Obama enacted DACA; Trump tried to end itThe DACA policy was enacted after bipartisan, comprehensive immigration reform efforts failed for the umpteenth time. Nearly 600,000 people have sought protected status under the program, which defers but does not necessarily end any immigration action against them. The Trump administration tried to end the DACA program in 2017, but the effort eventually failed at the Supreme Court in 2020. Instead, Trump hit pause on new applications, something the Biden administration then reversed. The much more modest bipartisan effort pushed by Biden earlier this year would not have helped the undocumented spouses of citizens and their children.

Thomas received 103 gifts with a total value of more than $2.4 million between 2004 and 2023, the judicial reform group Fix the Court said in a report Thursday. Fix the Court's analysis found that Alito accepted 16 gifts worth a combined $170,095. Counting those gifts, Thomas' total two-decade haul is valued at nearly $4.2 million. The value and number of gifts Thomas received also eclipsed those accepted by eight retired or dead Supreme Court justices whose tenures overlapped his service on the court, which began in 1991. Antonin Scalia, a conservative justice who died in 2016 while on the court, accepted 67 gifts worth about $210,000 during his tenure, which began in 1986.

This is not the first time Alito has found himself in hot water over displaying a controversial flag on his property. The upside-down flag, a signal of distress, was adopted by Trump supporters who believed the false claim that the election had been stolen. (Alito said his wife had raised the upside-down flag in response to a disagreement with a neighbor. A new study by researchers for the RAND Corporation to assess two decades of same-sex marriage in the US argues marriage rates actually increased among opposite-sex couples as same-sex couples were granted the ability to marry in certain states. The Major Supreme Court Cases of 2024No Supreme Court term in recent memory has featured so many cases with the potential to transform American society. In 2015, the Supreme Court limited the sweep of the statute at issue in the case, the Sarbanes-Oxley Act of 2002. In 2023, the Supreme Court temporarily blocked efforts to severely curb access to the pill, mifepristone, as an appeal moved forward. A series of Supreme Court decisions say that making race the predominant factor in drawing voting districts violates the Constitution. Depending on how the high court rules, some of Trump's most serious legal troubles could melt away instantly. Still, the question remains: Can Trump consistently stay awake through the long slog of a criminal trial? Still, it was a striking image that simulcast three individuals in one: a criminal defendant; one of the most powerful people on the planet; and a napping old man. Not everyone is so lucky when those around them fall asleep in court. A defendant whose liberty is on the line would be well advised to find out a way to stay awake. (Some judges might frown upon a defendant chewing gum in court, but sleep specialists have identified plenty of other ways to stay awake, some of them courthouse-friendly.)

The charge at issue in the Supreme Court case stems from a law Congress enacted in response to a series of corporate accounting scandals, including the 2001 Enron debacle. The case before the Supreme Court involves only that last charge. All three defendants appealed to the Supreme Court, but the justices granted only Fischer’s case. In a filing last week at the Supreme Court in Trump’s immunity case, Smith argued the obstruction charge should stick against Trump even if Fischer wins.

The Supreme Court is hurting. I can say that with confidence — not based on any inside information but on the external evidence of how hard some of the justices are working to show that everyone on the court really does get along. The retired justice Stephen Breyer, on the talk circuit for his new book on constitutional interpretation, has been making the same point. I’m reminded of the last time the court made a concerted effort to assure the public that all was well. It was during the weeks that followed the ruling that clinched the 2000 presidential election for George W. Bush.

Recently, the Supreme Court justices Sonia Sotomayor and Amy Coney Barrett spoke together publicly about how members of the court speak civilly to one another while disagreeing, sometimes vigorously, about the law. Considerable disagreements on professional matters among the Supreme Court justices, important as they are, remain professional, not personal. They found some, and Justice Ginsburg wore them ever after. At about the same time, Justice O’Connor reminded me that our chief justice, William Rehnquist, had decided that he, too, needed something distinctive on his black robe. Justice O’Connor found at a European bookstall a picture of Lorenzo de’ Medici wearing similar stripes.

CNN —The foundation that selected SpaceX CEO Elon Musk, conservative media mogul Rupert Murdoch and other honorees as recipients of an award named after Ruth Bader Ginsburg announced Monday it is canceling its award ceremony after receiving pushback from the late justice’s family. The slate of this year’s honorees for the foundation’s “RBG Leadership” award, formerly the “Ruth Bader Ginsburg Women in Leadership” award, was announced last week and also included lifestyle icon Martha Stewart, actor Sylvester Stallone and financier Michael Milken. Ruth Bader Ginsburg, a longtime liberal member of the high court who died at age 87 in 2020, consistently delivered progressive votes on major social issues, including abortion rights, same-sex marriage and immigration. It is not interested in generating a debate about whether particular honorees are worthy or not,” she said. Indeed, Justice Ginsburg was known for her civility.”

Justice Amy Coney Barrett’s opinion was just a page long, all of two paragraphs. Justice Barrett was the third of Mr. Trump’s appointees, rushed onto the court after the death of Justice Ruth Bader Ginsburg, arriving just before the 2020 election. But she is viewed as one of the more moderate members, relatively speaking, of the court’s six-member conservative supermajority. In public appearances, she is adamant that the court is apolitical, though she sometimes says so in venues that undercut her message. In 2021, for instance, Justice Barrett told an audience in Kentucky that “my goal today is to convince you that this court is not comprised of a bunch of partisan hacks.”
