CNN —The Biden administration is taking the unprecedented step of banning US companies and citizens from using software made by a major Russian cybersecurity firm because of national security concerns, Commerce Department Secretary Gina announced Thursday. Thursday’s announcement comes after CNN reported in April that the Biden administration was preparing to issue an order that would prevent US companies and citizens from using Kaspersky software. US government agencies are already banned from using Kaspersky Lab software, but action to prevent private companies from using the software is unprecedented. Founded in Moscow in 1997, Kaspersky Lab grew into one of the world’s most successful anti-virus software companies alongside American rivals like McAfee and Symantec. A senior White House official described the action as a “rather extraordinary” policy adjustment at a critical moment for Ukraine. “If we didn’t do this for Ukraine, they would not have been able to maintain their critical air defense stockpile heading into the winter, period,” the official said. Ukraine is expected to get its first exports of the air defense capabilities this summer and the policy change will stay in place for 16 months, the official said. The White House official would not share the list of affected countries, other than to say that air defense exports to Taiwan would not be impacted. "I am still favoring moves to the upside for the gold market in light of where we currently stand on the interest rate curve, which is at the peak," said Tim Waterer, chief market analyst at KCM Trade. "The gold market seems content to consolidate recent gains rather than reach higher at this stage, at least until we see some further evidence of softening U.S. macro data, which could alter the interest rate outlook."

Since the attacks of Oct. 7, every legal expert I have asked has shared one conclusion: Hamas’s attacks on civilians that day, including killing, torture, and hostage-taking, were war crimes. Tom Dannenbaum, a Tufts University professor, told me just days after the attack that there was “no question” Hamas’s attack had involved multiple war crimes. Last month, the prosecutor of the International Criminal Court announced that he was seeking warrants for the arrest of three Hamas leaders on charges of war crimes and crimes against humanity relating to the Oct. 7 attack on Israel, as well as the hostage-taking that followed. Last week, a U.N. commission concluded that there was credible evidence that members of Hamas and other armed Palestinian groups committed war crimes on Oct. 7, including by killing civilians, carrying out torture, and taking hostages. The commission also found evidence of Israeli war crimes, including the use of starvation of civilians as a weapon of war.

The Trump campaign, by contrast, has been slow to staff up in key states, causing concern among some Republican strategists. A former Texas city councilwoman may pursue a lawsuit claiming that officials had abused their power by arresting her in retaliation for exercising her First Amendment rights, the Supreme Court ruled on Thursday. The court’s five-page opinion was unsigned, which is unusual in argued cases. Justice Samuel A. Alito Jr. issued a 16-page concurring opinion, writing only for himself. The unsigned opinion said an appeals court had taken “an overly cramped view” of the evidence required to prove a retaliatory arrest. The appeals court should have considered, the opinion said, objective evidence presented by the councilwoman, Sylvia Gonzalez, that the criminal law under which she had been charged had never been used in the county in similar circumstances.

CNN —US officials have serious concerns that in the event of a full-blown war between Israel and Hezbollah, the Iran-backed militant group could overwhelm Israel’s air defenses in the north — including the much-vaunted Iron Dome air defense system, three US officials told CNN. Israeli officials have told the US they are planning to shift resources from southern Gaza to northern Israel in preparation for a possible offensive against the group, US officials told CNN on Wednesday. “We assess that at least some” Iron Dome batteries “will be overwhelmed,” said a senior administration official. Earlier this month, Hezbollah released a video purporting to show a drone striking and damaging an Iron Dome battery on an army base in northern Israel. The Iron Dome is fundamental to Israel’s defense and the US government has spent over $2.9 billion on the program, according to the Congressional Research Service.

New York is launching a program offering homeowners up to $14,000 in total rebates for energy-efficiency upgrades to their property, and more states are expected to follow suit by summer's end. The rebate programs are part of the federal Inflation Reduction Act, the largest piece of climate legislation in U.S. history, which President Joe Biden signed in 2022. The law earmarked $8.8 billion for consumers via two Home Energy Rebates programs. Such projects might include installing air sealing, insulation, electric heat pumps and electric stoves, for example. When combined with a fledgling state program called EmPower+ — which offers up to $10,000 per low-income household — consumers can access up to $24,000 in total rebates for making energy-efficiency upgrades, according to Doreen Harris, president and CEO of the New York State Energy Research and Development Authority.

ShotSpotter, a system the Police Department uses to detect gunfire, is overwhelmingly inaccurate and leads officers to spend hundreds of hours each month investigating nonexistent shots, according to an audit the New York City comptroller released Thursday. The Police Department has spent more than $45 million on ShotSpotter since it started using it in 2015, even as cities around the country have stopped using the system. New York must decide before December whether to renew its contract with SoundThinking, the California company that owns the system, and the audit advises officials to decline until the system can be fully evaluated. Of the 940 alerts officers responded to last June, only 13 percent corresponded to confirmed shootings. And in 2022, the audit found, the system also failed to detect more than 200 real incidents of gunfire in Manhattan.

CNN —Two beluga whales have been rescued from the besieged city of Kharkiv in Ukraine and taken to an aquarium in Valencia, Spain, in a complex operation. A multinational team involving marine mammal care experts from Oceanogràfic de Valencia, the largest oceanarium in Europe; Georgia Aquarium in Atlanta; and SeaWorld were involved in the high-risk journey. The pair of belugas – a 15-year-old male named Plombir and a 14-year-old female called Miranda – arrived in “delicate health” Tuesday evening after a “grueling journey,” according to Georgia Aquarium. “The city is facing increasing threat from artillery fire, which has intensified in recent weeks, with bombs dropping within a few hundred meters of the aquarium,” Georgia Aquarium said in a press release. The journey began Monday when the team first removed the whales from Ukraine’s NEMO Dolphinarium and drove them 12 hours from Kharkiv to Odesa.
