As things stand now, 48 states are set to allocate their electors this November according to the winner of the popular vote in their state. There, electoral votes are partially divvied up on a proportional basis. In Maine, two of the state’s four electoral votes go to the winner of the popular vote, while the other two are split between its two congressional districts. Biden won that election with 306 electoral votes; the Nebraska elector did not make a difference. Which is why Nebraska Republicans have launched an effort, backed by Trump, to end its quasi-proportional allocation of electoral votes.

CNN —A state prosecutor will investigate whether Georgia Lt. Gov. Burt Jones violated criminal law in his efforts to help former President Donald Trump subvert the 2020 election results in the state. Peter Skandalakis, director of the Prosecuting Attorneys’ Council of Georgia, has appointed himself to investigate the matter, according to a news release. It took nearly two years for Skandalakis to announce his decision that he would appoint himself to spearhead a potential case against Jones. ATLANTA (AP) — The charges against former President Donald Trump in the Georgia election interference case seek to criminalize political speech and advocacy conduct that the First Amendment protects, his lawyers argued in a court filing challenging the indictment. Fulton County Superior Court Judge Scott McAfee plans to hear arguments on that filing and on two pretrial motions filed by former Georgia Republican Party chair David Shafer during a hearing set for Thursday. Lawyers for Shafer argue that he acted legally when he and other state Republicans signed a certificate asserting that Trump won the 2020 presidential election in Georgia and declaring themselves the state’s “duly elected and qualified” electors. McAfee is forging ahead with the case even as Trump and other defendants have said they plan to seek a ruling from the Georgia Court of Appeals to disqualify District Attorney Fani Willis. The charges against him include impersonating a public officer, forgery, false statements and writings, and attempting to file false documents.

(AP) — Wisconsin voters are set to decide next month whether to make it unconstitutional to accept private grant money to help administer state elections, one of two Republican-backed ballot measures that Democrats say are meant to make it harder to conduct elections in the presidential battleground state. The Wisconsin measures are supported by Republicans and conservative groups and opposed by an array of government watchdog and liberal groups including the American Civil Liberties Union, Common Cause Wisconsin, Wisconsin Conservation Voters and the League of Women Voters of Wisconsin. Three courts and the bipartisan Wisconsin Elections Commission rejected complaints challenging the legality of the grant money. It’s unclear how adoption of the amendment would change current practice, other than place requirements currently in state law into the constitution. The ruling comes in a lawsuit by Democrats that originally sought $2.4 million in damages from all 10 Republicans who submitted a document to Congress falsely declaring Trump as the 2020 election winner in Wisconsin. But Dane County Circuit Judge Frank Remington said they can be questioned, although he put limitations on the Evers interview. Atlanta CNN —Former President Donald Trump’s attorneys in the Georgia election subversion case are set to defend their client in a Fulton County courtroom for the first time on Friday as they try to have the charges thrown out on First Amendment grounds. This is the first time Trump’s attorneys will appear in court in the Fulton County case, though their client won’t be with them. Trump hasn’t yet been in the Atlanta courthouse – he previously waived his right to an arraignment hearing – though he was processed at the Fulton County jail in late August. She used a similar legal strategy in a 2014 RICO case in Fulton County, according to a source familiar with the matter. Despite his mounting legal debt and the fact that he is almost 80, sources close to Giuliani said he intends to fight the Georgia case.

CNN —A Colorado judge on Friday issued a stunning ruling that fell just short of removing former Donald Trump from the state’s 2024 ballot based on the 14th Amendment’s insurrectionist ban. The 102-page decision was a win for Trump, but it read more like a condemnation. The Colorado ruling isn’t binding on other courts, but it’s the most comprehensive fact-finding to date by a judge about Trump’s attempts to overturn the 2020 election. And it’s the first time that any court in the country has ruled that Trump engaged in the insurrection, a watershed moment in the quest for accountability for January 6. “Trump was unable to provide the Court with any credible evidence which would discredit the factual findings of the January 6th Report,” Wallace said.

CNN —Nevada’s attorney general is investigating individuals who acted as fake electors in the state following the 2020 election, a source close to the investigation told CNN. Attorney General Aaron Ford’s office declined to comment. In Georgia, Fulton County District Attorney Fani Willis has charged multiple individuals involved in the plot to put forth fake electors in that state, along with Trump. Michigan Attorney General Dana Nessel in July charged more than a dozen individuals who acted as fake electors. And Arizona Attorney General Kris Mayes has launched an investigation into the fake elector scheme there.
