A federal appeals court ruled Friday that a Mississippi law allowing mail-in ballots to be counted if they are postmarked before Election Day — but received up to five days after Election Day — is pre-empted by federal law. It does, however, pave the way for a possible challenge that could go up to the U.S. Supreme Court, which could have ramifications for states that do allow ballots postmarked before Election Day to be counted. The appeals court ruling says that no such ballots should be counted. "Federal law requires voters to take timely steps to vote by Election Day. And federal law does not permit the State of Mississippi to extend the period for voting by one day, five days, or 100 days," the ruling said.

CNN —Costco is recalling smoked salmon products over possible listeria contamination. There have been at least 10 reported deaths and 59 hospitalizations across 19 states due to the listeria outbreak, according to the CDC. In October, there have multiple instances of recalls like Costco’s salmon products due to potential listeria contamination, according to the FDA, which tracks public announcements. While the recalls come on the heels of the Boar’s Head listeria outbreak and McDonald’s E. coli outbreak, experts told CNN that an increase in recalls over potential contamination isn’t necessarily cause for concern. On October 24, the FDA announced a recall of chicken taco kits produced by Sprouts Farmers Markets over potential listeria contamination.

The S & P 500 is down 0.9% week to date, on pace to snap a six-week advance. There may be more turbulence next week as the election draws closer, but history shows all is not lost for the market. The week of the election itself, the broad market index has seen a median gain of 0.56%. In 2020, the S & P 500 dropped 5.6% the week before the election, then rallied 7.3% the week of the vote. Robert Roberson, 57, was set to become the first person in the U.S. executed in a "shaken baby" case until members of the state House Criminal Jurisprudence Committee issued a subpoena to have him testify at a legislative hearing this week. Despite efforts by the attorney general's office to appeal, as the execution was scheduled to get underway on the evening of Oct. 17, the Texas Supreme Court, in an 11th-hour decision, sided with the lawmakers, handing Roberson a temporary reprieve. Former President Donald Trump said Thursday that, if elected to a second term in November, he would immediately fire special counsel Jack Smith, who brought two federal indictments against Trump.
