CNN —Almost three decades ago, Richard Hays, a United Methodist minister and the soon-to-be dean of Duke Divinity School, wrote what quickly became the go-to traditionalist Christian argument against same-sex marriage. Fuller Theological Seminary, where Christopher Hays is a professor, also demands agreement with a faith statement that opposes same-sex marriage. Even as support for same-sex marriage has plateaued in the last few years, recent surveys from Gallup find that more than one in five Gen Z Americans identify as LGBTQ, and nearly 90% of Americans under 30 years old support same-sex marriage. The reversal from Hays certainly will not settle the debate among Christians when it comes from same-sex marriage. But I hope it makes opponents of same-sex marriage at least pause and wonder — is there a faithful path forward that makes room for people like me?

PHOENIX — Members of an Arizona tribe are trying to persuade a federal judge to extend a temporary ban on exploratory drilling for a lithium project near lands they have used for religious and cultural ceremonies for centuries. The case is among the latest legal fights pitting Native American tribes and environmentalists against President Joe Biden’s administration as green energy projects encroach on lands that are culturally significant. The springs have served as a place of healing and prayer for generations, the tribe has said in court filings. Federal land managers also are expected to issue a draft environmental review of a lithium mine planned by Australian company Ioneer Ltd. between Reno and Las Vegas. Backers of Arizona Lithium’s project include the Navajo Transitional Energy Company, which announced its plans in 2022 to join with the Australian company and work as a contractor on the project.

New York CNN —Meta failed to remove an explicit, AI-generated image of an Indian public figure until it was questioned by its Oversight Board, the board said Thursday in a report that calls on the tech giant to do more to address non-consensual, nude deepfakes on its platforms. The report is the result of an investigation the Meta Oversight Board announced in April into Meta’s handling of deepfake pornography, including two specific instances where explicit images were posted of an American public figure and an Indian public figure. But in the case of the Indian public figure, although the image was twice reported to Meta, the company did not remove the image from Instagram until the Oversight Board took up the case. “Meta determined that its original decision to leave the content on Instagram was in error and the company removed the post for violating the Bullying and Harassment Community Standard,” the Oversight Board said in its report. The push to fight non-consensual deepfakes is just part of Meta’s larger efforts to prevent the sexual exploitation of its users.

Public schools are not Sunday schools, and families should feel free to send their children to school without worrying about state officials interfering in their choices about religious instruction. These politically conservative state officials are seemingly making a show of testing the limits of government-sponsored religious instruction and exercise in public schools, emboldened by the US Supreme Court’s recent decisions. Like religious instruction in public schools, the public funding of religion undermines fundamental principles of religious freedom for all. By merging religious and political authority, taxpayer funding of religious schools threatens the rights of people of all faiths — and those of no faith.

From Monday, users will need to present a doctor’s prescription to a pharmacist to buy vapes, and the choice will be limited to three flavors: mint, menthol and tobacco. Dozens of countries have banned disposable vapes, but with the ban on vape sales in shops, service stations and other small retailers, Australia has introduced “world leading” laws, according to the government. Adults will be able to buy vapes in pharmacies, without a prescription – but the devices may be hard to find after some leading pharmacy chains declared they would refuse to stock them. CNN —As the conservative Supreme Court majority has won case after case in recent days, liberal dissenters are having their moment in the courtroom. Other justices stared out at spectators or down at notes, perhaps anticipating the next opinions, and dissents, to be revealed. The court majority reversed a 1984 milestone that required judges to defer to reasonable agency interpretations of their congressional mandates. Her oral dissent lasted nearly 15 minutes, about five minutes longer than Roberts’ rendition of the majority opinion. The Supreme Court on Friday upheld an Oregon city’s laws aimed at banning homeless residents from sleeping outdoors, saying they did not violate the Constitution’s prohibition on cruel and unusual punishment. The decision is likely to reverberate beyond Oregon, altering how cities and states in the West police homelessness. The ruling, by a 6-to-3 vote, split along ideological lines, with Justice Neil M. CNN —The Supreme Court ruled Friday in favor of an Oregon city that ticketed homeless people for sleeping outside, rejecting arguments that such “anti-camping” ordinances violate the Constitution’s ban on “cruel and unusual” punishment. The case centered on “anti-camping” ordinances in Grants Pass, Oregon, that were challenged by several residents experiencing homelessness. “For some people, sleeping outside is their only option.” The city, she said, “punishes them for being homeless. The ordinances barred people from sleeping in public with “bedding,” which can include sleeping bags or bundled-up clothing. In reaction to the Supreme Court’s ruling, housing rights groups came out in full force to condemn the decision.

I’m still sorting through the Supreme Court’s immunity ruling, and while it’s way too early for a definitive interpretation (scholars will be arguing about it for years), it’s not too early for three broad conclusions. First, and most important, the Supreme Court granted a dangerous amount of discretion to presidents. The court might say that presidents aren’t above the law, but in reality, it established an extraordinarily broad zone of absolute immunity for presidents (one broad enough, as Justice Sonia Sotomayor notes in a dissent, to potentially protect presidents from prosecution for bribes and assassinations) and a tough test for prosecuting those acts that aren’t immune. To understand the most dangerous potential implications of this action, consider that a president has the extraordinary authority to order troops into American streets under the Insurrection Act. Then, once deployed, those troops would be under the command of a person who would almost certainly enjoy absolute immunity for the orders he gives them.

A New York judge on Tuesday lifted parts of a gag order imposed on former President Donald Trump in his criminal hush money case, but kept some restrictions in place until Trump is sentenced. While he lifted that piece of the gag order, the judge ruled that a prohibition on disclosing juror information will remain in effect until further notice. Trump raged against the gag order when it was first imposed on March 26, about three weeks before the trial began. Trump violated the gag order 10 times during the historic trial. Trump campaign spokesman Steven Cheung in a statement Tuesday criticized Merchan for declining to lift the entire gag order.
