☆ Supreme Court Justices Say They Get Along. Should We Care? - The New York Times

The Supreme Court is hurting. I can say that with confidence — not based on any inside information but on the external evidence of how hard some of the justices are working to show that everyone on the court really does get along. The retired justice Stephen Breyer, on the talk circuit for his new book on constitutional interpretation, has been making the same point. I’m reminded of the last time the court made a concerted effort to assure the public that all was well. It was during the weeks that followed the ruling that clinched the 2000 presidential election for George W. Bush.

Recently, the Supreme Court justices Sonia Sotomayor and Amy Coney Barrett spoke together publicly about how members of the court speak civilly to one another while disagreeing, sometimes vigorously, about the law. Considerable disagreements on professional matters among the Supreme Court justices, important as they are, remain professional, not personal. They found some, and Justice Ginsburg wore them ever after. At about the same time, Justice O’Connor reminded me that our chief justice, William Rehnquist, had decided that he, too, needed something distinctive on his black robe. Justice O’Connor found at a European bookstall a picture of Lorenzo de’ Medici wearing similar stripes.

CNN —The foundation that selected SpaceX CEO Elon Musk, conservative media mogul Rupert Murdoch and other honorees as recipients of an award named after Ruth Bader Ginsburg announced Monday it is canceling its award ceremony after receiving pushback from the late justice’s family. The slate of this year’s honorees for the foundation’s “RBG Leadership” award, formerly the “Ruth Bader Ginsburg Women in Leadership” award, was announced last week and also included lifestyle icon Martha Stewart, actor Sylvester Stallone and financier Michael Milken. Ruth Bader Ginsburg, a longtime liberal member of the high court who died at age 87 in 2020, consistently delivered progressive votes on major social issues, including abortion rights, same-sex marriage and immigration. Justice Barrett was the third of Mr. Trump’s appointees, rushed onto the court after the death of Justice Ruth Bader Ginsburg, arriving just before the 2020 election. Harry Connick Sr., a long-serving district attorney in New Orleans whose office gained national notoriety for prosecutorial overreach that eventually resulted in many reversed convictions, died on Thursday at his home in New Orleans. His death was announced by his son, the singer Harry Connick Jr., in a statement. The older Mr. Connick was a singer himself and became locally renowned for his nightclub performances in the French Quarter. But his national reputation as a district attorney was much darker, particularly after a 2011 dissent by Supreme Court Justice Ruth Bader Ginsburg that blasted the Orleans Parish district attorney’s office, under his leadership, for singular incompetence and misconduct. And while she was demanding — accepting no excuses for mistakes, a lesson she drew from growing up on a ranch in the West — she also took an interest in her clerks and their personal lives. “She would give them career advice, she would give them jobs,” said the historian Evan Thomas, who interviewed 94 former O’Connor clerks for his biography of the justice, “First.”“She told them to get out and get exercise, always take care of your family, give good dinner parties, never be too busy to take care of people,” he said. “You had to have a life.”For the women who clerked under Justice O’Connor, there was a keen awareness of both the barriers she had broken and her desire to be viewed outside of that history. When she retired, Justice Clarence Thomas, a consistent conservative, called her “an outstanding colleague, civil in dissent and gracious when in the majority.”She could, nonetheless, express her views tartly. “I had never expected or aspired to be a Supreme Court justice," she said. The retired justice was relieved that he was comfortable and happy at the center, according to her son, Scott. “It has been a great privilege indeed to have served as a member of the court for 24 terms,” the justice wrote.

Amy Coney Barrett on Monday endorsed the idea for a formal ethics code for the Supreme Court. Barrett, a conservative former federal appeals court judge who has served on the Supreme Court since October 2020, told an audience at the University of Minnesota Law School that instituting an ethics code would allow the justices to offer the public greater transparency. And she also pushed back against any idea that the justices differed on the necessity of creating an ethics code. But when the host, former Minnesota Law Dean and professor Robert Stein, asked Barrett about a timeline for when the high court might institute an ethics code, she said she wasn't able to offer any specifics. The push for increased ethics rules for the high court has grown louder this year following detailed reports of the activities of several justices off the bench.
