Why OpenAI should fear a Scarlett Johansson lawsuit
  + stars: | 2024-05-22 | by ( Brian Fung | ) edition.cnn.com   time to read: +11 min
“It doesn’t matter if OpenAI used any of Scarlett Johansson’s actual voice samples,” Li posted on Threads. Here, Johansson could accuse OpenAI of illegally monetizing who she is by essentially fooling users into thinking she had voiced Sky. But there’s substantial case law — and one very inconvenient fact for OpenAI — undercutting that defense, legal experts say. According to Johansson, OpenAI approached her to perform as Sky; Johansson declined. While California’s publicity law protects all individuals, some state statutes only protect famous people, and not all states have such legislation on the books.

The situation deteriorated in April after Synapse declared bankruptcy following the exodus of several key partners. That has left users of several fintech services stranded with no access to their funds, according to testimonials filed this week in a California bankruptcy court. One customer, a Maryland teacher named Chris Buckler, said in a May 21 filing that his funds at crypto app Juno were locked because of the Synapse bankruptcy. Synapse had contracts with 20 banks and 100 fintech companies, resulting in about 10 million end users, according to an April filing from founder and CEO Sankaet Pathak. The freeze-up of customer funds exposes the vulnerabilities in the banking as a service, or BAAS, partnership model and a possible blind spot for regulatory oversight.

The Esper Hand is the first product from Esper Bionics, a Ukrainian-US based company focused on next-generation prosthetics. “I think AI will be the next step in bionics,” says Dima Gazda, CEO of Esper Bionics. According to Esper Bionics, 70 Ukrainian soldiers are currently serving with Esper Hands, but the need greatly outnumbers the supply. Every morning, a group of Ukrainian veterans gather inside the clinic and go over the schedule for the day. Esper Bionics sells the Esper Hand (which normally sell for around $20,000) to Protez at manufacturing costs, and then Protez fits them to users for free.

In contrast to previous research that assumed the sun’s magnetic field originates from deep within the celestial body, they suspect the the source is much closer to the surface. This view of the sun's magnetic field was generated by NASA's Solar Dynamics Observatory. NASA/GSFC/Solar Dynamics ObservaModeling the sun’s magnetic fieldIt’s difficult to see the sun’s magnetic field lines, which loop through the solar atmosphere to form a complicated web of magnetic structures far more complex than Earth’s magnetic field. To better grasp how the sun’s magnetic field works, scientists turn to mathematical models. Like the 11-year solar magnetic cycle, torsional oscillations also experience an 11-year cycle.

on Wednesday announced a "multi-year global partnership" that will allow OpenAI to access current and archived articles from News Corp.'s outlets, including The Wall Street Journal, MarketWatch, Barron's, The New York Post and more. As part of the deal, OpenAI will be able to display content from News Corp.-owned outlets within its ChatGPT chatbot, in response to user questions. The news follows Reddit's announcement on Thursday that it will partner with OpenAI, allowing the ChatGPT maker to train its AI models on Reddit content. As part of that deal, OpenAI will gain access to Reddit's Data application programming interface, or API, "which provides real-time, structured, and unique content from Reddit," according to a release. Google announced a similar partnership with Reddit in February, allowing the company to train its AI models, such as Gemini, on Reddit content via access to the platform's API.

PARIS, France — French car giant Peugeot told CNBC this week that it's partnering with Vay, a German mobility startup, to integrate so-called "teledriving" tech — an alternative to autonomous cars — into its vehicles. The deal will see the two companies assess the use of Vay's teledriving tech on "last-mile delivery" vans and smaller logistics vehicles, with a focus on business-to-business (B2B) customers. The first pilot test drives of Vay's technology with Peugeot vehicles are expected to take place this year. Peugeot is looking to include the tech in its E-3008 electric SUVs and some electric vans.

Industry analysts think the AI revolution is still in its early stages, and longtime fund manager Chris Retzler agrees. But the market veteran believes small, under-the-radar growth stocks—not the well-known companies that have already surged — are the best way to play the AI boom. AdvertisementHow to invest in small caps — and where to find themSince 2008, Retzler has single-handedly managed the Needham Small Cap Growth Fund (NESGX). Plus, investors are overlooking small-cap stocks' exposure to key growth opportunities like AI, data center buildouts, military modernization, and telecommunication improvements, in Retzler's view. "Money doesn't go immediately to small caps — it goes to the next market cap, generally," Retzler said.

Meta may need such access to make its generative AI tools, like Meta AI, more effective for users and more competitive in the increasingly crowded market of generative AI search tools and chatbots, the people said. User posts and comments on Facebook or Instagram are not necessarily the type of high-quality training data that generative AI chatbots and search tools need to generate quality outputs. Previously, Zuckerberg said he did not expect the generative AI boom. The US Copyright Office is considering new rules to cover generative AI. Major rival tech companies now fiercely competing in generative AI have already entered into deals with news publishers and media outlets for more access to content to be used as model training data.

Back in September, Scarlett Johansson, who played the hauntingly complex AI assistant in the 2013 Spike Jonze film “Her,” got a request from OpenAI’s CEO, Sam Altman. He wanted to hire Johansson to voice his company’s newest ChatGPT model, “Sky.” She said no. Johansson quickly lawyered up, saying Monday she was “shocked, angered and in disbelief” that Altman would use a voice “so eerily similar” to her own. OpenAI was forced to confront some of those concerns late last week, after two prominent employees left the company. “Being friends with AI will be so much easier than forging bonds with human beings,” wrote Wired editor Brian Barrett in a recent essay about the movie.

The decision by Microsoft to link executive compensation to successful cybersecurity performance is another is prompting discussions at other firms. One change the tech giant is making in response: linking executive compensation more closely to cybersecurity. In recent years, many Fortune 500 companies, including Apple, have added bonus pay tied to ESG metrics. The conversations about cybersecurity-linked executive pay have started taking place at other companies since Microsoft made its move, according to Aalap Shah, managing director at executive compensation consultant Pearl Meyer. Madnick's research shows that gaps in corporate culture are often culprits in high-profile hacks, not just the Microsoft example.

A federal judge in Texas on Wednesday said Exxon Mobil can sue to bar a climate change proposal from an activist investor, in a case that has raised concerns about its future effect on shareholder resolutions. Exxon sued the two investors in January after they submitted a proposal to be tabled at the May 29 annual shareholder meeting that called for the company to accelerate carbon dioxide emissions reductions. Arjuna and Follow This subsequently withdrew the proposal, but Exxon proceeded with its claims against the two firms, arguing that they could file similar proposals at future shareholder meetings. The judge, appointed to the federal bench by former President Donald Trump in 2019, said Exxon should not be faulted for distrusting the activist investors. He said Arjuna could slightly modify its withdrawn 2024 proposal for submission to future shareholder meetings.
