Washington CNN —Former President Donald Trump isn’t immune from being held accountable in civil lawsuits related to the January 6, 2021, US Capitol riot in a long-awaited, consequential decision from the federal appeals court in Washington, DC. The decision arises out of lawsuits brought by Capitol Police officers and Democrats in Congress. The district court did find that Trump was protected by presidential immunity from the claim that he failed to stop to the riot, saying that he would be acting in his official presidential powers in that instance. Trump still will be able to contest the facts of the case as the lawsuits move forward. The appeals court said Trump also may be able to make more arguments around immunity before the January 6 lawsuits move into extensive evidence-gathering phases.

Despite Trump’s much-vaunted travel ban, there was plenty of terrorism on his watch as the 45th president of the United States. Also, the most lethal antisemitic attack ever in the United States took place on October 27, 2018, when a terrorist killed eleven people at the Tree of Life Synagogue in Pittsburgh. It seems, at least in Trump’s mind, that lethal acts of terrorism carried out by far-right terrorists don’t count as terrorism. Terrorism did not disappear with Trump, and his proposed “solution,” were he to become president again – amping up the Muslim travel ban – likely won’t accomplish much of anything. As Trump spends more time on the campaign trail, we will surely be seeing more factually challenged statements of this type.

CNN —A former appointee of Donald Trump was sentenced Friday to 70 months in prison for his violent role on January 6, 2021. Federico Klein, a former State Department appointee, was found guilty following a bench trial before Judge Trevor McFadden this summer of multiple counts, including assaulting multiple police officers that day. “Your actions on January 6 were shocking and egregious,” McFadden, also a Trump appointee, said during Friday’s sentencing. Aquilino Gonell told the court that Klein had attacked him multiple times with a police riot shield. Klein’s actions on January 6, Woodward said, were “not a betrayal” of his service in the military and the State Department, but was part of attending “a protest turned wrong.”

CNN —An Alaska man was arrested on Monday after allegedly sending a threatening message to a US senator, writing that he planned to hunt down and physically harm the senator, according to court documents. Arther Charles Graham is charged with making interstate threats to kidnap and injure a current US senator, according to a statement from the Department of Justice. Court documents do not identify the senator, only referring to “she” and “her.” Republican Sen. Lisa Murkowski is the only current female Alaska senator. Graham wrote that he was facing eviction and said that he had “nowhere else to live,” according to court documents. US Capitol Police are investigating with the FBI Anchorage Field Office, Kenai Police Department and Alaska State Troopers, according to the Justice Department.
