CNN —Special counsel Jack Smith urged the Supreme Court on Monday to reject Donald Trump’s claims of sweeping immunity and to deny the former president any opportunity to delay a trial on charges that he attempted to subvert the results of the 2020 election. Trump’s position, Smith told the court, has no grounding in the Constitution, the nation’s history or Americans’ understanding that presidents are not above the law. Even if the Supreme Court finds that former presidents are entitled to some form of immunity, Smith asserted, at least some of Trump’s actions were private conduct – far removed from “official acts” – and could be prosecuted. The Supreme Court will hear arguments April 25, and a decision is expected by July. Instead, he said that if the Supreme Court finds that former presidents are entitled to some immunity, a trial could get underway focused on Trump’s private actions.

The Florida Supreme Court issued a separate ruling on Monday that could energize Democrats’ efforts to hold Trump to account on abortion. The ex-president has long been wary of taking a definitive stand against abortion rights. But some Republicans are infringing the spirit of the Supreme Court ruling – which sent the issue back to individual states – by pushing for a national ban. And Democrats believe they have an issue, in abortion rights, that could thwart him – despite Biden’s own unpopularity. Democrats are delighted since they have had considerable success in using ballot initiatives to protect abortion rights or reject further restrictions.

The Comstock Act, as the law is known, is not central to the current Supreme Court case. Democrat Tom Suozzi flipped a New York congressional seat blue Tuesday night, narrowing the GOP's already razor-thin majority in the House and boosting the spirits of Democrats fretting about President Joe Biden's strength in the fall elections. A centrist Democrat, Suozzi was seeking to get back the job he had before he left to run, unsuccessfully, for the gubernatorial nomination in 2022. The special counsel report found that Biden willfully retained classified information, including top secret documents, and knew he was in possession of some documents as far back as 2017. House Oversight Committee Republicans, who have separately investigated Biden’s handling of classified documents, criticized Hur’s report before it was even released or delivered to Congress. “Most notably, after being given multiple chances to return classified documents and avoid prosecution, Mr. Trump allegedly did the opposite.” Hur wrote. “Among the places Mr. Biden’s lawyers found classified documents in the garage was a damaged, opened box containing numerous hanging folders, file folders, and binders,” the report said. CNN —Anti-war candidate Boris Nadezhdin has been barred from standing in Russia’s presidential election next month, in a move that further clears the country’s political landscape of opponents to Vladimir Putin.
