CNN —Donald Trump is underscoring the profound choice that voters could face next year with expansive claims of unchecked presidential power alongside increasingly unapologetic anti-democratic rhetoric. This has huge consequences not simply for the courtroom accounting that is yet to take place over his first turbulent term. If the twice-impeached former president wins the Republican nomination and the presidency, it is already clear that a second term would risk destroying the principle that presidents do not hold monarchial power. “Joe Biden is not the defender of American democracy,” Trump said during a campaign stop in Cedar Rapids, Iowa, on Saturday. And if he succeeds in 2024, his legal arguments will have been a warning of a second term that he envisions with almost no guardrails.

Nikki Haley is instructive. But nowhere does it talk in depth about policy or what the Koch brothers’ organization represents within the Republican coalition. What makes Haley interesting in this race is not, in fact, her position in the polls but her position in the party. Haley was, after all, Trump’s ambassador to the United Nations, an interesting position for someone who so sharply diverges from Trump’s ostensibly non-interventionist foreign policy. Or maybe it’s Haley, the standard-bearer for a more inclusive Republican Party, defined by her identities as a woman and Indian-American.

On Veteran’s Day, Trump called his enemies “vermin” and spoke of his intention to go after opponents should he regain power. Presidential power has been a bipartisan affair. Frustrated with the Republican Congress, for instance, President Bill Clinton used executive action to expand the environmental programs of the federal government. Most recently, Biden leaned on executive power to advance a student loan forgiveness program that the courts ultimately overturned. When presidents use presidential power in dangerous ways, not only does this present a dangerous stress test at the moment, but it also means that over time, the expansions of power are rarely cut back.

American democracy, the Constitution and the rule of law are the righteous causes of our times, and the nation’s legal profession is obligated to support them. But with the acquiescence of the larger conservative legal movement, these pillars of our system of governance are increasingly in peril. The dangers will only grow should Donald Trump be returned to the White House next November. He would stock his administration with partisan loyalists committed to fast-tracking his agenda and sidestepping — if not circumventing altogether — existing laws and long-established legal norms. The Federalist Society, long the standard-bearer for the conservative legal movement, has failed to respond in this period of crisis.

The Clean Air Act, Safe Drinking Water Act and Endangered Species Act were some of the federal laws waived by DHS to make way for construction that will use funds from a congressional appropriation in 2019 for border wall construction.
