Meadows, Clark, and several other defendants have asked to have their cases removed to federal court. "A federal court judge might be more sympathetic to some of their federal constitutional defenses that they might want to raise," Ratakonda told Insider. The Atlanta district attorney prosecuting the Georgia election interference case against former President Donald Trump and 18 others asked a judge Tuesday to order that defendants granted so-called speedy trials be tried together. Fulton County DA Fani Willis also asked Judge Scott McAfee to set a deadline for defendants in the case to file requests to sever their cases. McAfee has discretion on whether to sever the cases for separate trials. But defendants soon could make similar speedy trial requests, which would require their trials to begin by Nov. 3. In her court filing Tuesday, Willis said she opposed, "at this juncture," severing the cases of defendants so that they would be tried either in 19 separate trials or in smaller groups.

It says that if a person were carrying out duties placed on them by federal law, they cannot be prosecuted for committing a state crime. Legal experts said Jones could allow the case to proceed in federal court and address immunity at a later hearing. If he determines immunity did not apply to the accused actions, the jury trial would take place in federal court, with the broader jury pool.

Washington CNN —The federal criminal trial of Donald Trump on charges he sought to subvert the result of the 2020 presidential election will begin March 4, 2024, the day before the Super Tuesday primary, a federal judge ruled Monday. Special counsel Jack Smith had proposed a January 2024 start date and Trump sought to begin the trial two years later, in April 2026. Smith’s team told Chutkan in a filing earlier this month that the trial should begin on January 2, 2024. “The government’s objective is clear: to deny President Trump and his counsel a fair ability to prepare for trial,” they wrote in their filing.
