Hong Kong CNN —The operator of 7-Eleven has rejected an opening offer from the owner of convenience store rival Circle K, indicating the bid was too low and that its global business was worth more. In a statement Friday, Tokyo-based Seven & I Holdings, which owns 7-Eleven, said it was “open” to “sincerely consider” any proposal that is in the best interests of its shareholders. The Financial Times reported on Thursday that Seven & I was open to the possibility of a higher offer from its suitor. Shares in Seven & I have rallied since the news of the offer broke last month, pushing its market value above $38 billion. Although 7-Eleven traces its origins to Dallas, Texas, it was the late Japanese entrepreneur Masatoshi Ito who is credited with turning it into a ubiquitous global brand.

Donald Trump’s claim that he has absolute immunity for criminal acts taken in office as president is an insult to reason, an assault on common sense and a perversion of the fundamental maxim of American democracy: that no man is above the law. More astonishing than the former president’s claim to immunity, however, is the fact that the Supreme Court took the case in the first place. It is a process so vital, and so precious, that its first occurrence — with the defeat of John Adams and the Federalists at the hands of Thomas Jefferson’s Republicans in the 1800 presidential election — marks a second sort of American Revolution. And if the trial occurs after an election in which Trump wins a second term and he is convicted, then the court will have teed the nation up for an acute constitutional crisis. A president, for the first time in the nation’s history, might try to pardon himself for his own criminal behavior.

CNN —Alabama has scheduled the nation’s first execution by nitrogen hypoxia, an alternative to lethal injection, its Republican governor said. He asked the state to be put to death by nitrogen gas rather than lethal injection after what he called a botched execution. Smith’s execution now is set to take place between January 25 and 26, according to a news release from Gov. The court’s action came after the justices divided 6-3 earlier in the term to allow Smith’s execution to go forward by lethal injection. Smith’s case was tried by a jury twice, Alabama Attorney General Steve Marshall has noted, both of which resulted in convictions.
