The U.S. Justice Department on Tuesday sued Visa , the world's biggest payments network, saying it propped up an illegal monopoly over debit payments by imposing "exclusionary" agreements on partners and smothering upstart firms. "Merchants and banks pass along those costs to consumers, either by raising prices or reducing quality or service," Garland said. "As a result, Visa's unlawful conduct affects not just the price of one thing – but the price of nearly everything." "These agreements penalize Visa's customers who route transactions to a different debit network or alternative payment system." 4 behind Visa, MasterCard and American Express .

The technology revolution in banking lets these "Fintech Pioneers" accrue benefits and manage their finances in an efficient way that doesn't disrupt their lifestyles. They don't want to constantly vet new fintech solutions, or risk encountering technical glitches that can jeopardize their finances. I don't know how JPMorgan Chase knew that I would spend $200 on Botox in Argentina, but it did. It's great that banks and credit-card companies are getting better at discerning which payments are fraudulent and which are legit. Credit-card fraud protection is still far from perfect, but there's no denying that the technology is improving. So I reached out to some credit-card companies and academics to learn more. But it's cool that companies really are making fraud detection better, especially in a world where fraudsters themselves are constantly getting better.

Gooch-Peters pointed to Visa — which has a 60% operating profit margin — as a more sustainable investment opportunity. This creates a strong competitive moat and helps to sustain the company's high profit margins over time. Gerry Fowler, chief European equity strategist at UBS, echoed the sentiment about the importance of a company's competitive moat while picking stocks. The UBS strategist pointed to the attempts of Apple, then the world's biggest company, to break into the payments network sector. The UBS strategist also cautioned that impenetrable moats might sometimes pose a downside risk to investors.

One time-honored corporate M&A prenup strategy, which could become more important going forward, is the use of break-up fees, also known as termination fees. In addition to reverse termination fees, companies are also allowing for longer timelines and more extensions than they were a few years ago, Thomas said. Not all deals include break-up fees for regulatory failures. Meanwhile, Visa's deal for Plaid was scuttled in 2021 due to regulatory snares, with neither of the companies owing break-up fees. A 2022 study by investment bank Houlihan Lokey shows that 57.1% of the 140 transactions reviewed had reverse breakup fees, with median fees of 4.2% as a percentage of transaction value.

“I have been consistently surprised at the resilience of consumer spending,” Christopher Waller, an influential member of the Fed’s board, said in a speech this month. “The acceleration of consumer spending on experiences (has) propelled us towards another outstanding quarter,” said CEO Jason Liberty. Wealthier households, in particular, have enjoyed substantial growth in home values and stock portfolios, which are likely juicing their spending. Spending on the bank's credit and debit cards by households with incomes below $50,000 has risen faster than spending by higher-earning clients. “Consumer spending across all segments from high to low has remained stable since March."
