(AP) — The Oregon Supreme Court said Thursday that 10 Republican state senators who staged a record-long walkout last year to stall bills on abortion, transgender health care and gun rights cannot run for reelection. The decision upholds the secretary of state’s decision to disqualify the senators from the ballot under a voter-approved measure aimed at stopping such boycotts. Measure 113, passed by voters in 2022, amended the state constitution to bar lawmakers from reelection if they have more than 10 unexcused absences. The senators’ lawsuit was filed against Secretary of State LaVonne Griffin-Valade, who last August said the boycotting senators were disqualified from seeking reelection. Oregon voters approved Measure 113 by a wide margin following Republican walkouts in the Legislature in 2019, 2020 and 2021.

CNN —While former President Donald Trump’s path through Republican primaries is clearing up, he faces looming unanswered questions in multiple different courts. Engoron had already ordered the dissolution of Trump’s New York real estate empire, which is on hold pending Trump’s appeal. The US Supreme Court has, for now, declined to take up the case, because justices wanted this particular appeals court panel to weigh in. Trump will remain on the ballot for Colorado’s primary pending the Supreme Court decision. While the situation is unlikely, at least for now, to kill the case against Trump, Willis’ position at the helm is very much in question.

While we await oral argument in Trump v. Anderson — the Supreme Court case that will evaluate the Colorado Supreme Court’s decision to exclude the former president from the state’s Republican primary ballot — it’s worth revisiting the arguments leveled against the Colorado court’s decision and, by extension, its interpretation of Section 3 of the 14th Amendment to the U.S. Constitution. The first and most important one is that the plot to overturn the results of the 2020 presidential election, culminating in the Jan. 6 attack on the United States Capitol, was not an insurrection. Related to this is the argument that, even if Jan. 6 was an insurrection, it’s still not clear that Donald Trump was an insurrectionist. If that isn’t persuasive, consider the evidence marshaled by the legal scholars Akhil Reed Amar and Vikram David Amar in a more recent amicus brief. They argue that top of mind for the drafters of the 14th Amendment were the actions of John B. Floyd, the secretary of war during the secession crisis of November 1860 to March 1861.

Scott Momaday, a Pulitzer Prize-winning storyteller, poet, educator and folklorist whose debut novel "House Made of Dawn" is widely credited as the starting point for contemporary Native American literature, has died. “His Kiowa heritage was deeply meaningful to him and he devoted much of his life to celebrating and preserving Native American culture, especially the oral tradition." Like Joseph Heller’s “Catch-22,” Momaday’s novel was a World War II story that resonated with a generation protesting the Vietnam War. Addressing a gathering of American Indian scholars in 1970, Momaday said, “Our very existence consists in our imagination of ourselves.” He championed Natives' reverence for nature, writing that "the American Indian has a unique investment in the American landscape." CNN —A former conservative federal appellate judge is urging the Supreme Court to keep Donald Trump off the ballot, arguing the ex-president’s effort to cling to power after his 2020 election loss was “broader” than South Carolina’s secession from the US that triggered the Civil War. Trump tried to prevent the newly-elected President Biden from governing anywhere in the United States. “Trump incited, and therefore engaged in, an armed insurrection against the Constitution’s express and foundational mandates that require the peaceful transfer of executive power to a newly-elected President,” the brief said. The US Supreme Court agreed earlier this month to review the unprecedented decision from the Colorado Supreme Court that removed him from that state’s ballot. CNN —The Colorado voters trying to disqualify Donald Trump from the state ballot told the Supreme Court on Friday that the violence the former president provoked on January 6, 2021, qualifies as an insurrection under the terms of the Constitution and bars him from holding future office. In the early pages of their 60-page filing, they also countered Trump lawyers’ warning of the “bedlam” that could follow if the justices were to allow states to block his name from upcoming primary ballots. The voters’ lawyers wrote that the mob “infiltrated the (US Capitol) building through shattered windows” and “erected gallows” outside, while chanting “Hang Mike Pence.” They noted that video of the day was on file at the court. The Supreme Court agreed earlier this month to hear the case of Trump v. Anderson, accepting the former president’s appeal of the Colorado Supreme Court decision that removed him from that state’s ballot. The Colorado trial judge disagreed, and her findings were upheld by Colorado’s high court, which concluded that he “intended that his speech would result in the use of violence.”

Washington CNN —Peter Navarro was sentenced Thursday to four months in jail for contempt of Congress after defying a subpoena related to the congressional investigation into the January 6, 2021, US Capitol attack. Each count carries a mandatory minimum sentence of one month in prison, but prosecutors had asked Mehta to sentence Navarro to six months for each count – running concurrently – and fine him $200,000. Former Trump adviser Steve Bannon was convicted in 2022 on two contempt counts and later sentenced to four months in prison. The Justice Department used its testimony to make the case that the committee had good reason to subpoena Navarro and that he was informed repeatedly of its demands. Navarro has insisted that he didn’t comply with the subpoena at the direction of Trump, who he claimed invoked executive privilege in the matter.

The 11th Circuit U.S. Court of Appeals has scheduled oral arguments in the case for March 27 in Atlanta. Attorneys for father and son Greg and Travis McMichael and their neighbor, William “Roddie” Bryan, are asking the court to throw out hate crime convictions returned by a jury in coastal Brunswick in 2022. Bryan joined the chase in his own truck and recorded Travis McMichael shooting Arbery at close range with a shotgun. The McMichaels and Bryan stood trial on hate crime charges in U.S. District Court less than three months after all three were convicted of murder in a Georgia state court. Also pending are appeals by all three men of their murder convictions in Glynn County Superior Court.

Circuit Court of Appeals in Manhattan on Wednesday scheduled oral arguments in Maxwell's appeal for March 12 before a three-judge panel. Prosecutors countered that Maxwell's appeal had no merit. Nathan was elevated to the 2nd Circuit from the U.S. District Court in Manhattan after being assigned Maxwell's criminal case. The appeals court may take at least a few months to rule.

SANTA FE, N.M. (AP) — A U.S. District Court judge is standing by her decision to block portions of a public health order from New Mexico's governor that would suspend the right to carry firearms in many public parks in the Albuquerque area, with appeals pending before a higher court. The Monday order from Albuquerque-based Judge Kae Riggs denied a request from the governor to leave in place a temporary ban on firearms in some public places in greater Albuquerque, including most public parks. “Judge Riggs’ opinion ignores this caselaw and the massive amount of historical evidence in the record supporting the constitutionality of the temporary restrictions imposed by the public health order,” Hayden said in an email. The rest of the public health orders have remained intact, including directives for monthly inspections of firearm dealers statewide, reports on gunshot victims at New Mexico hospitals, wastewater testing for illicit substances at schools and more. Votes against the bill were cast by two Republican lawmakers who are pursuing impeachment proceedings against the governor for her emergency health orders on gun violence.
