Federal law known as the Health Information Portability and Accountability Act (HIPAA) generally requires health care providers to notify people within 60 days of discovering a breach affecting their personal health data. The Department of Health and Human Services is already investigating whether UnitedHealth is compliant with HIPAA obligations to protect patient data. HHS can use HIPAA to fine companies for failing to protect patient data. The department announced a $4.75 million settlement in February with a nonprofit hospital system in New York for “data security failures” that the department said resulted in an employee stealing and selling patient data. On May 31, the HHS Office for Civil Rights clarified that health care providers can delegate that obligation to Change Healthcare.

Washington CNN —A pair of recent ransomware attacks crippled computer systems at two major American health care firms, disrupting patient care and exposing fundamental weaknesses in the US health care system’s defenses against hackers. Health care lags other industries such as big financial institutions and energy providers when it comes to IT security, according to some experts. The two ransomware attacks hit different nerves of the health care system. Momentum is also growing on Capitol Hill to force health care organizations to meet basic cybersecurity standards. More broadly, the Justice Department last week announced a task force to examine “health care monopolies and collusion” that will guide the department’s approach to “civil and criminal enforcement in health care markets,” where warranted.

A Kansas man is suing Rep. Tim Burchett, R-Tenn., over social media posts that falsely identified him as an undocumented immigrant and one of the shooters in the Kansas City Chiefs Super Bowl parade that turned deadly last month. "At no time was Plaintiff an 'alien,' an 'illegal alien,' nor a 'shooter' and the assertions to the contrary were false and were circulated widely among Defendant's followers," the lawsuit states. Burchett in February posted an image of Loudermill on X, identifying him as "one of the Kansas City Chiefs victory parade shooters" and "an illegal Alien." Federal courts require cases seeking damages between people in different states, such as this one, to exceed $75,000. The California-based chipmaking giant has seen its shares soar about 220% this year, making it the top performing S&P 500 stock in 2023. What’s happening: Just before Thanksgiving, Nvidia crushed doubts that its star was fading by reporting gangbuster third quarter earnings. By Sosnick’s count, Nvidia executives mentioned AI at least 70 times on their most recent earnings call. Historically, Nvidia has had hard falls after missteps — between 2021 and 2022, shares of the stock fell by 66%.

NASHVILLE, Tenn. (AP) — Former Ambassador to Poland and longtime Tennessee Republican politician Victor Ashe sued state election officials on Wednesday over a law he claims is so vague that he could be prosecuted for voting in a Republican primary. They argue that Tennessee voters aren't registered by party, and the law does not define what it means to be a bona fide party member, to declare allegiance to a party or long that allegiance must last. The league also worries that volunteers could be subject to a separate law that punishes people who promulgate erroneous voting information. Tennessee voters often decide which primary to participate in based on campaign developments. The lawsuit names Tennessee Secretary of State Tre Hargett, Coordinator of Elections Mark Goins and Attorney General Jonathan Skrmetti as defendants.

Washington CNN —A group of US senators is demanding that Meta CEO Mark Zuckerberg hand over troves of emails and documents that could show how the company handled the knowledge that its platforms could harm the mental health of teens. The company didn’t immediately respond to a request for comment on the letter. Meta spokesman Andy Stone said that the company is in touch with the members who signed the letter. The letter further accuses Meta of showing an “apparent willful disregard” for young people’s well-being, of “misrepresentations to Congress” and of “profiting from threats” to user safety. The letter requests a response by Nov. 30 and calls for Meta to provide its correspondence related to Bejar’s warnings to executives, as well as senior leaders’ own correspondence with Zuckerberg about proposed investments in user well-being.
