In the mifepristone case, Kacsmaryk’s initial ruling was notable not just for its sweeping nature but in how he embraced the anti-abortion movement’s sensational rhetoric about the procedure. The groups fighting mifepristone argue that the Supreme Court’s decision shouldn’t affect the states’ ability to sue. Both the FDA and several medical groups, including the American Medical Association, told the Supreme Court that mifepristone is safe. But the Supreme Court knocked that argument aside, noting that federal law already allows doctors to avoid performing procedures that violate their conscience. Adam Unikowsky, a veteran Supreme Court litigator who has closely followed the mifepristone case, predicted it will be hard for the states to get the issue back before the Supreme Court.

The Supreme Court Rejected the Ban on Bump Stocks

The Supreme Court today struck down a ban on bump stocks, which enable semiautomatic rifles to fire rapidly like machine guns. The ban was enacted by the Trump administration after a deadly mass shooting in Las Vegas in 2017. The decision, by a vote of 6 to 3, split along ideological lines. Justice Sonia Sotomayor filed a dissent along with two other judges, saying the decision “puts machine guns back in civilian hands.” President Biden urged Congress to act to ban the device. The man who challenged the bump stock ban, a gun shop owner in Texas, said that the ruling was a broader victory for gun rights and that it would make it easier to challenge future attempts by the A.T.F.

Bump stocks allow a shooter to convert a semi-automatic rifle into a weapon that can fire at a rate of hundreds of rounds a minute. The federal rule made possession of a bump stock a crime punishable by up to 10 years in prison. Both the Trump and Biden administrations, as well as gun control groups, said the way bump stocks work mean they qualify as machine guns. Trump described bump stocks at the time as converting “legal weapons into illegal machines.”ATF estimated that as many as 520,000 bump stocks were sold between 2010 and 2018. “Without this ongoing manual input, a semiautomatic rifle with a bump stock will not fire multiple shots.

The Supreme Court struck down on Friday a ban on bump stocks enacted by the Trump administration after a deadly mass shooting in Las Vegas in 2017. By a vote of 6 to 3, with the court splitting along ideological lines, the justices found that the Trump administration had exceeded its power when it prohibited the device, an attachment that enables a semiautomatic rifle to fire at a speed rivaling that of a machine gun. The decision is a forceful rejection of one of the government’s few steps to address gun violence, particularly as legislative efforts have stalled in Congress.
Persons: Trump Locations: Las Vegas
The ban on bump stocks overturned by the Supreme Court on Friday was a rarity in an era of deep division over gun violence: a restriction that won support from Democrats, Republicans and even the National Rifle Association. Bump stocks are attachments that allow a semiautomatic rifle to fire faster. The effort to limit them, which former President Donald J. Trump put in place by executive order in 2018, gained support after a gunman killed 60 people at a concert in Las Vegas. What happened in Las Vegas? The gunman killed 58 people and himself that night.

Read previewThere's "little doubt," Supreme Court Justice Samuel Alito wrote, that Congress would have considered bump stocks akin to a machine gun. AdvertisementThe Supreme Court on Friday struck down the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) rule that classified bump stocks as "machine guns." He argued it had been too broad in interpreting firearms law and that Congress never explicitly meant to ban bump stocks, challenging the law on statutory grounds, not Second Amendment protections. "A bump stock does not convert a semi-automatic rifle into a machinegun any more than a shooter with a lightning-fast trigger finger does," Thomas wrote. AdvertisementBut Alito said Congress needs to be explicit that it wants to ban bump stocks, too, by amending the law or passing a new one.

“The American principle that no one is above the law was reaffirmed,” President Biden said after former President Donald J. Trump was convicted last month of falsifying records to cover up a sex scandal. “No one in this country is above the law,” David Weiss, the special counsel who prosecuted Hunter Biden on gun charges, said after Mr. Biden was convicted this week. The expression has been used by plenty of political figures in recent weeks, including Vice President Kamala Harris (“Donald Trump thinks he is above the law,” she said at a recent campaign event). The phrase “above the law” has appeared in The New York Times 100 times this year alone. The specific origin of the phrase is not clear, with several people getting credit for pushing it forward.

President Biden said on Thursday that he would not commute the sentence of his son, Hunter Biden, who was convicted this week on three federal felony counts for lying on a federal form about his drug addiction when he bought a handgun in 2018. In response to a question at the Group of 7 summit in Italy, Mr. Biden reiterated his earlier position that he would not pardon his son. “I’m extremely proud of my son Hunter,” Mr. Biden said. I am satisfied that, I’m not going to do anything. I will do that.”As he was leaving the stage, Mr. Biden was asked if he would use his authority to issue a commutation, which would leave the guilty verdict intact but wipe out some or all of the punishment.

In his first reaction to the verdict, Hunter Biden didn’t attack the judge or prosecutors, simply saying he was grateful for the love and support of his family and blessed to be clean again. The Hunter Biden verdict also contradicted the central rationale of Trump’s multiple legal defenses in his four criminal cases, several civil matters and his entire presidential campaign. “So much for the weaponization of the Justice Department to go after just the enemies of the other side,” Michael Zeldin, a former senior Justice Department official and federal prosecutor, said on CNN Max on Tuesday. Stephen Miller, Trump’s former White House domestic policy adviser, argued that the Justice Department had actually shown favoritism toward Hunter Biden by not charging him with 50 felonies over foreign influence peddling. “Hunter Biden just became the Deep State’s sacrificial lamb to show that Justice is ‘balanced’ while the other Biden crimes remain ignored,” she wrote on X.

There was nothing abstract about the 6-to-3 decision issued Friday morning by the Supreme Court to permit bump stocks to be used on semiautomatic rifles. It is one of the most astonishingly dangerous decisions ever issued by the court, and it will almost surely result in a loss of American lives in another mass shooting. Bump stocks attach to the back of a rifle and use the gun’s recoil to enable shooting hundreds of bullets at a very rapid pace, far faster than anyone could shoot by pressing the trigger multiple times. Bump stock devices were banned the next year, just as all fully automatic machine guns are banned for public use, but the six conservative members of the court seemed entirely unbothered by their deadly potential. The opinion, written by Justice Clarence Thomas, parses in a ridiculous level of detail whether bump stocks truly fit the precise mechanical definition of a machine gun.

Hunter Biden is expected to appeal his felony conviction for falsifying a federal firearms application, likely arguing that the judge in the case violated his constitutional rights in her instructions to the jury, according to people in his orbit and legal experts. Mr. Biden’s lawyer Abbe Lowell has also signaled that any appeal would be based on the Supreme Court’s landmark decision in 2022 that vastly expanded gun rights, a ruling that spawned legal challenges to the part of the federal firearms form at the center of the Biden case. In Mr. Biden’s case, it included a question asking buyers about their drug use. There is still a possibility that David C. Weiss, the special counsel in the case, will seek a plea agreement before the tax trial begins, and would have leverage in negotiations now that Mr. Biden is already a convicted felon, according to former prosecutors. Mr. Biden might have greater incentive to reach a deal to avoid another public airing of his personal ordeal beyond what was presented in Wilmington last week.

Why Redstone ultimately vetoed the deal is now up for discussion. Chief among them was whether the deal should have been subject to approval from a majority of the minority shareholders. And tried they did over the last several months, with the negotiations claiming several high-profile casualties along the way. A jury in Wilmington, Del., on Tuesday found Hunter Biden, President Biden’s son, guilty of three felony counts for lying on a federal firearms application, a shattering blow for the Biden family in the middle of an unforgiving presidential election campaign. The verdict brought an end to an extraordinary seven-day trial that made painfully public Mr. Biden’s crack addiction, reckless behavior and ruinous spending — narrated by three former romantic partners, including the widow of his brother, Beau Biden, and by the defendant himself in the pages of his memoir. The charges that Mr. Biden was convicted of stem from the purchase of a Colt pistol in October 2018, and also included illegal possession of a weapon after falsely claiming to be drug-free on the standard background check required in all firearms transactions. Mr. Biden, 54, faces up to 25 years in prison, although federal sentencing guidelines call for a fraction of that penalty. First-time offenders who did not use their weapons to commit violent crimes typically see little jail time, and prosecutors suggested they would not seek a sentence more severe than for any other person convicted in such a case.
