A Georgia appeals court on Wednesday halted the criminal election case against Donald Trump in the state pending the outcome of his bid to disqualify the district attorney prosecuting the former president. The order by the Georgia Court of Appeals all but guarantees that Trump and eight co-defendants in the case will not stand trial before the November presidential election, where Trump is the presumptive Republican nominee. The appeals court said it would hear arguments on Oct. 4 on Trump's effort to boot Fulton County District Attorney Fani Willis from the case. The appeals court must rule on the question by March 14, 2025, according to the court's website. The appeals court order Wednesday halting the case also applies to Rudy Giuliani, David Shafer, Robert Cheeley, Michael Roman, Mark Meadows, Cathy Latham, Jeffrey Clark and Harrison Floyd.

The special grand jury report in Fulton County, Georgia, was released Friday after nobody raised any objections to making the documents public before a court-imposed deadline. However, the members of the special grand jury recommended their report be published, and according to Georgia law, this means the judge is required to make it public, barring objections, according to court filings. Fulton County Superior Court Judge Robert McBurney — who presided over the special grand jury and the separate grand jury that later approved charges in the case — said on August 28 that anyone who had concerns about publicly releasing the full report should raise an objection by Wednesday of this week. “Any concerned party that believes something less than everything should be published has until 6 September 2023 to file an objection to complete publication,” McBurney wrote. “If no objections are filed by 5:00pm on 6 September 2023, the remainder of the final report will be added to the docket.”There is no indication that anyone raised any objections, so the full report was released Friday as planned.

However, in addition to the three senators, the special grand jury also had recommended indictments be issued against 18 other people who were ultimately not charged by the regular grand jury last month, in addition to the people who did end up being indicted. Both Perdue and Loeffler, who were sitting senators at the time of the 2020 election, were defeated in early 2021 runoff elections by Democrats, Sens. Graham, a staunch Trump ally, is known to have called Georgia Secretary of State Brad Raffensperger after the November 2020 election to ask about absentee ballots in that contest. Trump and his co-defendants were indicted by a regular grand jury in Fulton County Superior Court last month on charges alleging a broad-ranging election conspiracy.

Jim Jordan, R-Ohio, left, and Fulton County District Attorney Fani Willis ReutersFulton County District Attorney Fani Willis tore into House Judiciary Chairman Jim Jordan on Thursday in a searing letter accusing the Ohio Republican of trying to obstruct her criminal prosecution of former President Donald Trump. "There is no justification in the Constitution for Congress to interfere with a state criminal matter, as you attempt to do," Willis wrote in the nine-page retort to Jordan, whose committee last month launched a probe into the district attorney's prosecution of Trump. Trump and his 18 co-defendants in the sprawling racketeering case have pleaded not guilty. Willis on Thursday fired back that Jordan's letter "contains inaccurate information and misleading statements." She wrote that "settled constitutional law clearly permits me to ignore your unjustified and illegal intrusion into an open state criminal prosecution" before launching into a multipage diatribe accusing Jordan of holding Trump to a lower standard of justice than any other defendant.

Judge Scott McAfee said that as of now, he plans to start trial for Kenneth Chesebro and Sidney Powell on Oct. 23. McAfee left open the door — slightly — to grant a request by prosecutors to hold a joint trial for Trump and the 18 co-defendants in the case. I remain very skeptical," the judge said as he gave the Fulton County District Attorney's Office time to submit a legal brief justifying the joint trial. Earlier in the hearing, a prosecutor told McAfee that holding a joint trial for Trump and the other defendants would take four months to complete, with testimony from potentially more than 150 witnesses.
