In this week’s mammoth New York trial of former President Donald Trump on charges of falsifying business records in connection to hush money paid to an adult film star, the yawning gap between “Us” and “Them” is along partisan lines. After all, making hush money payments, as Trump is alleged to have done with former adult film actress Stormy Daniels, isn’t illegal. For decades, Trump has been a fixture on our airwaves, social media sites and political coverage. But they didn’t, and now many are feeling a rally-round-the-flag effect in what is likely the first and potentially only Trump criminal case that’s going to trial before Election Day. Bragg’s decision to bring this case, with its attenuated connection to an actual crime, can’t be taken out of its political context.

CNN —If Donald Trump opts to testify at his New York criminal trial, Manhattan prosecutors want to use his past legal run-ins to discredit him to the jury. Prosecutors say they’ll want to question him about what they claim is false testimony he gave on the stand at that trial last November. The judge plans to hold a proceeding called a Sandoval hearing to rule on what’s fair fodder for prosecutors if Trump takes the stand in his defense later at trial. A Sandoval hearing is a common preliminary proceeding that reviews a defendant’s criminal history and looks at how much prosecutors can ask if a defendant testifies. “If for some reason we are fortunate and get done early on Friday, we will take up Sandoval at that time,” Merchan said.

States could, in theory, try to keep Mr. Trump off the ballot by passing legislation requiring a clean criminal record, but this would be on legally shaky ground. The California Supreme Court also unanimously blocked it as a violation of the state constitution, and the case never reached the U.S. Supreme Court. And the 14th Amendment is separate from criminal cases, meaning convictions would not disqualify Mr. Trump either. Now that Mr. Trump has secured a majority of delegates to the Republican convention, the party has no mechanism to nominate somebody else. Mr. Trump is registered to vote in Florida, and he would be disenfranchised there if convicted of a felony.

Still, sources believe Emmer is working to improve his stock inside both the House GOP and MAGA world, and keeping his options open for the future. Others who could be waiting in the wings: House Majority Leader Steve Scalise, who also previously ran for speaker, and House GOP Conference Chair Elise Stefanik, a top Trump ally. During the press conference, Johnson got some key backup from the former president. And a large swath of the House GOP conference agrees. Louisiana GOP Rep. Garret Graves warned against the idea of ousting Johnson without another speaker candidate waiting in the wings.

Jean Carroll defamation trial in January, Judge Lewis Kaplan bench-slapped Habba 14 times during a single day of testimony. "Please direct me to the portion of the original gag order, or the subsequent gag order, where it makes any exception if Mr. Trump feels he is under attack. The judge told Blanche to file a response, in writing, explaining why Trump should not be held in contempt for violating the gag order. In Manhattan's criminal trial court, reporters aren't seated close enough to Donald Trump to hear if he's snoring. On Tuesday morning, Trump closed his eyes for more than a minute at a time on at least a half-dozen occasions. Of the first group of 96 potential jurors who crammed into the courtroom, more than half were immediately excused for saying they could not be fair and impartial. A Manhattan jury also found Trump’s business, the Trump Organization, guilty of tax evasion, although Trump was not personally named in that case. And here is an excellent visual timeline of the entire hush money scandal. It was Cohen who orchestrated the hush money payments and who pleaded guilty to federal charges of violating campaign finance law, for which he served time in prison. Trump is accused by New York of falsifying business records when he paid Cohen back for the hush money scheme.
