His lawyers are expected to argue that Trump had presidential classification powers. Trump has claimed before that he was abiding by the relevant law, the Presidential Records Act, by engaging in a post-presidency negotiation with the National Archives and Records Administration about returning documents. The law simply says that when a president leaves office NARA assumes control of all presidential records. I do not understand what the former president is referring to when he mentions a process of negotiation with NARA."

“We’re going to win this election because we have no choice,” Trump said at his Mar-a-Lago resort as he savored his sweetest election night since he beat Hillary Clinton in 2016. The time for that excuse is going to fast run out now that the shape of the 2024 general election is clear. “Until now, people didn’t think it was going to be Biden versus Trump, but here we are and we’re ready to go,” he said. One reason why Trump didn’t come across as a loser to his supporters was that he convinced grassroots GOP voters that he didn’t actually lose the 2020 election. Democratic control of the Senate and the tiny House GOP majority that fell short of red wave expectations were widely blamed on his botched strategizing.

CNN —Former President Donald Trump is the closest thing in modern political history to an incumbent who doesn’t hold the office. But these considerable advantages also raise questions about his general election chances given his inability to completely win over Republican primary voters. Despite effectively clinching the Republican nomination with a near-sweep of Super Tuesday states, Trump couldn’t escape the shadow cast by former South Carolina Gov. Haley dropped out Wednesday after consistently winning 30% or so of the GOP primary vote in the states she competed in. Undoubtedly some of the Republican voters who backed Haley in the primaries and caucuses will return to the Trump fold in November, maybe even a majority.

America committed its worst foreign policy mistake of the post-Cold War era when it invaded Iraq in 2003 to disarm Saddam Hussein of his supposed weapons of mass destruction. CNN —Michigan provided the first test of President Joe Biden’s coalition in swing states Tuesday night. In a campaign that will likely come down to a handful of swing states, Biden can’t afford to make the mistakes that Hillary Clinton made in 2016, when small numbers of votes cost her the presidency. Some of the uncommitted voters are sending a message to President Biden rather than going all in and threatening to follow through on Election Day by voting against Biden. Voting uncommitted in February 2024 is not the same as voting for Donald Trump in November 2024. In 2024, the cost of President Biden failing to make a compelling case to his progressive coalition will be a second term for Donald Trump.

With Judge Juan Merchan’s proclamation last week that jury selection in the Manhattan prosecution of Donald Trump will begin on March 25, it is time for a reappraisal of the case. Mr. Bragg will face tough challenges ahead, fueled by lingering skepticism that critics have harbored about the strength of the evidence and whether Mr. Trump has been unfairly targeted. To understand why this case matters, think about a precedent — an earlier episode of an election-related felony and its cover-up. That was the Watergate scandal, which hung over Richard Nixon’s re-election campaign in 1972. We got a preview of this unprecedented criminal trial mixed with a presidential campaign on Thursday at a key hearing in the New York criminal case. Claiming violent crime in cites, especially those run by Democrats, is one of Trump’s favorite talking points. The idea that violent crime is at an “all-time high” is completely untrue, as CNN’s Daniel Dale wrote last October. But the judge in Manhattan has filled Trump’s calendar at the end of March, when that federal trial could theoretically have taken place. But as The New York Times notes, despite the rising number of migrants in the city, violent crime has dropped.

Later Tuesday, a group of former officials in Republican presidential administrations from Richard Nixon to Trump in a filing with the Supreme Court said Trump has failed to make "two of the mandatory showings required for a delay of" the appeals court ruling. "This Court should deny a stay in this case because Mr. Trump's claim of such a boundless immunity is wrong," the filing said. Biden’s reelection campaign has repeatedly declined to commit to joining debates with Trump, his likely opponent in the November general election.
