Trump’s out of luck: No immunityThe simplest outcome would be for the Supreme Court to rule that former presidents are not entitled to immunity from criminal prosecution. That official-versus-private debate emerged as a key component of Trump’s immunity battle and will be closely scrutinized once the opinion lands. ☆ Supreme Court’s Leisurely Pace Will Produce Pileup of Late June Rulings

The Supreme Court has been moving at a sluggish pace in issuing decisions this term, entering the second half of June with more than 20 left to go. That is not terribly different from the last two terms, when the pace at which the court issued decisions started to slow. Over the almost two decades in which Chief Justice John G. Roberts Jr. has led the court, it has on average decided 72 percent of argued cases by this point in the term, according to data compiled by Lee Epstein, a law professor and political scientist at the University of Southern California. The corresponding number for the previous court, led by Chief Justice William H. Rehnquist from 1986 to 2005, was 78 percent. But in the last three terms, the court has decided no more than 62 percent of the term’s cases by June 14.

☆ Supreme Court rejects challenge to abortion pill mifepristone

As those bans helped propel the demand for medication abortion, mifepristone became a logical target for the anti-abortion movement. None of those lower court rulings went into effect because the Supreme Court intervened last year and ordered that the status quo around mifepristone remain in place until the justices reviewed the case. The Supreme Court heard arguments in March. Both the FDA and several medical groups, including the American Medical Association, told the Supreme Court that mifepristone is safe. The mifepristone appeal was one of two abortion cases the high court was considering this month.

CNN —Former President Donald Trump has once again asked a judge to throw out the classified documents case, arguing this time that investigators destroyed exculpatory evidence by rifling through boxes for classified documents gathered in the FBI’s 2022 search of Mar-a-Lago. Special counsel Jack Smith’s team has already acknowledged in court that some of the documents may be out of order. But, according to Trump, those boxes have been tampered with because investigators failed to maintain the order of their contents. The judge has yet to decide several additional motions to dismiss the case from Trump and his two co-defendants. However, the judge gave them a small victory by removing from an indictment prosecutors’ account of Trump allegedly showing a classified map to a political adviser, as the map was not one of the documents Trump is charged with mishandling.

☆ NFL faces multi-billion dollar antitrust suit over its Sunday Ticket package

New York CNN —A class action case challenging the legality of the NFL’s Sunday Ticket package, whose opening arguments are scheduled for Thursday, could shake up television rights deals in professional sports and the way teams make money. The case, first brought in 2015, focuses on the NFL’s package of games outside of a local market that are not shown nationally on other networks. The suit says by restricting broadcasts of those “out-of-market” games to the Sunday Ticket package, the NFL is forcing customers who just want to watch one team or a small group of teams have to pay more. The NFL argues that the current arrangement offers the broadest possible selection of games for fans at a good value. The NFL has been known to settle some high profile cases against it rather than having its practices disclosed and dissected in open court.

Tuesday’s election results, in which Prime Minister Modi sealed a rare third term, only enhance the sense of gloom and doom for Indian Muslims like me. With the BJP back in power – albeit without the supermajority it had vowed – my only hope lies in a politically weakened Modi now. A weakened Modi shall, hopefully, translate into a more robust India and more secure minorities. In the days and months to come, things could get seriously tough for Indian Muslims. It could be the norm for the rest of India soon as the BJP tries to deny Indian Muslims the right to follow Islamic laws in civil matters, a right granted by the Indian Constitution.

On a mild Houston day in March 2021, Judge Marvin Isgur prepared to oversee the only case on his docket that morning. In October 2023, the Fifth Circuit Court rebuked Judge David Jones but said that his longtime colleague, Judge Marvin Isgur, had been "unaware" of Jones' inappropriate relationship. "But only Judge Isgur knows what he knew or didn't know about the relationship." Much of this work was in cases before either Judge Isgur or Judge Jones. Isgur can continue to hear the case, he ruled, writing in the December 2023 opinion that lawyers for the creditor "failed to demonstrate much other than that former Judge Jones and Judge Isgur are close friends."

CNN —CNN Opinion asked our contributors to weigh in on Trump’s conviction on 34 counts of falsifying business records. Are there really that many voters whose view of Trump as a man, or politician, could be altered by bookkeeping irregularities? How many would-be Trump voters will be swayed against him because of miscategorized business expenses? Instead of validating Trump’s narcissism, Democrats should turn the camera away from Trump and toward the American people. Democrats should make the case that Trump’s policies would decimate the middle class and that ought to be a (metaphorical) crime.

The Supreme Court sided with the National Rifle Association on Thursday, saying it could pursue a First Amendment claim against a New York state official who had encouraged companies to stop doing business with it after the 2018 school shooting in Parkland, Fla.Justice Sonia Sotomayor, writing for a unanimous court, found that the N.R.A. had plausibly claimed a violation of the First Amendment, sending the case back to the U.S. Court of Appeals for the Second Circuit, in New York, for further proceedings. The N.R.A., in asking the Supreme Court to hear the case, cited what it described as the enormous regulatory power of the state official, Maria T. Vullo, a former superintendent of the New York State Department of Financial Services. A court decision siding with Ms. Vullo, the group warned, would open the door to government officials making similar pleas about hot-button issues like abortion and the environment. Ms. Vullo, in court filings, has pushed back again the N.R.A.’s allegations that she undermined the First Amendment.

Conservatives, who indeed hold the upper hand on the 6-3 court, nonetheless spike their writing and remarks with derision for the left. New York CNN —Consumers may be fed up with high prices at the store, but they’re still willing to splurge on travel. Other key players in the travel industry have reported a similar trend this earnings season. Americans, especially lower-income consumers, have pulled back spending at retailers as goods inflation outpaces wage growth. They’ve even become frugal with some experience-based spending like dining out, opting instead to eat at home. “We saw a healthy but more normalized market environment for travel globally,” CEO Peter Kern told analysts on May 2.

That’s according to a New York Fed survey gauging consumers’ expectations of the housing market, released Monday. Consumers are gearing up for even bigger increases compared to the expected rise in mortgage rates over the next year, the New York Fed survey found. The issue of rent affordability is particularly pronounced in New York City, where housing costs have always been notoriously high compared to other parts of the country, absent a brief respite during the pandemic.

London CNN —FTX has recovered enough assets to pay most of its creditors back in full, the failed crypto exchange said late Tuesday as it unveiled a proposed reorganization plan. “The plan contemplates payment in full of all non-governmental creditors based on the value of their claims as determined by the (relevant) bankruptcy court,” FTX said in a statement. Ray, a restructuring specialist, took over as CEO in November 2022 to shepherd what was left of the firm through bankruptcy. “We are pleased to be in a position to propose a Chapter 11 (bankruptcy) plan that contemplates the return of 100% of bankruptcy claim amounts plus interest for non-governmental creditors,” John J. Ray III, FTX CEO and chief restructuring officer, said in Tuesday’s statement. If his plan is approved by the United States Bankruptcy Court for the District Court of Delaware, FTX expects that 98% of its creditors will receive approximately 118% of the amount of their allowed claims, FTX said.

If it loses, TikTok could be banned from US app stores unless its Chinese parent company, ByteDance, sells the app to a non-Chinese entity by mid-January 2025. But Virginia Democratic Sen. Mark Warner, an advocate for the TikTok legislation, said in remarks on the Senate floor in April that the briefings provided critical insight into the risk TikTok poses. US policymakers have described the law at issue as a forced divestiture of TikTok, not an outright app ban. Some US officials have been trying to ban TikTok from the United States since 2020, when former President Donald Trump moved to block the app by executive order.
