If she does not course-correct, she’s headed for another shellacking by the circuit – and possible removal from the case. That statute outlines the parameters between a president’s official and personal records, and sets up processes for how official documents are preserved. If this were true, the mere fact that Trump took the documents with him from the White House would inherently turn them into personal records. Importantly, Smith asked Cannon to let both parties know “promptly” how she viewed the law. Ejecting her from the case would be extremely unusual and Smith does not mention seeking it in his papers.

Haley laid out a stinging character study of the former president in an interview with CNN’s Jake Tapper on Thursday. Grouping Trump with President Joe Biden, she said it was “absurd” that the country would be stuck with two 80-year-old candidates. In recent campaign events, Haley has also questioned Trump’s morality and capacity to tell right from wrong. They had to find a way to exploit Trump’s greatest general election liabilities in the knowledge that most Republican voters had no interest in hearing about them. South Carolina state Rep. Bill Taylor hit back at some of Haley’s recent criticisms that Trump only thinks of himself.

The most recent polling on the race, published Monday by The Washington Post and Monmouth University, signals another Trump shellacking: 52% of potential primary voters said they support Trump, compared with 34% who back Haley. The poll, which was conducted prior to DeSantis dropping out, showed that just 8% of voters preferred him. “Even with a bump in the number of Democratic leaners turning out in the Republican primary, Haley is not able to catch the front-runner,” Patrick Murray, director of the independent Monmouth University Polling Institute, said in a statement. The former U.S. ambassador to the U.N. has the support of New Hampshire Gov. Though still considered a long shot, New Hampshire likely gives Haley her best chance of challenging the former president, especially since any independent or unaffiliated voter can participate in the state’s primary.

Polls indicate New Hampshire offers Haley her best chance for a win, while DeSantis, polling a distant third, is already looking ahead to South Carolina. While Tuesday's primary result is expected to be narrower, the latest polls of likely New Hampshire GOP primary voters show Trump leading Haley by double digits. They have been joined in recent days by a growing number of Trump's one time Republican primary rivals — Nebraska Gov. In New Hampshire, Haley is right: She and Trump are the top two candidates by far in the polls, with DeSantis a distant third. Days away from the New Hampshire primary, DeSantis' campaign is already shifting resources to South Carolina, while still holding some events in New Hampshire.

China failed to advance from the group stage for the first time in a Women's World Cup. A video review before halftime took away a goal or James would've bagged a hat trick against China (1-2-0, three points). England got three goals during group stage matches from James and next plays Nigeria on Monday in Brisbane. Chloe Kelly and Rachel Daly also netted goals for England, which matched its widest margin of victory in a Women's World Cup game. Vietnam concluded its first Women's World Cup appearance with losses in all three of its games.

Pittsburgh starter Mitch Keller (8-2) pitched seven innings, allowing one run and a season-low two hits, with seven strikeouts and two walks. Washington starter Trevor Williams (3-4) worked five innings and allowed two runs on seven hits, one walk and six strikeouts. Toronto right-hander Kevin Gausman allowed six runs, seven hits and four walks in 4 2/3 innings before the bullpen locked down the victory. Ian Gibaut (6-1) recorded five outs to earn the victory and Alexis Diaz pitched the ninth inning to earn his 15th save. The Giants erupted for 15 hits, seven for extra bases, and their fourth-most runs of the year to salvage one win in the three-game set.

Ron Klain Exits the White House Stage Left

Chief of staff Ron Klain is leaving the White House after President Joe Biden’s Feb. 7 State of the Union address. Much of the coverage frames his as a victorious exit, saying Mr. Klain departs with Mr. Biden having regained momentum after Democrats escaped a midterm shellacking. Other recent chiefs have served longer than Mr. Klain’s 25 months. Denis McDonough served four years for Barack Obama , and Andrew Card worked five years and three months for George W. Bush . Still, Mr. Klain has been a consequential chief in important respects.
CNN —Even as President Joe Biden and ex-President Donald Trump move toward a rerun of the most turbulent White House race in modern history, many voters are pining for a break from the past – and the present. A new CNN/SSRS poll shows that 6 in 10 Republicans and GOP-leaning independents want their party to nominate someone other than Trump in 2024. A Biden versus Trump race would raise questions over whether a bitterly polarized political system, where democracy itself is at stake, has lost the capacity for self-renewal that has always been an American strength. The CNN poll shows Biden on an upward trajectory and in a better position in his party than Trump is in his. The question of his age, however, might be less important if Biden faces Trump, who is already 76.
Biden had been hopeful that Russian President Vladimir Putin would be more apt to free Griner once America’s midterm elections were done, a calculation that proved correct. Still detained in Russia is Paul Whelan, a businessman whom the White House has also been working to free without success. In a 2012 interview with NBC’s “Meet the Press” when he was vice president, Biden came out in favor of same-sex marriage, and he is expected to sign the measure into law. White House officials acknowledged the headwinds and worried that the midterm elections would be a repudiation of Biden’s record. “When I look at what the Biden White House has done, I think experience and patience really paid off,” said Jennifer Palmieri, who served as White House communications director during the Obama administration.
If Republicans decide they are tired of losing elections they should be winning, Herschel Walker’s loss to Raphael Warnock in Georgia’s Senate runoff election should mark the definitive and unequivocal end of the Trump era. Republicans have grown complacent and comfortable on a bed of final straws with Trump, but Walker’s loss should wake them up from their slumber. Walker’s loss showed once again that Trump is the GOP’s Bridge to Nowhere, continuing the poor performance of Trump-anointed candidates in the midterms. If Trump wants to start a new party with his dinner companion, white supremacist Nick Fuentes, he’d be doing the Republican Party (and the republic) a favor. Republicans have grown complacent and comfortable on a bed of final straws with Trump, but Walker’s loss should wake them up from their slumber.
The plunging response rate of various economic surveys could call into question the reliability of Fed forecasts, according to Fundstrat. "How accurate is the surge in 5 million additional job openings, when there are 1/3 fewer respondents?" The CPI response rate is down to 37.7%, the NFP response rate is down to 44.8%, and the JOLTS response rate collapsed from 44% to 31% over the past year. By comparison, the JOLTS survey response rate was 68% in 2012, Lee observed. The current JOLTS data suggests for every unemployed American looking for a job, they have 1.7 job openings to choose from.
They’re offering more policy briefings to longtime supporters, Zoom calls with top administration officials and White House tours, too. "The $500,000 people like me, we’re not going to be players in 2024," said Dick Harpootlian, a longtime Democratic donor and South Carolina state senator. For the White House, the shift is an acceleration of a courtship campaign that began more modestly before the midterm elections. Amid concerns about the omicron variant last year, the White House was forced to abandon plans for a more full set of holiday parties. Some of those same people were invited to the White House next month for an in-person policy briefing.
For the world leaders meeting with Biden over the next week, there’s no assurance that he'll be the president they’ll be dealing with for the next six years. The U.S. is unnerved by Chinese military exercises that threaten Taiwan and raise the specter of a future invasion. “Tuesday was a good day for America, a good day for democracy,” Biden said Thursday at a Democratic National Committee event. Another reason that Biden might find the trip more gratifying is that he averted the midterm wipeout that sitting presidents normally endure. Biden’s midterm test went much better.
National Democrats were fairly happy on Election Day as they dodged a predicted trouncing at the polls, but state Democrats might have even more to celebrate. And Democrats appear on track to flip the state House in Michigan, as well as in Pennsylvania and Minnesota, according to the National Conference of State Legislatures (NCSL), the nonpartisan organization that represents legislative chambers. Democratic wins this cycle signals a shift in state legislative priorities that could have major ramifications on contentious issues. The Republican-controlled state legislatures in Pennsylvania and Michigan had entertained election denial conspiracies after the 2020 election, for example. "Success does beget success," she said, noting that many state legislative candidates outperformed those competing at the federal level.
MILWAUKEE — President Joe Biden appears to have pulled off something few of his recent predecessors managed — a midterm election that wasn’t a clear shellacking for his party, providing a sense of vindication for the White House. Biden's losses are likely to tally far fewer than President Barack Obama suffered in 2010 or President Donald Trump in 2018. The president spent election night at the White House watching returns with top advisers and family and making calls to Democrats who won their races. For many voters, Biden appeared to play little role in their decision. That compares to 2018 when only a third of voters said Trump was not a factor in their House vote.
President Joe Biden responded "nothing" when asked what he'll do differently over the next two years. Democrats lost seats in Congress but seem to have dodged a so-called "red wave" in midterm elections. Biden acknowledged that "some good Democrats" lost their elections, but he said his party had a "strong night." Former President Barack Obama called it a "shellacking" when Democrats lost 63 House seats and six Senate seats in 2010. In 2018, former President Donald Trump lost 40 Republican seats in the House and two in the Senate.
“The key differential between 2018 and 2022 is that in 2018 Joe Biden was not president,” the former official said. Biden allies also point to early polling that shows Biden narrowly ahead in a potential rematch against former President Donald Trump, who hinted Monday night at a rally that he’ll launch his own bid for re-election in a week. “You have an incumbent with a really good track record, and you’ll have Donald Trump [running],” said Jim Messina, who ran Obama’s re-election campaign in 2012. Democrats in some of the toughest races largely shied away from Biden, preferring popular surrogates, like Obama or first lady Jill Biden. In 2018, Biden held his final rally in a Pennsylvania county that had the largest swing from 2008 to 2016.
Forty-eight percent of likely voters say they prefer a Democratic-controlled Congress as the outcome from Tuesday’s elections, while 47% prefer a Republican-controlled Congress. Among all registered voters, congressional preference is tied at 47%-47% — essentially unchanged from last month, when Democrats held a narrow 1-point edge, 47%-46%. Yet what has changed in the poll is that Democrats have caught up to Republicans in election interest. An identical 73% of Democrats and Republicans express high interest, registering either a “9” or “10” on a 10-point scale. In October’s NBC News poll, Republicans held a 9-point advantage in high voter interest, 78% to 69%, after Democrats had previously closed the enthusiasm gap following the U.S. Supreme Court's decision to overturn the Roe v. Wade decision on abortion.
Democrats expect chaos next Congress as they face losing control of the House and possibly the Senate. They say far-right House members will be running the show as Kevin McCarthy struggles to control them. Between McCarthy and McConnell, Democrats view McConnell as the leader with more control over his caucus and they foresee future splits on legislation and priorities. Former President Barack Obama called it a "shellacking" when Democrats lost 63 House seats and 6 Senate seats in 2010. He expects House Democrats to lose about 30 seats, dropping from 222 to 190 and Republicans increasing from 212 to about 240.
HISTORICAL HEADWINDSThe party in power typically loses House seats halfway through a president's four-year term. Democratic President Barack Obama described his party's loss of 63 House seats in the 2010 election as a "shellacking." In 2018, two years into Donald Trump’s presidency, the Republican Party gave up 41 House seats. By comparison, 20 Republican House members announced retirement or that they were seeking another office. Even as the price of gasoline and some consumer goods have come down, the Federal Reserve has taken aggressive steps to control inflation that could slow growth.
Obama will hit a fifth state, Michigan, which has a competitive governor's race, along the way. "President Obama remains able to unite base Democrats, persuadable voters, and to motivate demographics less likely to turn out in midterm elections like young people," said Ben LaBolt, who served as spokesman for the first Black president's successful 2012 re-election campaign. "Bringing in President Obama helps to underscore the importance of African-American vote, while also exciting other voters." But Democrats will have to wonder if that will be enough, as recent polling has shown Republican candidates gaining strength across the board. The Senate race is Georgia is essentially tied, even as Walker has been hamstrung by a series of controversies.
