“This is a basically a death penalty for a business,” said Columbia University law professor Eric Talley. Bank officials called to testify couldn’t say for sure if Trump’s personal statement of worth had any impact on the rates. His nonprofit Trump Foundation agreed to shut down in 2018 over allegations he misused funds for political and business interests. The Deutsche unit making the Trump business loans wasn’t the typical lending unit, but its private wealth division. A POTENTIAL COMPROMISETo be sure, the attorney general’s office has argued that there are larger issues than victim losses at play in Trump's case.

“I will tell you that the last thing you want is to see multiple law enforcement officials with guns drawn pointing at my parents and thinking that something happened,” the former South Carolina governor told NBC. It’s been in the headlines recently because of a spate of incidents involving public officials. When prominent public officials are victims of swatting, one can’t always prove a cause-and-effect relationship between inflammatory rhetoric posted online or delivered during a speech and a caller’s reckless false emergency call to 911. We need tougher laws to protect public servants, and some states are increasing penalties for perpetrators of swatting. Swatting increases the likeliness of inadvertent harm to the public by the very people whose job it is to protect us.

Donald Trump on Monday lashed out at the financial monitor overseeing the Trump Organization and urged a judge to fire her days after she reported a range of issues — and flagged a questionable $48 million loan — in the former president's New York civil business fraud case. New York Attorney General Letitia James has asked Engoron to order that Jones continue to monitor the Trump Organization for at least five years as part of his judgment in the case. Robert made that argument three days after Jones submitted a report to Engoron accusing the Trump Organization of providing incomplete, inconsistent or incorrect information about its financial disclosures. In a footnote in that report, Jones said she identified a loan between Trump himself and an entity related to Trump Chicago Tower that later turned out not to exist. She also seeks five-year bans with the same conditions for Donald Trump Jr. and Eric Trump, who took over the Trump Organization after their father became president in 2017.

But an Associated Press analysis of nearly 70 years of similar cases showed Trump’s case stands apart: It’s the only big business found that was threatened with a shutdown without a showing of obvious victims and major losses. “This sets a horrible precedent,” said Adam Leitman Bailey, a New York real estate lawyer who once sued a Trump condo building. But AP’s review of nearly 150 cases reported in legal databases found that in the dozen cases calling for “dissolution,” victims and losses were key factors. The New York attorney general who filed the lawsuit, Letitia James, said that helped the ex-president receive lower interest rates. In fact, the bank made its own estimates of Trump’s personal wealth, at times lopping billions from Trump’s figures, and still decided to lend to him.

After a monthslong trial, the attorney general, Letitia James, asked for a penalty of roughly $370 million, which would come on the heels of a separate jury verdict in a defamation case requiring Mr. Trump to pay $83.3 million. The new accusations against Mr. Trump’s family business, the Trump Organization, came late last week in a report from an outside monitor whom Justice Engoron assigned in late 2022 to keep an eye on the company. The monitor, Barbara Jones, a former federal judge, has overseen how the company represents its finances to lenders. Her report highlighted several paperwork issues at a family company trying to shake a legacy of sloppiness: missing disclosures, typos, math errors and questions about a $48 million loan between Mr. Trump and one of his companies. Ms. Jones, now a law firm partner, told the judge that collectively, the issues “may reflect a lack of adequate internal controls.”

The rats were trained to press a button that triggered a camera attached to their cage. Giving randomized rewards in return for taking selfies mirrored the tactics used by social media companies and dating apps to keep users coming back, Lignier said. “I was fascinated by this.”After spending a few days taking selfies, the pet rats went to live with Lignier’s mother in Arles, southern France, until they died and were buried in her back garden.

Jones and Trump Organization attorney Alan Garten did not immediately respond to requests for comment from Business Insider. A 'pretty brazen' plotGarten told The Daily Beast an "internal loan" wherein Trump "leant money to the entity that he owns" does exist. "It would appear, assuming Judge Jones' letter is accurate, that this amounts to tax evasion," Martin Lobel, a tax lawyer, told The Daily Beast. So, instead of paying income taxes of up to 39% on the forgiven debt, the outlet reported, Trump "invented a loan — and then parked it."

He spoke to his lawyers, his words sometimes quite audible to the packed courtroom. He wrote instructions for his defense team that he shoved their way. He walked in late at one point, and at another, while a lawyer suing him was speaking to the jury, he stalked out. His use of the defense table as a stage also provided clues to the public, and a reminder to his own legal team, of how he might handle himself if and when any of the four criminal cases he is facing go to trial. And in recent months he sat for many days of the trial a few blocks away at 60 Centre Street, where Justice Arthur F. Engoron of State Supreme Court oversaw the fraud trial against Mr. Trump and his company.

Apple's overall smartphone shipments fell 2.2% year-on-year in 2023, while the overall market fell 5%, IDC said. China's smartphone market has been hit because of an uncertain economic environment in the country and weak consumer spending. In 2023, Honor, a spin-off from Chinese company Huawei, held the second spot with 16.8% market share, followed by Vivo, Huawei and then Oppo. Another market research firm called Counterpoint Research also came out with China numbers on Thursday. Counterpoint said it expects the China market to record low single-digit year-on-year growth in 2024, the first year of growth since 2018.

On Monday, Trump's attorney Alina Habba said he intends to take the witness stand in his defense. Trump's two driving impulses — to fight the system and to take the witness stand — will create the judicial equivalent of a car wreck, experts told Business Insider. Alternatively, Trump can get on the witness stand and "try to testify in a narrative fashion," Jones said. Carroll's trial does have a jury, making it harder to "unring that bell" of forbidden testimony, Jones said. Or wager that he'll inflict wounds on himself by taking the witness stand?

NEW YORK (AP) — A poetry collection, a coming-of-age novel and a history of deep sea exploration are unlikely to be found in the same section of your favorite bookstore. But they all have enough in common to be this year's winners of Science + Literature awards, $10,000 prizes administered by the National Book Foundation and the Alfred P. Sloan Foundation. While ““The Bathysphere Book” is the only winner you could officially classify as science, all three works draw upon science and the natural world. When Masters of Black-and-White Spin the Color Wheel

His black-and-white picture of Big Tex, the cowboy effigy that hovers over the State Fair of Texas in Dallas, shows a motley assortment of Texans sitting and cavorting beneath the absurd figure. In the color variant, much of the space is taken up by a blank blue sky and the visitors are indistinct, so that the comedy is drained. In the color image, probably taken an instant later, the man is looking at the camera, the woman’s expression has changed, and the impact is diffused by the photographer’s own obscuring shadow and a distracting crowd of passers-by. The previously published “White Sands National Monument, New Mexico,” 1964, transposes Winogrand’s fascination with alienated and isolated Americans into a beautiful blue-and-white image. And some of his very early Coney Island photographs, taken in the ’50s, use color to convey the tender vulnerability of sand-streaked flesh.

The testy clashes have come to be expected as Trump's lawyers carry into the courtroom the bombastic, and often antagonistic, style that defines his campaign trail demeanor. There's no doubt that the lawyers, with some exceptions, have struggled to score major points with judges and in fact have often provoked their ire. Both cases have been defined by contentious exchanges between judges and Trump and his lawyers. In November, for instance, they pushed unsuccessfully for a mistrial in the fraud case, accusing Judge Arthur Engoron of “tangible and overwhelming” bias. Chutkan has repeatedly admonished Trump’s lawyers for political arguments, once telling attorney John Lauro during debate over whether restrictions could be placed on Trump's speech that though she knew he had a “message” to convey, she didn't want campaign rhetoric in court.

Swatting Is a Political Problem - The New York Times
  + stars: | 2024-01-23 | by ( Barbara Mcquade | ) www.nytimes.com   time to read: +3 min
In a year with so much political and legal tension, law enforcement is seeing a disturbing trend: targeting public officials with swatting, or false emergency calls intended to draw a heavily armed police response. Recent incidents involving officials who have taken stands seen as hostile to Donald Trump and bomb threats in multiple state capitols are signs of a troubling escalation in political violence. In addition, swatting diverts law enforcement resources from real emergencies. But more insidiously, these tactics are tools of intimidation, designed to silence voices in the political process. The frequency and visibility of these incidents suggest that swatting and political violence require prosecutors to prioritize their efforts to stop it.
