FAIRFAX, Va. — A jury on Friday acquitted a former police officer in Virginia of involuntary manslaughter after he fatally shot a shoplifting suspect outside a busy shopping mall. But the jury did convict the former police sergeant, Wesley Shifflett, of reckless handling of a firearm in connection with the shooting. After the shots were fired, Shifflett immediately yelled “stop reaching” and told other officers that he saw Johnson reaching in his waistband. During cross-examination, Sands asked Shifflett about shooting Johnson before commanding that the victim “stop reaching.”“My motor functions were operating more quickly than I could verbalize,” Shifflett said. The special grand jury returned indictments on charges including involuntary manslaughter and reckless handling of a firearm.

For years, Jeff Sharp often relied on the same refrain when he came upon an addict. The only reason Bailey wasn’t charged in Hilbert’s murder, Zois told “Dateline,” is because she is dead. A lawyer for Bischoff disputed this account, telling “Dateline” that his client had nothing to do with Hilbert’s murder. Bailey Sharp, 23, was killed weeks after Justin Hilbert's murder. New York CNN —Additional charges against New York City Mayor Eric Adams are “possible” and it’s “likely” there will be additional defendants charged as part of the alleged scheme in the federal corruption case, a prosecutor said Wednesday at a court hearing. Federal prosecutor Hagan Scotten said they have evidence that Adams attempted to tamper with a witness in the investigation. The federal prosecutor revealed new information about the investigation, saying it began in the summer of 2021 before Adams became mayor. The additional defendants could be charged in a superseding indictment or in a separate case, Scotten added. Prosecutor Ute Lindemann argued that he should be convicted of two counts of rape and two of sexual abuse, and should be kept in preventive detention after he has served a 15-year sentence, German news agency dpa reported. The suspect hasn’t been charged in the McCann case, in which he is under investigation on suspicion of murder. He is currently serving a seven-year prison sentence in Germany for a rape he committed in Portugal in 2005. There are no formal pleas in the German legal system and there is no obligation for defendants to respond. In July, the court lifted an arrest warrant in the cases at stake in the current trial, citing a lack of “urgent suspicion” against the defendant.

Hannah Gutierrez-Reed will remain behind bars, according to a decision filed by the judge overseeing the “Rust” movie armorer's case on Monday. Judge Sommer ruled that Reed’s conviction still holds even though the judge previously determined that the prosecution suppressed evidence in the involuntary manslaughter case against “Rust” star and producer Alec Baldwin. For this reason, Judge Mary Marlowe Sommer dismissed Baldwin's case, saying New Mexico prosecutors failed to disclose the evidence — a violation of the Brady Law. The sanction of dismissal is the only warranted remedy,” Sommer said of her decision at the time. Morrissey has since asked the judge to reconsider dismissing the case against Baldwin.

Organized retail crime "is not shoplifting," the agency says on its website, "and these crimes are not victimless." AdvertisementOne homeless woman in jail who pleaded guilty to felony organized retail theft tells me she steals out of desperation. Gavin Newsom sent $267 million to cities across California to increase arrests of organized retail crime — and the crackdown has escalated dramatically. Even the guy who says he coined the term "organized retail crime" can't say how much is lost to it. Gavin Newsom has provided California cities with $267 million and signed 10 new bills into law to bolster the prosecution of organized retail crime.

“The Supreme Court has a limited role to play death penalty cases,” said Paul Cassell, a University of Utah law professor who is representing a victim’s family in another death penalty case before the high court this year. Another involves an Alabama man who claims he is intellectually disabled and therefore ineligible for execution under Supreme Court precedent. The Supreme Court’s approach to death penalty appeals is “to correct severe misapplications of constitutional law by America’s state court systems,” said Seth Kretzer, a Texas attorney who has represented death row inmates at the Supreme Court. Republicans stand a good chance of erasing the Democrats’ narrow 51-49 Senate majority in November, a hard reality that complicates Harris' transition planning. Members of Harris’ transition team have studied that one — the handoff from Ronald Reagan to George H.W. Harris' team is operating under an unusually compressed timeline and is still building the basic apparatus needed to vet potential hires and staff an administration. Last month, Harris' campaign appointed Yohannes Abraham to run the team that is preparing for a transfer of power. Emmanuel Littlejohn, 52, received a lethal injection at the Oklahoma State Penitentiary and was declared dead at 10:17 a.m. His execution came after Republican Gov. The five executions would also mark another grim milestone — 1,600 executions since the death penalty was reinstated by the U.S. Supreme Court in 1976, according to the Death Penalty Information Center. Littlejohn was 20 when prosecutors say he and co-defendant Glenn Bethany robbed the Root-N-Scoot convenience store in south Oklahoma City in June 1992. Littlejohn’s attorneys also argued that killings resulting from a robbery are rarely considered death penalty cases and that prosecutors today would not have pursued the ultimate punishment. Because of the board’s 3-2 recommendation, Stitt had the option of commuting Littlejohn’s sentence to life in prison without parole.
