CNN —An upside-down American flag – a symbol used by some supporters of former President Donald Trump who challenged the legitimacy of Joe Biden’s 2020 victory – hung outside the home of Supreme Court Justice Samuel Alito after the election, The New York Times reported Thursday. A spokeswoman for the Supreme Court did not immediately respond to a request for comment from CNN, which has not independently verified the flag’s use. “I had no involvement whatsoever in the flying of the flag,” Alito said in an emailed statement to the Times. The Times said it was not clear how long the flag flew outside of Alito’s home. Last fall, in response to a series of revelations about travel accepted by Thomas and Alito, the Supreme Court adopted a code of conduct for the first time.

A man identified as Thomas R., in keeping with German privacy rules, acted as an “agent” for the Chinese Ministry of State Security, and engaged two others — a married couple identified as Herwig and Ina F. — who ran an engineering company in Düsseldorf, the authorities said. CNN —Three people in Germany have been arrested under suspicion of spying for China, while two people have been charged in the United Kingdom for espionage offenses. “Allegations suggest the suspects have had ties to a Chinese secret service since before June 2022,” the German prosecutor’s office said in a statement. The couple are accused of buying and exporting a specialized laser to China without authorization, violating European Union regulations. Germany’s justice minister Marco Buschmann congratulated the prosecutor’s office in a post on social media platform X, writing that the arrests highlighted the need to stay vigilant. Separately in the UK, Britain’s Crown Prosecution Service (CPS) announced charges against two men who allegedly breached the UK’s Official Secrets Act on behalf of China.

Three German nationals have been arrested on suspicion of working with the Chinese secret service to hand over technologies that could be used for military purposes, German prosecutors said on Monday. The suspects were identified as Herwig F. and Ina F, a married couple who run a company in Dusseldorf, and Thomas R., whom prosecutors described as an agent for an employee of China's Ministry of State Security (MSS). The Chinese contract partner was the MSS employee from whom Thomas R. received his orders, it added. The suspects also purchased a special laser from Germany on behalf of and with payment from the MSS and exported it to China without authorisation, according to the prosecutors. The Chinese embassy in Berlin did not immediately respond to a request for comment.

The high court’s ruling could also affect the federal election subversion criminal case pending against former President Donald Trump, who was also charged with the obstruction crime. The law, Justice Elena Kagan said, could have been written by Congress to limit its prohibition to evidence tampering. Unless the court rules broadly in a way that undermines the charge entirely, the case against Trump may still stick even if Fischer wins his case. The top prize at this year’s Berlin International Film Festival was given to “Dahomey,” a documentary by the French filmmaker Mati Diop about 26 looted artworks that were returned to Benin from France in 2021. The unconventional feature, narrated in part by the gravelly, imagined voice of one of the artworks, is a playful exploration of the legacy of colonialism and the interplay between history and identity in present-day Benin. It is Diop’s first feature since “Atlantics,” a drama about Senegalese migrants that won the Grand Prix at the Cannes Film Festival in 2019. In Diop’s acceptance speech for the prize, known as the Golden Bear, she said that “Dahomey” was part of the “collapsing wall of silence” around the need to return artworks looted by colonial powers to their original owners. “We can either get rid of the past as an imprisoning burden,” she said, “or we can take responsibility for it.”
