The U.S. consumer agency, which enforces federal antitrust law, and 17 states filed their lawsuit against Amazon in Seattle federal court on Tuesday, asking a U.S. judge to consider an injunction and other penalties to combat alleged unlawful conduct. The FTC's lawsuit is related to but broader than a series of private consumer cases filed in recent years against Amazon that are pending in the same U.S. federal court. The private antitrust cases offer an early window into some of the legal arguments Amazon could be expected to make to challenge the FTC's lawsuit. Generally speaking, U.S. judges are "wary of using antitrust law to punish low-pricing behavior," said antitrust scholar Sean Sullivan of the University of Iowa's law school. Sullivan said it is not always a clear line between "good low pricing" — based on market competition — and "bad low pricing" that helps a company acquire or maintain market power.

Jakarta Reuters —Indonesia has banned e-commerce transactions on social media platforms, the trade minister said on Wednesday, in a blow to short video app TikTok, which is doubling down on Southeast Asia’s biggest economy to boost its e-commerce business. TikTok, owned by China’s ByteDance, has 125 million active monthly users in Indonesia and has been looking to translate the large user base into a major e-commerce revenue source. He warned of letting social media become an e-commerce platform, shop and bank all at the same time. Indonesia Deputy Trade Minister Jerry Sambuaga earlier this month named TikTok’s live streaming features as an example of people selling goods on social media. E-commerce transactions in Indonesia amounted to nearly $52 billion last year and of that, 5% took place on TikTok, according to data from consultancy Momentum Works.

The judge assigned to the US Federal Trade Commission’s antitrust lawsuit against Amazon.com has recused himself from the case, according to a court document filed on Wednesday. Senior Judge John Coughenour was assigned to the case on Tuesday, when the antitrust lawsuit was filed against Amazon in federal court in Seattle. Coughenour, an appointee of Republican former President Ronald Reagan, did not cite a reason for dropping off the case in the court filing. The case has been re-assigned to US District Judge John Chun based on rotation, according to the document. Amazon is facing a series of similar but smaller private consumer cases filed in recent years that are pending in the same US federal court with Judge Ricardo Martinez and the FTC has argued its case should be assigned to the same judge to avoid duplication or conflict.

REUTERS/Chris Wattie/File Photo Acquire Licensing RightsLONDON, Sept 27 (Reuters) - E-commerce giant Shopify (SHOP.TO) is investing in wholesale platform Faire, the companies said on Wednesday, in a global deal that would see the start-up adopt Shopify technology for its clients. Faire, founded in 2017 and valued at $12.59 billion, would become the recommended wholesale marketplace for Shopify merchants. Shopify's director of product Aneeqa Khan said the partnership would make it easy for Shopify merchants to find wholesale buyers, and enable retailers to source from Faire's network of brands. Faire said the most popular search filter on its platform is "Not on Amazon", as retailers look to source less widely available products. For Shopify, which sells tools to create and manage online store-fronts, this is the latest in a series of deals.

Amazon has a poor man’s monopoly

The $1.3 trillion retailer run by Andy Jassy was sued on Tuesday by the U.S. Federal Trade Commission for alleged anticompetitive practices. She rose to prominence after publishing a paper in the Yale Law Journal in 2017 titled “Amazon’s Antitrust Paradox,” which painted the e-commerce giant as a sprawling monopoly that has gone unchecked by traditional antitrust policing. But Chinese competitors like Shein and Temu, which have different cost structures, are starting to encroach on Amazon’s market. It's possible that Khan and the FTC can nail Amazon in court for behaviors that in the past have given it an exclusive edge. Follow @thereallsl on XCONTEXT NEWSThe U.S. Federal Trade Commission filed an antitrust lawsuit against Amazon.com on Tuesday, asking the court to consider forcing the online retailer to sell assets.

Today's consumers expect a seamless experience whether they're shopping online, in person, or a combination of both. To attract and retain customers, merchants need to prioritize affordability and convenience by providing a seamless payment experience across channels. This is an example of the type of seamless, omnichannel checkout experience today's consumers look for in the brands they shop with. These modern shoppers expect convenience, great prices, and the same level of service and security whether they're shopping online or in a store. Amazon is facing an antitrust lawsuit from the Federal Trade Commission and 17 states. The suit claims Amazon is leveraging its power to inflate prices and overcharge small sellers. The FTC has been gathering evidence for months to show how Amazon disadvantages sellers. Some of the agency's allegations in the Amazon case mirrors those made in a separate lawsuit last year by the state of California. The federal complaint follows other actions the FTC has taken against Amazon in the past few months.

REUTERS/Florence Lo/Illustration/File Photo Acquire Licensing RightsSHANGHAI, Sept 26 (Reuters) - Discount e-commerce is set to dominate globally during the critical upcoming holiday shopping season in the West and Singles’ Day in China, analysts said. Platforms in China, the world’s largest e-commerce market, have recently described a “value-for-money battle” stoked by economic insecurity and a slower-than-expected retail recovery following the lifting of COVID-19 curbs late last year. “There was a clear vacuum for the discount retailer online experience ... Across the world, executives are now focusing on price pressures as discount online retailers gain increasing market share. In the West, the inflation driven consumer wants something cheaper because they're going through a moment of financial insecurity,” Ho said.

More than 9 million merchants sell their wares on Amazon's marketplace and also supply it with steady streams of revenue. Amazon collects advertising fees for touting their products, fulfillment fees for delivery in addition to less specific "sellers' fees." Some merchants welcome the potential of relaxed seller and advertising charges, while others worry that completely dissolving Amazon's advertising services would harm their ability to reach shoppers. The FTC found that the company's fulfillment fees increased approximately 30% between 2020 and 2022. Dieterle relies on Amazon's fulfillment and advertising services to boost merchandise sales.

Effective Oct. 1, Amazon was planning to impose a new 2% fee on every sale by third-party sellers that ship their products themselves, according to media reports in August. "After careful consideration, we've made the decision not to implement this program fee to ensure seller sentiment related to the fee does not impact program participation," an Amazon spokesperson told Reuters. The reversal in Amazon's plans comes when the company is facing a potential lawsuit from the U.S. Federal Trade Commission. The FTC is expected to file a lawsuit against Amazon later this month after the company did not offer concessions to settle antitrust claims, the Wall Street Journal reported. Amazon has been criticized for allegedly favoring its own products over those from outside sellers on its platform.

SAO PAULO, Sept 18 (Reuters) - Brazilian financial technology company Ebanx is expanding its operations to India, marking its entry into the Asian market, the firm said on Monday. The move is part of the firm's global expansion strategy in developing countries and comes shortly after it announced its expansion to three nations in Africa last month, the first outside Latin America. Ebanx will enable global merchants to offer customers in India the most popular local payment methods, starting with the local payment system Unified Payments Interface (UPI) and cards, it said. "As the Indian market warmly embraces digital payments and digital commerce continues its rapid growth, we see great opportunities for businesses and meaningful partnerships being fostered," said Paula Bellizia, the firm's president of global payments. In Latin America, Ebanx processes payments for companies such as Airbnb, Spotify and Uber.
