The indictment comes weeks after the collapse of a plea deal that would have averted a criminal trial and distracting headlines for President Joe Biden. Trump's include federal indictments over the handling of classified documents and efforts to overturn his 2020 election loss to Joe Biden. Trump also pointed to the lack of connection to Joe Biden in the gun charge plea agreement. Federal prosecutors investigating Hunter Biden have not indicated Joe Biden is connected over the course of their yearslong probe. Two FBI agents who worked on the Hunter Biden case testified separately behind closed doors this week to lawmakers about allegations of political interference in the case.

Images: AP/Zuma Press/Reuters Composite: Mark KellyWashington is girding for a spending showdown, as Republicans and Democrats strategize on how to get more of what they want from a divided Congress. The impeachment inquiry comes at a fragile political moment for the president. An impeachment inquiry would give Republicans broad new powers to request documents and testimony about the Bidens. For now, the White House views the situation from a communications standpoint rather than as a legal issue. “Kevin McCarthy, Marjorie Taylor Greene, and MAGA Republicans just launched a beyond ridiculous impeachment inquiry into President Biden,” the fundraising email reads. An element of the White House strategy is keeping him focused on his governing duties, including plans to deliver what the White House has billed as a “major economic address” in Maryland on Thursday.

Republicans have accused the Democratic president of profiting while he served as vice president from 2009 to 2017 from his son's foreign business ventures, an accusation the White House denies. With a five-vote margin in the House — and 18 House GOP members representing districts President Joe Biden won — the math just doesn’t work. The impeachment of President Andrew Johnson during Reconstruction and the impeachment inquiry into President Richard Nixon for Watergate were separated by more than a century. The impeachment of President Bill Clinton and the double impeachment of President Donald Trump were separated by a little more than 20 years. The only silver lining in this dark cloud over the Biden White House comes from independents’ take on the alternative. As our colleague Harry Enten points out, just 33% of independents think Biden did something illegal, according to a recent Fox News poll.

That should be no surprise considering that a consistent proponent of this inquiry was former President Donald Trump. I make that judgment based on my work as a scholar of impeachment and also as a practitioner who helped lead the first Trump impeachment and trial as counsel to the House Judiciary Committee. McCarthy bitterly — and now hypocritically — criticized former Speaker Nancy Pelosi for announcing the first Trump impeachment before a vote (she later scheduled one). That includes examples like the inquiry into President Richard Nixon and the second Trump impeachment. The proposed Biden impeachment is a revenge mission and nothing more.

CNN —The initiation of an impeachment investigation against a president ought to be an earthshaking moment in the nation’s history. Republicans could use an impeachment investigation of the president to fuel public suspicion over Hunter Biden’s cascading controversies. But the coming impeachment investigation represents a gamble for Republicans since it could cause a backlash in moderate districts that their majority depends on. Ian Sams, a White House spokesman for oversight and investigations, blasted the impeachment investigation as “extreme politics at its worst.”But the strain of an impeachment inquiry is hardly the way the White House would have preferred to prepare for election year. If the impeachment investigation does uncover more direct involvement of Joe Biden, condemnations of McCarthy’s action may have been premature.

WHAT IS AN IMPEACHMENT INQUIRY? An impeachment inquiry is a formal step that can precede a House vote on whether to approve articles of impeachment and eventually a trial in the Senate. It did not hold a full impeachment inquiry before bringing impeachment charges in the final weeks of Trump's presidency following the Jan. 6, 2021, Capitol attack. Weiss has said prosecutors will seek to indict Hunter Biden on tax and gun charges by Sept. 29. House Speaker Kevin McCarthy's announcement that he has directed GOP-led House committees to open an impeachment inquiry into President Joe Biden was the long-anticipated retribution that White House aides had been waiting for, after House Democrats twice impeached Donald Trump during his term in office. Ever since Republicans retook the House majority last year, the White House has been building a team of legal experts and spokespeople to counter the congressional inquiry launched into the president and his son, Hunter Biden. Rep. Marjorie Taylor Greene, R-Ga., said she would not vote on any necessary budget bills unless the House opened an impeachment inquiry. The White House said caving to their demands would show that the exercise is a "costly, illegitimate, politically-motivated exercise not rooted in reality." "The time for impeachment is the time when there's evidence linking President Biden — if there's evidence linking President Biden — to a high crime or misdemeanor.

Mr. Biden has made false or overly simplistic statements about his son’s business dealings, and what he knew about them. Mr. McCarthy’s claim: “President Biden did lie to the American people about his own knowledge of his family’s foreign business dealings.”The facts: It is not clear whether Mr. Biden willfully misrepresented his son Hunter Biden’s business dealings. In 2019, Mr. Biden repeatedly said he had “never discussed” and had “never spoken to” Hunter about his business dealings, and Republicans have produced no evidence that he was ever briefed on specific transactions or deals. House Republicans have uncovered proof that the elder Mr. Biden was aware of and met some of his son’s business partners, raising questions about whether the president’s statements were misleading. In Hunter Biden’s book, he recounted how his father called him after Hunter joined the board of the Ukrainian energy company Burisma and warned, “I hope you know what you’re doing” — an acknowledgment of at least one conversation apparently unrelated to the details of any business dealings.

But Tuesday’s move was a break with the past and a major change in strategy for Mr. McCarthy, who previously indicated that he believed the full House should vote — as it has in past presidential impeachments — on whether to move forward with an impeachment inquiry. Several Republicans, including those from districts Mr. Biden won, indicated they did not support an impeachment inquiry unless investigators could tie the business dealings of Hunter Biden, the president’s son who engaged in transactions with overseas firms, to his father, or uncover evidence of high crimes and misdemeanors. In brief remarks at the Capitol, Mr. McCarthy accused Mr. Biden of lying about his knowledge of his son’s business dealings, and he raised questions about the millions Hunter Biden and other family members made from overseas firms. Mr. McCarthy also accused the Biden administration of giving his son Hunter “special treatment” in a criminal tax investigation against him. “House Republicans have uncovered serious and credible allegations into President Biden’s conduct,” Mr. McCarthy said.

When House Speaker Kevin McCarthy directed three House committees to proceed with an impeachment probe into President Joe Biden on Tuesday, despite an earlier commitment to put the question to a House vote in an apparent appeal to conservatives in his conference, he may have anticipated that his critics on the right would take a day off. CNN —House Speaker Kevin McCarthy announced Tuesday he is calling on his committees to open a formal impeachment inquiry into President Joe Biden, even as they have yet to prove allegations he directly profited off his son’s foreign business deals. While McCarthy has already publicly threatened to launch an inquiry, sources say that McCarthy has sent even stronger signals about his intentions behind closed doors. Punchbowl first reported McCarthy’s expected message on an impeachment inquiry. But Tuesday’s news will mark a real effort by McCarthy to start moving ahead and get House Republican skeptics on board with proceeding. House Republican leadership will need to formally whip votes at some point which they have not yet done.

CNN —The White House plans to send a letter to top US news executives on Wednesday, urging them to intensify their scrutiny of House Republicans after Speaker Kevin McCarthy launched an impeachment inquiry into President Joe Biden, despite having found no evidence of a crime. “It’s time for the media to ramp up its scrutiny of House Republicans for opening an impeachment inquiry based on lies,” Ian Sams, a spokesperson for the White House Counsel’s Office, wrote in the letter, according to a draft copy obtained by CNN. The correspondence comes one day after McCarthy announced that he had directed three House committees to begin an impeachment inquiry into Biden. In its letter Wednesday, the White House will ask news organizations to be more clear-eyed in their coverage of the impeachment inquiry, and not to fall prey to the traps of false equivalency in reporting. The Republican House-led investigations into Biden have yet to provide any direct evidence that the president financially benefited from Hunter Biden’s career overseas.
