Part of the reason for those modest hopes was the fact that the defense case would not include testimony by the defendant. Later, the charging conference to agree on jury instructions showed how daunting the law is that Trump faces. All of that is bad news not just for Costello, whose clash with Merchan won Trump’s praise outside the courtroom Monday, but also for the defense. Because Costello was one of Trump’s only witnesses, there is also the risk that he — and the jury’s reaction to his poor attitude — will taint the defense case overall. There was little the defense could do about the law in the charging conference beyond their usual able argument.

CNN —Rudy Giuliani has agreed to never again publicly accuse two Georgia election workers of tampering with votes in the 2020 election, a false accusation that he has repeated frequently and that led to his bankruptcy. With the agreement, Giuliani is forfeiting a yearslong verbal and legal battle he’s waged with the election workers, Ruby Freeman and her daughter, Shaye Moss. “Today ends his efforts to profit off of lies about these two heroes of American democracy,” the workers’ attorney Michael Gottlieb said in a statement. The trial provided a searing glimpse into the harassment election workers suffered while prominent Trump supporters spread lies about the 2020 election. Giuliani is also in Chapter 11 personal bankruptcy, with Freeman, Moss and others pursuing everything he has of value.

It’s inspiring to watch these ordinary citizens as sovereign soldiers for justice. On Monday, this calm processional was disrupted, as jurors were forced to hurry out after a pro-Trump witness for the defense mocked the authority of the court. Moments later, Justice Juan Merchan ordered the courtroom immediately cleared and reporters fled in a frenzy. Michael Cohen had testified earlier that Costello and Rudy Giuliani were assigned by Trump to open a “back channel” to Cohen to keep him in the Trump fold.

CNN —Rudy Giuliani was suspended from New York City radio station WABC and his talk show canceled after he flagrantly ignored orders not to discuss false 2020 election conspiracy theories, the station’s owner said Monday. In recent months, Giuliani was repeatedly directed to not make claims of electronic voting manipulation surrounding the 2020 election, John Catsimatidis, the billionaire GOP donor and owner of the radio station, said in a statement. “Guiliani has admitted repeatedly over the past few days that he agreed not to speak about Dominion,” Catsimatidis said. CNN —An attorney discipline judge in California has rejected a request from ex-Trump election lawyer John Eastman to reactivate his law license following her recent recommendation that he be disbarred, which rendered him unable to practice law for now. Judge Yvette Roland, who oversees state bar proceedings in California, recommended in March that Eastman be disbarred for his election subversion efforts. The California Supreme Court will ultimately decide whether to endorse or reject Roland’s recommendation to disbar Eastman. “Eastman failed to uphold his primary duty of honesty and breached his ethical obligations by presenting falsehoods to bolster his legal arguments,” Roland wrote in her opinion recommending he be disbarred.
