CNN —The Supreme Court returns to Washington to face a new term and the fresh reality that critics increasingly view the court as a political body. Earlier this year, Roberts declined an invitation to appear before the Democratic-led Senate Judiciary Committee to discuss Supreme Court ethics, citing separation of powers concerns. Even if he did believe a formal ethics code is necessary, it’s unclear whether he would need a unanimous vote to move forward. Washington CNN —Justice Clarence Thomas attended a private dinner in 2018 during a winter donor summit of the Koch network, the political organization founded by libertarian billionaires Charles and David Koch, ProPublica reported Friday. Thomas attended Koch donor events at least twice over the years, according to interviews with three former Koch network employees and one major donor conducted by ProPublica. Thomas arrived for the 2018 dinner on a Gulfstream G200 jet, although a Koch network spokesperson told the outlet that the network did not pay for the private jet and it was not disclosed on his financial disclosure forms for that year. A spokesperson for the Koch network told ProPublica that Thomas wasn’t present for fundraising conversations. CNN has reached out to the Supreme Court for comment.

CNN —Justice Clarence Thomas disclosed Thursday that Republican megadonor Harlan Crow paid for private jet trips for Thomas in 2022 to attend a speech in Texas and a vacation at Crow’s luxurious New York estate, as ethics questions continue to rock the Supreme Court. Thomas made the disclosures after receiving an extension to file the yearly reports that were originally due in May 2023. In a statement after the ProPublica report, Thomas acknowledged the friendship but stressed that Crow did not have business before the court. In addition, he said that he should have disclosed a 2014 private real estate deal between Crow, Thomas and members of Thomas’ family. According to the disclosure, Thomas flew down to be the keynote speaker of the event in February, but returned via private jet “due to an unexpected ice storm.”The talk was rescheduled in May and Thomas rode round trip on Crow’s plane.

Business conditions in China’s manufacturing industry, the largest in the world, improved in May, according to the Caixin manufacturing Purchasing Managers’ Index. Globally, manufacturers’ optimism fell to its lowest level since December, according to the JPMorgan Global Manufacturing PMI. The possibility of China reinvigorating global economic growth is slipping. CNN —The Supreme Court on Thursday ordered Alabama officials to redraw the state’s congressional map to allow an additional Black majority district to account for the fact that the state is 27% Black. The federal court ordered the creation of another majority Black district to be drawn. He said it would be impossible to draw a second majority Black district in the state without taking race into consideration. Instead, she wrote, the state plan “divides the Black voters within this well-established community of interest across several districts, and as a result, Black Alabamians have no chance to elect their preferred candidates outside of” the one Black majority district. “Black voters are significantly numerous and compact to form a majority in a reasonably configured district, as the district court specifically found,” she said.

Washington CNN —Democrats on the Senate Judiciary Committee have asked Harlan Crow, the GOP megadonor and friend of Clarence Thomas whose gifts to the Supreme Court justice have prompted fresh criticism about the ethical standards of the nation’s highest court, for more information about the expenditures. The letters also state that the recent revelations come amid a lack of American confidence in the Supreme Court, pointing to recent polling. Washington CNN —The Supreme Court agreed Monday to reconsider long held precedent and decide whether to significantly scale back on the power of federal agencies in a case that can impact everything from how the government addresses everything from climate change to public health to immigration. Conservative justices have long sought to rein in regulatory authority, arguing that Washington has too much control over American businesses and individual lives. The justices have been incrementally diminishing federal power but the new case would allow them to take a much broader stride. CNN —The Supreme Court on Friday protected access to a widely used abortion drug by freezing lower-court rulings that placed restrictions on its usage. How the dispute over medication abortion is ultimately resolved could make it more difficult for women to obtain abortion, even in the states that still allow it. At issue is the scope of FDA’s authority to regulate mifepristone, a drug that the medical community has deemed safe and effective. The next step in the litigation will be a hearing in front of a New Orleans-based federal appeals court on May 17. The appeals court ultimately let stand the government’s approval of the drug, but agreed with Kacsmaryk that access could be limited.

CNN —The Supreme Court held Friday that a party involved in a dispute with the Federal Trade Commission or the Securities and Exchange Commission does not have to wait until a final determination in the proceeding has been issued before bringing a constitutional challenge to the agency’s structure in federal court. The court’s decision means that targets of investigative actions do not have to wait long periods of time before lodging constitutional challenges to the proceedings that could ultimately weaken the agency. Although the court’s opinion could weaken the power of federal agencies, liberal justices likely signed onto the opinion because it will only apply to a small subset of cases. “The question presented is whether the district courts have jurisdiction to hear those suits — and so to resolve the parties’ constitutional challenges to the Commission’ structure,” Kagan wrote. The ordinary statutory review scheme does not preclude a district court from entertaining these extraordinary claims.”
