CNN —Tennessee’s ban on gender-affirming care for minors will now take effect after a federal appeals court lifted an injunction against the law. The appeals court granted a stay of a lower court injunction, which had been blocking enforcement of a part of the state’s ban. The ban prohibits health care providers from performing gender-affirming surgeries and administering hormones or puberty blockers to transgender minors, pending the duration of the appeal. In five states, providing gender-affirming care to minors is now a felony. Taking effect in the third most populous U.S. state, the law escalates a Republican political strategy to pursue bills restricting transgender rights. In addition, the new Florida law, which takes effect immediately, grants Florida courts jurisdiction in child custody battles over transgender kids when a Florida parent opposes treatment that is being pursued under an out-of-state parent. The World Professional Association for Transgender Health (WPATH) criticized the bill after it passed the legislature, opposing government interference into the doctor-patient relationship. If successful, it’s unclear if VUMC would be allowed to resume gender-affirming surgeries for minors, regardless of their internal review. On average, VUMC has provided five gender affirming surgeries to minors every year since its transgender clinic opened in 2018. “The revenues from this limited number of surgeries represent an immaterial percentage of VUMC’s net operating revenue,” Pinson wrote. Only a handful defended the clinic’s services, with some saying the transgender health care they received had been life-saving.
