A federal appeals court agreed to rehear a challenge by two conservative groups to Nasdaq's board diversity rule related to the disclosure of women and minority membership on boards of companies listed on the stock exchange. The 5th Circuit U.S. Court of Appeals, in its order Monday night setting a rehearing, also vacated a decision in October upholding the Nasdaq rule by a three-judge panel from the appeals court, which encompasses Texas, Louisiana, and Mississippi. The Nasdaq rule requires companies to disclose details about the diversity of their boards of directors, and to either have a minimum number of women and minorities on their boards or explain why they do not. "NASDAQ's rule promotes racial discrimination and polarizing personal disclosures and it is to be hoped that this rule is struck down," Blum said. The SEC and Nasdaq did not immediately respond to requests for comment on the rehearing order.

We discussed that for many people, the most powerful tools for medical weight management are the glucagon like peptide 1 (GLP1) agonists. As of 2024, insurance, not body weight or BMI, has become the most important vital sign for doctors who see patients for medical weight management. They really did transform a fairly barren landscape of pharmacotherapeutic options for medical weight management that lasted several decades. Weight loss is on average about 15% with Wegovy and 22% with Zepbound, with super responders losing more than 25% of their body weight. By comparison, other medications that are FDA-approved for weight loss, including Qsymia and Contrave, are combinations of much older drugs.

Fifty-two countries will participate in arguments at The Hague over the six-day hearing – more than any other case heard by the court in its history. Israel captured the West Bank, East Jerusalem and Gaza in the 1967 Six-Day War. Israel today has full administrative and security control over 60% of the West Bank area while the PA has nominal control over Palestinian population centers. There are an estimated 700,000 Israeli settlers illegally living in the West Bank. In the two and a half years since he resigned as New York’s governor, Andrew M. Cuomo has spent countless hours and millions of dollars to restore his image and vanquish his critics. One of his primary targets is the state’s new ethics panel, which his lawyers argue was formed unconstitutionally and should be disbanded — a result that would plunge the enforcement of state ethics rules into chaos. Mr. Cuomo won the fight’s first round, successfully persuading a State Supreme Court judge last year that the panel, the Commission on Ethics and Lobbying In Government, had been created in a way that violated New York’s Constitution. After the commission appealed the ruling, the parties wound up in an appeals court in Albany, N.Y., on Friday for oral arguments.

CNN —Civil lawsuits seeking to hold Donald Trump accountable for the January 6, 2021, US Capitol attack can move forward after the former president declined to ask the Supreme Court to decide whether he is shielded by presidential immunity. The decision means the lawsuits will move to a fact-finding phase at the trial-level federal court in Washington, DC. The case could still eventually come before the Supreme Court. Lower courts sided with the plaintiffs as Trump sought to have the cases dismissed based on his claims of presidential immunity. The Supreme Court is still considering whether to step into Trump’s federal criminal case related to January 6.

CNN —Former President Donald Trump made his final pitch Thursday to the Supreme Court in his effort to pause a trial over the election subversion charges brought by special counsel Jack Smith. “There are overwhelming reasons why the case should not go to trial ‘in three months or less,’” Trump told the Supreme Court in a 16-page filing. The Supreme Court is expected to decide on Trump’s request within a few days. On Monday, Trump asked the Supreme Court to block a unanimous decision from the DC Circuit handed down last week that rejected his claims of immunity from the election subversion charges. “Without immunity from criminal prosecution, the presidency as we know it will cease to exist,” Trump told the Supreme Court.

NEW YORK (AP) — Nearly four years after Harvey Weinstein was convicted of rape and sent to prison, New York’s highest court will hear arguments Wednesday in his quest to overturn the landmark #MeToo-era verdict. The New York Court of Appeals agreed last year to take Weinstein’s case after an intermediate appellate court upheld his conviction. His New York trial drew intense publicity, with protesters chanting “rapist” outside the courthouse. That evidence would have served “only to make the jury hate Weinstein,” his lawyers said. During oral arguments, Judge Sallie Manzanet-Daniels said that Burke had let prosecutors pile on with “incredibly prejudicial testimony” from additional witnesses.

CNN —When it comes to deciding whether former President Donald Trump should be booted from Colorado’s ballot, the easiest path the Supreme Court could take now may wind up causing the most chaos early next year. In the ballot litigation, Trump is appealing a decision from the Colorado Supreme Court in December that he incited the attack on the US Capitol as electoral votes were being counted in 2021. Arguments at the US Supreme Court last week focused less on whether there was an insurrection and more on technical questions about whether states may enforce the ban. A political fight over eligibility would likely be limited to Congress, but it could sweep the Supreme Court back into the thicket, as well. “Depending on just how horrendously ugly the situation could get, the court might feel compelled to become involved,” Foley said.

Donald Trump’s filing to the Supreme Court over his claim for sweeping presidential immunity begins with a quote from Yogi Berra. The coming days could decide when the first Trump trial takes placeThe text of Trump’s filing to the court at times feels somewhat frivolous. Trump’s legal team has a good reason to try to run out the clock. But it is not certain that the Supreme Court, which last week heard oral arguments on another Trump case — over his expulsion from Colorado’s ballot — will even agree to take his latest request. As with Smith’s Washington case, Trump’s team is seeking to delay the trial currently scheduled for May.

Bob Moore, the grandfatherly entrepreneur who, with his wife, Charlee, leveraged an image of organic heartiness and wholesome Americana to turn the artisanal grain company Bob’s Red Mill into a $100 million dollar-a-year business, died on Saturday at his home in Milwaukie, Ore. His death was announced by the company, which did not cite a cause. Founded in Milwaukie in 1978, Bob’s Red Mill grew from serving the Portland area to become a global natural-foods behemoth, marketing more than 200 products in more than 70 countries. Over the years, the company profited handsomely from the nutrition-minded shift away from processed foods and grains. “I think our diets, nationally, and international probably, show the fact that we just have allowed ourselves to be sold a bill of goods.”

There are more key points I want to emphasize: The Covid-19 vaccine is not going to protect you 100% from contracting the virus. That’s because the viral load may not be high enough initially to trigger a positive test. You should also consider getting tested for the flu, as antiviral treatments are available for influenza, too. What Was The Village Voice?

THE FREAKS CAME OUT TO WRITE: The Definitive History of The Village Voice, the Radical Paper That Changed American Culture, by Tricia RomanoTricia Romano’s oral history of The Village Voice, the most important alternative weekly of the 20th century, is a well-made disco ball of a book — it’s big, discursive, ardent, intellectual and flecked with gossip. A lot of the people Romano interviewed, former Voice writers, editors, photographers, designers and cartoonists, will probably wince, at times, at the text. Humiliations are recalled; toes are trod upon; old hostilities have been kept warm, as if on little Sterno cans of pique. Founded in 1955 by a group of writers and editors that included Norman Mailer, The Voice was intended to be a newspaper for downtown, defined as below 14th Street in Manhattan. For many oddballs and lefties and malcontents out in America’s hinterlands (I was among them), finding their first copy of The Voice was more than eye-opening.

Three Big Legal Questions
  + stars: | 2024-02-09 | by ( David Leonhardt | Ian Prasad Philbrick | ) www.nytimes.com   time to read: +1 min
In a two-hour oral argument at the Supreme Court yesterday, nearly all justices appeared skeptical of Colorado’s effort to keep Trump off the ballot. Maine has also moved to bar Trump, and other states would likely follow if the Supreme Court were to allow it. The legal issues are complex, and we walk through them below. As Adam Liptak, who covers the Supreme Court for The Times, told us yesterday:Donald Trump is accused of doing grave wrongs in trying to overturn the election. Many legal experts expect the court to rule quickly (as this story explains) and to issue a broad decision that applies to all states.

Not since the 2000 case of Bush v. Gore has the Supreme Court been in the middle of an election battle of such potential magnitude. Several of the justices’ spouses, including Jane Roberts, wife of the chief justice, sat in a special guest session. Roberts’ criticism of the Colorado Supreme Court decision barring Trump was echoed by his colleagues, even as they varied in their constitutional grounds. Just as Roberts can set the tone for oral arguments, the chief justice presides over their private votes on cases. As he strives for consensus, Roberts is likely to try to keep any separate, concurring opinions to a minimum.

“What do you do with the – what would seem to me to be – the plain consequences of your position?" Chief Justice John Roberts asked attorney Jason Murray, who argued on behalf of the Colorado voters who brought the lawsuit. “The reason we’re here is because Donald Trump tried to disenfranchise 80 million voters,” he said. The Colorado Supreme Court agreed, ruling that Trump's conduct amounted to engaging in "insurrection" in violation of Section 3. But it is not the last time the Supreme Court will be called upon to settle questions with an outsized impact on the 2024 election.

The court scheduled 80 minutes for the arguments that will kick off shortly after 10 a.m. Though the 14th Amendment was ratified in 1868, the court has never before wrestled with a claim based on the insurrection clause. The case, Trump v. Anderson, is on appeal from the Colorado Supreme Court, which in December ruled that the former president is no longer eligible to serve. Trump is simultaneously juggling four criminal prosecutions – including one that could reach the Supreme Court in coming days dealing with whether he can claim immunity from criminal prosecution. While the stakes for Trump are enormous, they are also significant for the Supreme Court.
