to expected strong consumer demand, tougher environmental regulations both from US states and foreign countries, and a push from Wall Street. Electric vehicles have outpaced growth of traditional internal combustion engine (ICE) cars in recent years. But automakers bucked Trump and agreed to meet tougher standards set by California rather than the Trump administration’s rules. At a Detroit battery plant Wednesday, Trump said America didn’t need what the factory produced“This plant, we just walked through this plant and the electric vehicles are gonna put [automakers] out of business,” Trump said. Trump’s proposals could undermine US companies’ EV investments and hand over control of an increasingly EV future to foreign manufacturers.
