The move followed new evidence about the gun Baldwin was holding when it fired the bullet that killed Hutchins during the movie's filming, a person close to state prosecutors said. "The case is dismissed without prejudice and the investigation is active and ongoing," prosecutors Kari Morrissey and Jason Lewis said in a filing. Special prosecutors said on Thursday they might refile charges against Baldwin once new evidence was examined.

CNN —Prosecutors in the “Rust” fatal shooting case plan to file a notice to dismiss involuntary manslaughter charges against Alec Baldwin, his attorney, Luke Nikas, tells CNN. CNN has contacted the special prosecutor in the Santa Fe, New Mexico case for comment. Baldwin and “Rust” armorer Hannah Gutierrez Reed were both charged with involuntary manslaughter in January. An attorney for Gutierrez Reed has previously said she will plead not guilty. Prosecutors already removed a firearm enhancement charge against Baldwin and Gutierrez Reed, reducing a potential prison sentence from 5 years to a maximum of 18 months.

CNN —Filming of the movie “Rust” will resume this week. On Tuesday, a spokesperson for Rust Movie Productions told CNN that principal photography of “Rust” is set to resume Thursday at Yellowstone Film Ranch in Montana. Production on the western starring Alec Baldwin came to a halt in 2021, when cinematographer Halyna Hutchins was fatally shot when a prop gun Baldwin was holding fired a live round of ammunition during rehearsal. Baldwin and Souza will also return to finish the project, according to Rust Movie Productions. Baldwin and “Rust” armorer Hannah Gutierrez Reed were charged with involuntary manslaughter in Hutchins’ death in January.

Five other live rounds were later found on the set by investigators. Investigators have not been able to establish where the live rounds found on the "Rust" set came from. Kenney has denied that the live rounds on set came from his company. Charging documents held Gutierrez-Reed responsible for "allowing live ammunition on the set," but not for bringing them to the production.

The decision by special prosecutor Andrea Reeb came a month after Baldwin's attorney filed a motion to remove her because she is also a representative in the state legislature. The Baldwin team argued it violates the state constitution for a legislator to serve in another branch of government. "I will not allow questions about my serving as a legislator and prosecutor to cloud the real issue at hand." Gutierrez-Reed has blamed the shooting on potential sabotage, Baldwin's lack of firearms training, and a failure by Halls and Baldwin to call her onto set for extra firearm checks.
