Trump’s claim that he is immune from prosecution, his stance was widely seen as a brazen and cynical bid to delay his trial. The practical question in the case, it was thought, was not whether the court would rule against him but whether it would act quickly enough to allow the trial to go forward before the 2024 election. Instead, members of the court’s conservative majority treated Mr. Trump’s assertion that he could not face charges that he tried to subvert the 2020 election as a weighty and difficult question. They did so, said Pamela Karlan, a law professor at Stanford, by averting their eyes from Mr. Trump’s conduct. “What struck me most about the case was the relentless efforts by several of the justices on the conservative side not to focus on, consider or even acknowledge the facts of the actual case in front of them,” she said.

Donald Trump’s claim that he has absolute immunity for criminal acts taken in office as president is an insult to reason, an assault on common sense and a perversion of the fundamental maxim of American democracy: that no man is above the law. More astonishing than the former president’s claim to immunity, however, is the fact that the Supreme Court took the case in the first place. It is a process so vital, and so precious, that its first occurrence — with the defeat of John Adams and the Federalists at the hands of Thomas Jefferson’s Republicans in the 1800 presidential election — marks a second sort of American Revolution. And if the trial occurs after an election in which Trump wins a second term and he is convicted, then the court will have teed the nation up for an acute constitutional crisis. A president, for the first time in the nation’s history, might try to pardon himself for his own criminal behavior.

To the Editor:Re “Split Court Hints at Some Immunity for Ex-Presidents” (front page, April 26):Incredibly, though perhaps not surprisingly, it is patently clear that the conservative justices on the Supreme Court, based on their questions and statements made during argument, are breaking ground for the demise of our democracy. These justices have left no doubt that they disagree with the holding of the lower courts and will find that Donald Trump enjoys at least some degree of immunity from criminal prosecution for acts while he was president. Further, it is apparent that they will send the case back to the trial court with instructions to make findings about whether the charges brought by the special counsel, Jack Smith, against Mr. Trump involved official or private acts. This will ensure that a trial of the case cannot be held before the November election. What is surprising is the painfully inadequate response of the liberal justices and the missed opportunities for the special counsel to present his case about efforts to overturn the 2020 election with greater cogency and passion.

On Thursday, the Supreme Court gathered to consider whether Donald Trump, as president, enjoyed immunity from prosecution for attempting to overturn the 2020 election. Even if the justices eventually rule against him, liberals should not celebrate the Constitution as our best bulwark against Mr. Trump. Each of these efforts has been motivated by a worthy desire to hold Mr. Trump accountable for his actions. It is not just that Mr. Trump would never have been president without the Electoral College. Think about why those previous efforts to use the Constitution to hold Mr. Trump accountable failed.
