CNN —A federal judge on Monday is scheduled to sentence Alex Murdaugh – the 55-year-old former attorney already serving two life sentences for the murders of his wife and son – for nearly two dozen financial crimes following his guilty plea last year, according to the US Department of Justice. Murdaugh denies the claim, and his attorneys asked the judge to disregard the government’s motion during sentencing Monday. In a filing last week, prosecutors recommended Murdaugh be sentenced to between 17.5 and almost 22 years in prison. While Murdaugh insists he is innocent of the murders, he has admitted to the financial crimes, saying he was maintaining a yearslong opioid addiction. In exchange for his guilty plea, federal prosecutors agreed to recommend Murdaugh’s sentence be served concurrently with the one imposed in South Carolina, court filings show.

CNN —Alabama inmate Kenneth Smith was put to death Thursday night by nitrogen hypoxia, marking the nation’s first known execution to be carried out using that method. The execution process began at 7:53 p.m. CT Thursday, and Smith was pronounced dead at 8:25 p.m., according to Alabama Department of Corrections officials. Smith made a lengthy statement in front of the witnesses before the execution started, according to the pool reporters. Smith is due to be executed during a 30-hour window starting Thursday for his part in a 1988 murder for hire. The state 14 months ago aborted an effort to execute him by lethal injection because officials could not set an intravenous line before the execution warrant expired. CNN —Alabama has scheduled the nation’s first execution by nitrogen hypoxia, an alternative to lethal injection, its Republican governor said. He asked the state to be put to death by nitrogen gas rather than lethal injection after what he called a botched execution. Smith’s execution now is set to take place between January 25 and 26, according to a news release from Gov. The court’s action came after the justices divided 6-3 earlier in the term to allow Smith’s execution to go forward by lethal injection. CNN —Danelo Cavalcante, the convicted killer who escaped from a Pennsylvania prison, was seen overnight Saturday more than 20 miles from the search area where he was last reportedly sighted, according to state police. Cavalcante fled about two weeks after he was convicted of first-degree murder for the 2021 killing of his former girlfriend, Deborah Brandão, 33, in Chester County. Cavalcante was seen in or around Chester County’s Longwood Gardens – about 3 miles from the prison – several times last week. On Monday, a security camera recorded the fugitive at Longwood Gardens, authorities said. On Wednesday, a trail camera image showed Cavalcante in or around Longwood Gardens, but officials learned about this sighting Thursday evening, according to Bivens.

CNN —A University of South Carolina student was fatally shot early Saturday after he tried to enter the wrong home on his own street, the Columbia Police Department said – the latest case in which someone in the US was shot after apparently approaching the wrong home. “Preliminary information indicates that Donofrio who resided on South Holly Street attempted to enter the wrong home when he was fatally shot,” the release said. Police have not released any information about who shot Donofrio, adding they would consult prosecutors in the Fifth Circuit Solicitor’s Office as they investigate. The case is the latest in which the victim appears to have gone to the wrong place at the wrong time in a nation with more guns than people. CNN —Six former Mississippi law enforcement officers pleaded guilty Monday to all state charges against them stemming from the torture and abuse of two Black men earlier this year. Additionally, Dedmon was charged with home invasion and Elward was charged with home invasion and aggravated assault, the release says. McAlpin, Middleton, Opdyke and Hartfield each faced an additional charge of first-degree obstruction of justice. The Richland Police Department announced in July that Hartfield – who was off-duty at the time of the alleged assault – had resigned. An attorney for Opdyke said the former officer “has admitted to his wrongdoing” and will plead guilty to all charges against him in Rankin County Circuit Court on August 14.

CNN —The actress Leah Remini has filed a lawsuit against the Church of Scientology and its leader, David Miscavige, claiming she has suffered years of harassment, intimidation and defamation as part of an organized campaign of retaliation for her criticism of the church since leaving it a decade ago. CNN —Mass shootings, like the ones that occurred Monday in Philadelphia and Fort Worth, Texas – and over the weekend in Baltimore — are not uncommon around the Fourth of July. The holiday has accounted for the most mass shootings of any other days of the year in nearly a decade, according to a CNN analysis of the Gun Violence Archive’s mass shooting data since 2014. So far, there have been at least 10 mass shootings on July 4 and 5, according to GVA. Summer days overall have higher numbers of mass shootings than other times of the year, according to CNN’s analysis. Of the top 10 calendar days with the highest number of mass shootings since 2014, all but one — New Year’s Day — was in June, July or August.

CNN —A jury has acquitted on all counts the former school resource officer who stayed outside during the February 2018 massacre at Marjory Stoneman Douglas High School in Parkland, Florida – absolving him of wrongdoing in the rare trial of a law enforcement officer for his response to a mass shooting. His attorney argued the then-Broward Sheriff’s Office deputy didn’t enter the building under attack because he couldn’t tell where the shots were coming from. And even if Peterson had known where the shooter was, speculation he could have made a difference is false, Eiglarsh argued. Eiglarsh emphasized Peterson was at the scene for the last 4 minutes and 15 seconds of the shooting, which lasted about 6 1/2 minutes. Peterson also arrived at the scene without a bulletproof vest or rifle and called for measures to lock down the school, the attorney told jurors.
