The racketeering case against Donald J. Trump and his allies in Georgia has ignited outrage among staunch supporters of the former president, pushing some to urge the Republican-controlled state legislature to find a way to intervene. Change the state’s rules on pardons to empower the governor to absolve Mr. Trump and his associates should they be convicted — that has been one suggestion making the rounds on social media and conservative talk shows this week. And on Thursday, a state senator from rural northwest Georgia sent a letter to the Republican governor, Brian Kemp, demanding an emergency special session for “the review and response to the actions of Fani Willis,” the Fulton County district attorney who is leading the case. The odds of any of that coming to fruition anytime soon: slim to nonexistent. “It ain’t going to happen,” said Charles S. Bullock III, a political science professor at the University of Georgia, who is considered a leading scholar on politics in Georgia and the South, which he has studied for more than five decades.

The former president’s surrender and arraignment will look different in Georgia than in his previous three criminal cases. Successfully transferring their cases to federal court could provide some key advantages. Should the case actually go to trial in the federal court, Trump and Meadows or others could end up with a jury pool more sympathetic than the one they might get from around Atlanta, where the state courthouse for this case is based. Trump and Meadows could also argue in federal court that they are protected because their efforts were part of their official duties as president and White House chief of staff, respectively. No one knows whether these charges will lead to convicting Mr. Trump and the other conspirators or in keeping him from power. But even if it doesn’t, the indictment, and the evidence supporting it, and the trial that ideally will follow it, will have a lasting value. Unlike the other three cases against Mr. Trump, this one is an indictment for history, for the generations to come who will want to know precisely how the men and women in Mr. Trump’s orbit tried to subvert the Constitution and undermine American democracy, and why they failed. History needs a story line to be fully understood. But in Georgia, Fani Willis, the district attorney of Fulton County, was unencumbered by the narrower confines of federal law and was able to use the more expansive state RICO statute to draw the clearest, most detailed picture yet of Mr. Trump’s plot.

This argument has been partially successful with US District Judge Aileen Cannon in the federal classified documents case. It is unclear whether the judge assigned to the Georgia case would be amenable to delay arguments. I expect that, as in the New York case, where the judge recently denied such a motion, Trump will seek to move the case against him to federal court. While those decisions may not be binding on the Georgia judge, they will be informative as he considers the issues. As president, Trump would have the power to scuttle the federal cases and a greater ability to avoid accountability in the state cases as well.

All are accused of running afoul of the state's Racketeer Influenced and Corrupt Organizations, or RICO, law. “You can tell a great story in your indictment, and you might be able to prove it. “The problem with RICO is that it takes a lot longer because there are so many more elements to it,” said Jerry Froelich, a Georgia criminal defense attorney and former prosecutor. In RICO cases, defendants are often loosely associated, making it easier for prosecutors to get them to "flip," or turn on one another. Georgia courts have upheld the law’s use in novel contexts that include Willis' successful prosecution of teachers who falsified scores on standardized tests.

The historic 41-count indictment unsealed Monday is the fourth criminal case that Trump is facing. All 19 co-defendants must surrender by August 25 at noon ET, Fulton County District Attorney Fani Willis told reporters Monday after the indictment was released. “Trump and the other Defendants charged in this Indictment refused to accept that Trump lost, and they knowingly and willfully joined a conspiracy to unlawfully change the outcome of the election in favor of Trump,” the indictment states.
