ATLANTA — The judge overseeing the election interference case against Donald Trump and several co-defendants in Georgia has thrown out three counts in the indictment — including two counts brought against the former president. “President Trump and his legal team in Georgia have prevailed once again,” he said in a statement. But a lawyer for Trump confirmed that McAfee’s decision would also apply to Trump. The case is currently on hold as Trump and other defendants appeal McAffee’s decision not to disqualify Fulton County District Attorney Fani Willis. In March, the same judge dismissed six other counts in the indictment, including three against Trump because the indictment lacked sufficient detail.

A judge on Thursday dismissed two criminal counts against Donald Trump in his Georgia election interference case, but kept intact the top racketeering charge and other counts against the former president and other defendants. Fulton County Superior Judge Scott McAfee also tossed out a third count that had been lodged against a number of Trump allies. The third count the judge tossed — numbered as Count 14 in the indictment — was criminal attempt to commit filing false documents. In March, judge tossed out three counts of solicitation of violation of oath by a public officer that had been lodged against Trump. Trump's appeal is set to be heard in oral arguments at the Georgia Court of Appeals in December.

CNN —The Georgia Court of Appeals will consider an effort by Donald Trump and his co-defendants to disqualify District Attorney Fani Willis from the 2020 election subversion case. In a brief order Wednesday, the court said it will hear the appeal from Trump and others challenging the ruling from Judge Scott McAfee that allowed Willis to remain on the case. No trial date has been set in the sprawling election subversion conspiracy case against Trump, and the decision to consider the appeal is another sign that pre-trial efforts to delay a trial are succeeding. CNN —Former President Donald Trump was dealt two major setbacks Thursday in his efforts to derail the criminal cases against him, with judges in the Georgia election interference case and in the federal classified documents case both rejecting bids by the presumptive 2024 GOP presidential nominee to have those cases thrown out. Trump has made similar presidential immunity arguments in the Georgia case and in the classified documents case. She wrote that prosecutors “make no reference to the Presidential Records Act” in the indictment against Trump and did not “rely” on the statute to bring charges.
