CNN —The Department of Justice doubled down on its decision to not release the audio files of President Joe Biden’s interview with special counsel Robert Hur to House Republicans, stating that Republicans have not established a legitimate legislative purpose for demanding these recordings, in a new letter obtained by CNN. The DOJ’s refusal to turn over the audio comes as Republicans find their impeachment inquiry into the president stalled now that the prospects of the investigation ending in impeachment are increasingly unlikely. Without the votes in their narrow majority or evidence of an impeachable offense, Republicans are now struggling with how to end their probe. Uriarte pointed to the possibility that audio files can be manipulated through “cutting, erasing, and splicing” in a way that increases the privacy concerns of the witness. Uriarte therefore accused Republicans of going after these audio files for the wrong reasons.

But Donald Trump’s return to his hush money trial Thursday does not even represent the most critical courtroom drama of his day. The ex-president’s attention is certain to stray from what he has repeatedly complained is a “freezing” court in New York to the neoclassical splendor of the US Supreme Court. Trump blames Judge Juan Merchan for dashing his hopes of being at the Supreme Court Thursday. Trump’s Supreme Court gambit is also part of his wider campaign strategy. CNN reporters in the courtroom said Trump was deeply engaged at times during Pecker’s earlier testimony.

CNN —The Gateway Pundit, the notorious far-right blog and prolific publisher of conspiracy theories, said Wednesday that it had filed for bankruptcy protection as it grapples with litigation related to its coverage of the 2020 election. Another lawsuit, filed by a former Dominion Voting Systems executive, accuses the outlet of defamation. The Gateway Pundit denies wrongdoing in both cases. Over the years, The Gateway Pundit has become infamous for its publishing of hyper-partisan blog posts, many of which advance dangerous lies and conspiracy theories. But on Tuesday, former National Enquirer boss David Pecker lifted the curtain on the actual media collusion that took place in the 2016 election. Pecker revealed in granular detail how Trump worked hand-in-hand with the infamous national tabloid to boost his candidacy and, perhaps far more importantly, simultaneously smear his political opponents with shameful lies and innuendo. Meanwhile, Pecker worked with Cohen to smear Trump’s Republican rivals in the 2016 primary, including Ben Carson, Ted Cruz, and Marco Rubio. At times, Pecker said that Cohen went as far as to contact him and direct the Enquirer to attack Trump’s GOP rivals. When the Enquirer published negative stories about Bill and Hillary Clinton, Pecker said that Trump was elated.

The judge will not order Trump jailed even if he does find he repeatedly violated the gag, Richman predicted. Trump's gag order bans Trump from making public statements about jurors and witnesses that could interfere with the trial. "The defendant has demonstrated his willingness to flout the order," Conroy told the judge last week. He has attacked Grand Jurors and jurors," Conroy said. The judge added, with some sarcasm, "I don't recall inserting that anywhere in either gag order."

"You're losing all credibility," the judge railed when Blanche insisted Trump was "careful" online. "You're losing all credibility," New York Supreme Court Justice Juan Merchan angrily told the lawyer, Todd Blanche. It was at this point that the judge accused Blanche of "losing all credibility." Blanche's arguments at Tuesday's hearing, in defense of Trump's posts, fell roughly into three categories. Blanche's third argument was that reposting attacks on trial witnesses that were originally made by others was somehow exempt.

The New York hush money trial of Donald Trump is set to resume Tuesday with testimony from its first witness, former National Enquirer publisher David Pecker. Most either referenced, or linked to articles referencing, Trump's former lawyer Michael Cohen, a key witness in the Manhattan Supreme Court trial. The posts "unquestionably relate to known witnesses and prospective jurors in this criminal trial" in violation of Trump's gag order, a state prosecutor wrote in a court filing Thursday. Defense lawyer Todd Blanche fired back, "I have a spoiler alert: There's nothing wrong with trying to influence an election. Protests over the Israel-Hamas war could also complicate this year’s convention and the Democratic messaging for President Biden, whom Republicans have eagerly cast as too indulgent of chaos and disorder in American society. Last week, Fox News and other conservative outlets repeatedly showed demonstrations that made the country seem on the edge: Columbia University sending in the police to arrest students on campus; protesters shouting “genocide!” at President Biden at a campaign stop; demonstrators chaining themselves to cars to block traffic, creating gridlock. “The whole Republican message is, ‘The world is out of control and Biden is not in command,’” said David Axelrod, the Democratic strategist and adviser to former President Barack Obama. “They will exploit any images of disorder to abet and support it.”

New York Supreme Court Judge Juan Merchan, who is overseeing the trial, told news outlets to watch how they report on the jurors and forbade the press from reporting where jurors are employed. The ruling came after one juror was dismissed from the trial after expressing concerns that portions of her identity had been made public by the news media. The juror told the judge she had concerns that she could not be impartial after those close to her asked if she was a juror on the case. Christine Cornell“We just lost what probably would’ve been a very good juror,” Merchan added. CNN —Uri Berliner, a National Public Radio senior editor who wrote a scathing online essay accusing the public radio network of harboring a liberal bias, said Wednesday he had resigned from the outlet. “I am resigning from NPR, a great American institution where I have worked for 25 years,” Berliner wrote in a resignation letter to NPR chief executive Katherine Maher, which he posted to his X account. Berliner’s resignation came after he was suspended for five days without pay over his 3,500-word piece in the anti-establishment publication The Free Press. In his resignation letter, Berliner said he did not support calls to defund NPR and that he wants to see the audio-focused outlet thrive. Berliner’s allegations of network bias were billed as a top story, with right-wing outlets and personalities portraying Berliner as a “whistleblower.”

CNN —There is a major disconnect between two CNN stories on Wednesday about Russia and the US. While it is mostly Republicans who oppose additional funding for Ukraine, they are still a minority, even within their own party. In February, 22 Republicans in the Senate joined all but three Democrats to form a 70-vote majority in favor of the funding. Asked about that propaganda comment by Tapper earlier this month, Rep. Mike Turner of Ohio, who chairs the House Intelligence Committee, agreed. Senator Tom Cotton, Republican of Arkansas, on Monday urged people whose routes were blocked by pro-Palestinian protesters to “take matters into your own hands” and confront the offenders, endorsing the use of physical force against peaceful demonstrators. In a series of social media posts after protesters shut down traffic in cities across the country including major roads in Oakland, Calif., the Golden Gate Bridge in San Francisco and near O’Hare International Airport in Chicago, Mr. Cotton called those responsible “pro-Hamas” and “criminals.”He also shared a clip of himself during a recent interview in which he said that if protesters had disrupted public roads in his home state of Arkansas, they would have been met with force from citizens. “Let’s just say I think there would be a lot of very wet criminals that would have been tossed overboard — not by law enforcement, but by the people whose road they are blocking,” he told Fox News in the interview. “If they glued their hands to their car or pavement, it’d probably be pretty painful to have their skin ripped off.”

The case against OAN was one of a spate of lawsuits filed against right-wing outlets in the aftermath of the election. In the wake of the 2020 presidential contest, pro-Donald Trump outlets spread lies wrongfully suggesting President Joe Biden had not been legitimately elected president. "How it should be done," the senator wrote in the post. On Monday, traffic came to an hourslong standstill on the Golden Gate Bridge in San Francisco and in major cities including Chicago, Seattle and New York as demonstrators planted themselves on the roads to draw attention to the war in Gaza.
