REUTERS/Gonzalo Fuentes/File Photo Acquire Licensing RightsDec 5 (Reuters) - Elon Musk's artificial intelligence startup xAI has filed with the U.S. securities regulator to raise up to $1 billion in an equity offering, according to a filing on Tuesday. In a Twitter Spaces event earlier in the year he said that rather than explicitly programming morality into its AI, xAI will seek to create a "maximally curious" AI. The billionaire, who has criticized Big Tech's AI efforts as ridden with censorship, in July launched xAI, calling it a "maximum truth-seeking AI" to rival Google's (GOOGL.O) Bard and Microsoft's Bing AI. In 2015, Musk co-founded OpenAI, the company behind ChatGPT, which has created a frenzy for generative AI technology around the world, but stepped down from the board in 2018. The team behind xAI, which launched in July this year, comes from Google's DeepMind, the Windows parent, and other top AI research firms.

While OpenAI later transitioned to a for-profit model, its controlling shareholder remains the nonprofit OpenAI Inc. and its board of directors. This unique structure made it possible for four OpenAI board members — the company's chief scientist, two outside tech entrepreneurs and an academic — to oust CEO Sam Altman on Friday. When it was founded, OpenAI’s original board co-chairs were Altman and Tesla CEO Elon Musk. Musk recently launched his own AI startup, xAI, to compete with OpenAI, Microsoft and Google, among others. The lawsuit is one of several that have been brought by groups of copyright owners, including authors John Grisham, George R.R. Martin and Jonathan Franzen, against OpenAI and other tech companies over the alleged misuse of their work to train AI systems. Sancton's complaint is the first author lawsuit against OpenAI to also name Microsoft as a defendant. "While OpenAI and Microsoft refuse to pay nonfiction authors, their AI platform is worth a fortune," Sancton's attorney Justin Nelson said in a statement. The complaint also said that Microsoft has been "deeply involved" in training and developing the models and is also liable for copyright infringement.

Other than Quora's D'Angelo, OpenAI's four-person board consisted of Tasha McCauley, Helen Toner and OpenAI chief scientist Ilya Sutskever as of Friday.
