Nigeria regulator says local Binance operations 'illegal'
  + stars: | 2023-06-10 | by ( ) www.reuters.com   time to read: +1 min
LAGOS, June 10 (Reuters) - Nigeria's markets regulator has ordered the world's largest cryptocurrency exchange Binance to halt its operations in the country, saying a local unit that courted Nigerian investors through a website was illegal. "Binance Nigeria Limited is hereby directed to immediately stop soliciting Nigerian investors in any form whatsoever," the Securities and Exchange Commission (SEC) said in a statement dated June 9. The U.S. Securities and Exchange Commission this week sued Binance and Coinbase for allegedly breaching its rules. That was after Nigeria's central bank in 2021 banned banks and financial institutions from dealing in or facilitating transactions in digital currencies. Nigeria's young, tech-savvy population has eagerly adopted cryptocurrencies, for example using peer-to-peer trading offered by crypto exchanges to avoid the financial sector ban.

"Everything on Sale" signs at a Buy Buy Baby store in the Brooklyn borough of New York, US, on Monday, Feb. 6, 2023. The auction process for Bed Bath & Beyond and its assets was extended once again as discussions progress with potential bidders, namely for its Buy Buy Baby chain of stores. In court papers filed Thursday, Bed Bath & Beyond said it would delay its sale timeline by a few days "to ensure the most value maximizing transaction is achieved." The assets of the baby gear retailer Buy Buy Baby had earlier attracted interest from at least two bidders, including Babylist, CNBC previously reported. Buy Buy Baby has been considered the crown jewel of the assets, reportedly attracting interest in 2022 and in the months ahead of the bankruptcy filing.

Binance.US urged its customers to withdraw cash from the crypto exchange in a recent notice. The moves are part of an "ideological campaign" against the US crypto industry, Binance said. WASHINGTON, June 8 (Reuters) - Other U.S. crypto exchanges are likely to be in the firing line after the Securities and Exchange Commission (SEC) this week sued Coinbase and Binance, two of the world's largest crypto exchanges, for allegedly breaching its rules. Both Coinbase and Binance deny the SEC's allegations and have pledged to vigorously defend themselves in court. The Coinbase and Binance suits this week expand that list to include some commonly traded tokens, such as Solana, Cardano and Polygon. While big crypto companies can afford to fight the SEC, smaller companies have filed for bankruptcy following SEC enforcement actions, including crypto exchange Beaxy. "I think if there's a real value in these crypto tokens, then compliance will build trust and the business model might change," he said.

But the Coinbase case will be the biggest test yet of the regulator's jurisdiction over the industry. To argue that crypto assets are securities, the SEC has relied on a U.S. Supreme Court case from 1946. WHAT MAKES A CRYPTO ASSET A SECURITY? In the few cases that have been decided in court, judges have agreed with the SEC that specific crypto assets are securities. The SEC has alleged in the Coinbase case that 13 different digital assets sold on the platform are securities.

The lawsuit is the SEC's second in two days against a major crypto exchange, following its case against Binance, the world's largest cryptocurrency exchange, and founder Changpeng Zhao. Crypto companies including Coinbase have said SEC rules are unclear, and the regulator is overreaching by asserting oversight of their industry. Coinbase customers pulled more than $57 million from the exchange within a couple of hours of the filing, according to data firm Nansen. The SEC said Coinbase traded at least 13 crypto assets that are securities that should have been registered, including tokens such as Solana, Cardano and Polygon. The U.S. Securities and Exchange Commission sued Coinbase, accusing it of illegally operating without registration with the regulator. That happened a day after the SEC filed a lawsuit against Binance and its CEO, Changpeng Zhao. Coinbase shares were down 13.4% at $50.81 after earlier hitting their lowest level since January. Also, after falling earlier, Bitcoin , the world's biggest cryptocurrency, was up 1.4%. On Tuesday, the US Securities and Exchange Commission sued Coinbase, America’s largest crypto exchange, for allegedly acting as an unregistered broker. “Since at least 2019, Coinbase has made billions of dollars unlawfully facilitating the buying and selling of crypto asset securities,” the SEC said in a press release. The Coinbase lawsuit comes on the heels of a similar SEC complaint against Binance, which is by far the world’s biggest crypto exchange. Since then, digital asset prices have tanked and regulators have stepped up their scrutiny of the industry. “It should get crypto closer to final rules of the road regardless of how the judge rules.”

Coinbase stock had already fallen 9% on Monday, after the SEC unveiled charges against rival crypto exchange Binance and its founder Changpeng Zhao. Coinbase's flagship prime brokerage, exchange and staking programs violate securities laws, the regulator alleged in its complaint. The SEC has alleged that at least 13 crypto assets available to Coinbase customers were considered "crypto asset securities" by the regulator. Coinbase's institutional service, Prime, its retail exchange product, and its self-custody Wallet service all offered one or more crypto asset security, the SEC said in its complaint. Coinbase's staking program was also identified as a investment contract and as an unregistered security: The SEC had already taken similar action to force the closure of crypto exchange Kraken's staking service.

It's only Tuesday, but the Securities and Exchange Commission has already brought legal action against two of the biggest platforms in crypto – and to the surprise of some, crypto prices are climbing. What began as a muted reaction Tuesday to the SEC's lawsuit against Coinbase , the largest U.S. crypto exchange and first publicly listed crypto company, turned into a positive one. At one point in the afternoon, bitcoin and ether had nearly recovered their losses from the previous day's crypto market sell-off, sparked by the SEC's lawsuit against Binance, the largest crypto exchange in the world. Investors are also now anticipating another Fed rate hike, which has typically weighed on crypto prices. "Crypto prices are up 60% or more YTD, the crypto winter is over," he added.

Bottom line: “The SEC looks like it is playing Whac-A-Mole with crypto exchanges,” Moya wrote. Because of that, crypto investors will have to decide whether they are confident that the offerings on various exchanges will remain available to trade.

June 5 (Reuters) - Cryptocurrencies and shares in crypto and blockchain-related companies tumbled on Monday after the U.S. securities regulator sued crypto exchange Binance, another blow to the industry. The SEC crackdown has prompted some crypto companies to increase compliance, spike products, and expand overseas, moves that some marketwatchers said would likely be accelerated by this latest action against the world's largest crypto exchange. In April, the SEC charged crypto exchange Bittrex Inc with operating an unregistered securities exchange, broker and clearing agency, and settled with Kraken in February for $30 million over the exchange's U.S. crypto staking service. Shares of Coinbase (COIN.O) were down 9.1% on the news of the SEC's charges against Binance. Both Coinbase and crypto exchange Gemini launched international exchanges for crypto derivatives in May.

The bill proposes a clearer pathway for the registered offer and sale of digital assets. Crypto exchanges have been calling for regulatory clarity in the wake of expansive enforcement actions that have left companies and developers scrambling to move operations beyond the U.S. Crypto exchanges Coinbase and Gemini have both announced off-shore exchange operations. Coinbase also is engaged in a bruising courtroom battle with the SEC over the very issues that apparently prompted the McHenry-Thompson bill. The crypto exchange received a Wells notice, a warning of impending enforcement action, from the SEC earlier this year. The draft bill will likely be reshaped and modified in coming weeks and months, but it represents a powerful vote of support from two influential Republican members.

Crypto exchange Gemini to soon operate in the UAE
  + stars: | 2023-06-01 | by ( ) www.reuters.com   time to read: +1 min
June 1 (Reuters) - Gemini will "soon" start the process of buying a crypto license to operate in the United Arab Emirates, and the team has met stakeholders throughout the region to learn more about local regulatory requirements, the crypto exchange said late on Wednesday. Gemini, founded by cryptocurrency pioneers and identical twins Cameron and Tyler Winklevoss, is aiming for the "adoption of crypto globally across 20 countries." "By applying for a license, we will be taking another step towards making Gemini a truly global company," the exchange said in a blog post. Digital assets industry is recovering from several blow-ups last year, including the bankruptcy of Sam Bankman-Fried's crypto exchange FTX and companies are looking to expand their global footprint amid escalating tensions between the crypto sector and regulators in the United States. Gemini, earlier in May, also launched a derivatives platform for trading perpetual futures, outside the U.S. jurisdiction.
