In Trump's case, Electric Avenue was used for a commercial purpose, not for an allowable non-profit, research, or educational purpose, the judge wrote. The second factor looks at whether the copyrighted work was "creative" or "factual." The third factor weighs how much of the copyrighted work was taken for an unauthorized use. "In this case, there is no public benefit as a result of the defendants' use of 'Electric Avenue'" the judge wrote.

CNN —Elon Musk has stepped up online attacks on a Supreme Court judge threatening to suspend social media platform X in Brazil, calling him “an evil dictator” in an ongoing feud between the two men. Justice Alexandre de Moraes had threatened to suspend X if Musk did not appoint a new legal representative of the company in Brazil and settle any outstanding daily fines within 24 hours. X announced earlier this month that it would close its operations and fire its staff in Brazil due to what it called “censorship orders” from the judge. The statement from the Supreme Court was posted at around 8.30 p.m. local time on Wednesday, giving Musk until Thursday evening local time to respond. The responsibility lies solely with Alexandre de Moraes.”Later that day, Musk reiterated the official X statement, saying his company had “no choice” but to close Brazilian operations.

Elon Musk, the owner of X, retweeted a parody Kamala Harris campaign ad Friday without labeling it as misleading, an apparent violation of his own platform's rules. Portions of video footage in the altered content — such as Harris speaking to crowds, and general videos of her supporters — were used in a recent Harris' campaign video on YouTube. In the original video, Harris narrates, telling viewers, "In this election, we each face a question: what kind of country do we want to live in?" The altered video reposted by Musk does not include Beyonce. This is not the first time altered voice content has appeared during this presidential campaign.

Asked whether Biden would exit the race, Biden campaign spokesperson Seth Schuster responded: “No.”“There’s no basis for that,” one Biden adviser also told CNN Friday morning. New York CNN —Elon Musk said late on Wednesday that Tesla shareholders have re-approved a pay package worth billions that was already thrown out by a Delaware judge earlier this year in a vote that also approved moving Tesla to Texas. “Both Tesla shareholder resolutions are currently passing by wide margins! He famously bought social media platform Twitter for $44 billion in 2022, selling $22.9 billion of his Tesla shares to help fund that purchase. But perhaps a more serious concern among Tesla shareholders is the pioneering electric car company itself. Even with Musk’s pay package again endorsed by shareholders, the Delaware court could still have the final say.

On Douban, a popular site for reviewing movies, books and music, users compiled a list of nearly 100 Taiwanese celebrities, detailing whether each of them had shared the post. On Saturday, CCTV publicly endorsed Taiwanese celebrities who shared its post, sharing the screenshots of 36 such reposts – fueling a further backlash against those who hadn’t. On Monday, Taiwan’s Mainland Affairs Council weighed in, accusing the Chinese Communist Party of requiring Taiwanese artists to express a political stance. The remarks and retweets by Taiwanese artists of the CCTV unification post came against the backdrop of China’s largest show of force around the island in more than a year. “This is not the first time, and probably not the last, that Taiwanese artists are forced to make a political stand in China,” said the leader.

In recent years, the free-market economist and the contrarian Austrian school he led midcentury have been turned into a hashtag deployed by tax-wary workers. Ludwig von Mises From Mises Institute“Ludwig von Mises is Latin America’s leading economist,” declared the headline of a Bloomberg opinion piece earlier this month by economist Tyler Cowen. His free-market policy prescriptions, framed by an economic thinking centered on human behavior and individual choice, were widely considered out of fashion at the time. “That is my jam!” Shapiro said of the Austrian school. “If you start to understand the concept of the Austrian economic school,” Moicano said in a recent YouTube video, “you’re going to understand that’s what I need: free market, liberties, and wealth, my brother.

New York CNN —Tesla CEO Elon Musk has a new social media target: Diversity, Equity and Inclusion. Following Musk’s recent critical posts about DEI policies and racial discrimination lawsuits against Tesla, the electric car company has omitted all language regarding minority workers and outreach to minority communities in its 10-K filing with the SEC made January 29. In Musk’s eyes, DEI is “just as morally wrong as any other racism and sexism,” he tweeted in December. And as recently as 2020, Tesla had been publishing its own corporate DEI reports, reaffirming its commitment to the mission. CNN has reached out to Tesla for comment, though the company does not usually respond to press requests.

The U.S. Securities and Exchange Commission said on Monday that a SIM swap attack was to blame for the breach of its official account on X (formerly Twitter) earlier this month. With access to the phone number, the unidentified individual then reset the account password. "While multi-factor authentication (MFA) had previously been enabled on the @SECGov X account, it was disabled by X Support, at the staff's request, in July 2023 due to issues accessing the account," the SEC said in the statement. The agency had the ability to switch two-factor authentication back on for their X account and were not reliant on X to do so. X owner and CTO Elon Musk mocked the SEC, an agency he has clashed with for years, after the agency's account on X was breached.

The network of nearly 4,800 fake accounts was attempting to build an audience when it was identified and eliminated by the tech company, which owns Facebook and Instagram. The accounts sported fake photos, names and locations as a way to appear like everyday American Facebook users weighing in on political issues. Meta often points to its efforts to shut down fake social media networks as evidence of its commitment to protecting election integrity and democracy. But critics say the platform's focus on fake accounts distracts from its failure to address its responsibility for the misinformation already on its site that has contributed to polarization and distrust. But 2024 poses new challenges, according to experts who study the link between social media and disinformation.

Shrek Crocs are officially real

CNN —In the distant future, archaeologists will happen upon a Shrek Croc, its soft vinyl unsullied by the ages, and they will have questions. Crocs, the brand behind everyone’s favorite unapologetically ugly shoe, has collaborated with DreamWorks to craft an extremely important cultural artifact: The Shrek Croc. Green, freckled, and just a little scary, the Shrek Croc (or Shroc, if you will) has long been a dream for some Croc lovers. There actually is a 2018 Change.org petition floating around to “Make Shrek Crocs Real.” The good people at Crocs know what’s up too: In the run-up to the shoe’s launch on September 13, the official Croc X account retweeted 20 identical messages from an account called “Shrek Crocs,” all reading “Make Shrek Crocs real.”“The wait is over for the most wonderfully hideous Classic Clogs,” the shoe’s description reads. There are Pop Tarts Crocs (Croc-Tarts), Lisa Frank Crocs, Barbie Crocs, Crocs with fanny packs and even scented Crocs Jibbitz — a combination of words commanding almost as much dark energy as “Shrek Crocs.”Most reactions to the Shrek Crocs fall into one of two categories: “I need them immediately,” or “If you wear these in public I will perform a citizen’s arrest.” If your thoughts lean toward the former, you may want to hurry.

RICHMOND, Va. (AP) — A Democratic Virginia legislative candidate whose race was rattled by the revelation that she and her husband livestreamed themselves having sex moved forward with her campaign Tuesday and drew some early support in the high-stakes contest. But state Sen. L. Louise Lucas, a leading Democratic lawmaker in Virginia, quickly came to her defense, calling on voters to “make this the biggest fundraising day of (Gibson's) campaign.” Many women voters retweeted Lucas with a link to donate to Gibson's campaign. Linton said she plans to donate another $100 to Gibson's campaign even though she can't vote for her because she lives outside her district. Mark Rozell, dean of George Mason University’s Schar School of Policy and Government, said the sex videos are a huge distraction from Gibson's campaign.
