FTX gets court approval to sell crypto assets

During the hearing, Dorsey overruled concerns raised by two FTX customers who said FTX sales could cause crypto prices to crash and that FTX may not own all of the crypto that it holds in its accounts. FTX said in court filings it was keenly aware of the risk that its effort to liquidate coins could move crypto markets. But keeping its current crypto portfolio intact also carries risks, potentially locking FTX into holding certain assets as their prices decline, according to FTX’s court papers. FTX filed for bankruptcy in November 2022 in the wake of claims that it misused and lost billions of dollars worth of customers' crypto deposits. FTX founder Sam Bankman-Fried has pleaded not guilty to charges that he defrauded FTX customers by using their funds to prop up his own risky investments.

Many crypto and asset management industry professionals now expect the first so-called spot bitcoin funds to launch in 2024 . The number of firms jockeying for a spot bitcoin ETF has already broken into double digits, and it's still growing. The largest bitcoin futures ETF, the ProShares Bitcoin Strategy ETF (BITO) , has an expense ratio of 0.95%. Valkyrie has a Bitcoin Strategy ETF (BTF) that holds futures and has also applied to launch a spot product. The cryptocurrency market fell to start the week as traders turned their focus to new inflation data and digested the latest in the SEC's legal battle with Ripple. Bitcoin fell more than 2.8% to trade at $25,004.45, according to Coin Metrics. Bitcoin briefly dipped below $25,000, the first time below that key support level since June. The case has been closely watched by the cryptocurrency and asset management industries, which have been trying for years to convince the SEC to approve a spot bitcoin ETF. Cboe Global Markets earlier this year filed a proposal with the U.S. SEC to list and trade shares of a spot bitcoin ETF by Ark Invest and 21Shares on the Cboe BZX exchange. The regulator has in recent years rejected dozens of applications for spot bitcoin ETFs, citing inadequate levels of trading surveillance that could leave the underlying spot market subject to fraud and manipulation.

The native token of the Solana blockchain jumped Tuesday after Visa announced it will expand its stablecoin capabilities to the Ethereum alternative. Other cryptocurrencies were little changed, with bitcoin hovering below the flat line at $25,803.25 and ether up slightly at $1,640.06. The move came after Visa announced it will introduce settlement of the USDC stablecoin over the Solana network. Bernstein has called stablecoins the "monster killer app" for crypto, identifying them as a nearly $3 trillion market over the next five years. "Going forward, we expect tokenized stablecoins to be a $2.8 trillion market, led by regulated, onshore stablecoins."

Bitcoin finished August about 10% lower, its second consecutive losing month. Crypto was caught up in a tough sell-off that hit stocks and bonds throughout the month. Bitcoin extended losses into September, down more than 2.5% on Friday to trade at $25,660. Even as investors cheered Grayscale's court win over the Securities and Exchange Commission—which many see as helping to pave the way for a spot bitcoin ETF—bitcoin couldn't eke out a gain in August. The end-of-week dip comes after the SEC announced late Thursday that it would delay deciding on all of its spot bitcoin ETF applications until October.

Altcoin trading is limping along, despite initially getting a boost from a key July court ruling that gave Ripple a partial victory over the Securities and Exchange Commission. However, this is not a strong enough narrative to take over the broader theme of deterioration in crypto market structure, said Park added. "This has serious implications for altcoin trading, as the shift in focus to alternatives like FDUSD or TUSD has created a bottleneck for pairs trading that is often how altcoin liquidity is gauged and accessed," he added. "At its peak, there were over 300 BUSD trading pairs and the number is steadily decreasing as BUSD is ceasing its operations." Wolfe Research's Rob Ginsberg noted this week that weak price action and low trading volume largely define the trading of altcoins in the current market.

Bitcoin soared 6% on Tuesday after Grayscale won its crypto case against the SEC. Grayscale sued the SEC in 2022 after the agency rejected its application to turn its bitcoin trust into an ETF. The court ruling from the District of Columbia Court of Appeals could pave the way for other bitcoin ETFs. The current discount of the Grayscale Bitcoin Trust to its NAV is about 24%, according to data from YCharts. The Grayscale Bitcoin Trust soared more than 17% on Tuesday.

A federal appeals court struck down the SEC's order denying the conversion of the Grayscale Bitcoin Trust (GBTC) into an exchange traded fund. The decision does not guarantee that investors will be able to freely trade a bitcoin ETF anytime soon, however. Another impact could be for the bitcoin futures ETFs that are already on the market, led by the $940 million ProShares Bitcoin Strategy ETF (BITO) . Those funds could see outflows if investors choose the spot bitcoin products instead. Consider Valkyrie's attempt to change its bitcoin futures product into a broader crypto fund that also holds ether futures.

On Tuesday, the court sided with Grayscale in a lawsuit against the Securities and Exchange Commission which had denied the company's application to convert the Grayscale Bitcoin Trust to an ETF. A spot bitcoin ETF would be traded through a traditional stock exchange, although the bitcoin would be held by a brokerage, and would allow investors to gain exposure to the world's biggest cryptocurrency without having to own the coin themselves. Many crypto bulls believe that approval of a spot bitcoin ETF will lead to more mainstream institutional adoption. Bitcoin , ether and other major cap crypto coins surged on the news, and Coinbase , which is listed as the custodian partner in multiple spot bitcoin ETF applications, was up more than 14% on Tuesday. The company decided to pursue the ETF, which would be backed by bitcoin rather than bitcoin derivatives, after the SEC approved ProShares' futures-based bitcoin ETF in October 2021.

The rule is part of a broader push by Congress and regulatory authorities to crack down on crypto users who may be failing to pay their taxes. It would also subject digital asset brokers to the same information reporting rules as brokers for other financial instruments, such as bonds and stocks, Treasury said. Brokers would need to send the forms to both the IRS and digital asset holders to assist with their tax preparation. The new requirements stem from the $1 trillion 2021 Infrastructure Investment and Jobs Act, which included a provision that aimed to increase tax reporting requirements for digital asset brokers. It instructed the IRS to define what firms qualified as crypto brokers and provide forms and instructions for reporting.
