Lawful permanent residency, commonly known as obtaining a green card, allows immigrants to live and legally work in the United States. Some Democrats in the Senate praised Biden’s executive order while those in vulnerable seats tried towing a line. Sen. Bob Casey, a Democrat in a vulnerable seat, also declined to say if he supports Biden’s executive order. However, he did praise Biden’s executive order from earlier this month aimed at restricting border crossings.

The Biden administration is considering a proposal to protect undocumented spouses of U.S. citizens from deportation and allow them to work in the country legally, according to four officials with knowledge of the discussions. Any such program could also provide some spouses an easier route to obtain U.S. citizenship. The proposal comes as President Biden has moved to address political liabilities in his immigration policy in recent days. Last week, he moved to bar asylum for migrants crossing into the United States as part of an effort to toughen border enforcement, eliciting criticism from members of his own party. And now, a move to protect undocumented immigrants in the United States could help Mr. Biden address some of the fierce resistance that order elicited and shore up support among immigrant advocates, Latino voters and his progressive base.

The average daily illegal crossings have for years surpassed that threshold, peaking at over 8,000 in December, according to Department of Homeland Security data analyzed by CNN. Under a pandemic-era restriction, which was lifted last year, federal authorities swiftly expelled hundreds of thousands of migrants encountered at the US southern border. A CNN analysis found the last time average daily encounters between migrants and US Border Patrol at the southwestern land border were less than 2,500 was in January 2021. To lift the new policy, the daily average needs to drop even lower — to less than 1,500 average daily encounters for seven consecutive days between ports of entry. The last time illegal crossings at the southwestern land border were that low was in July 2020, the records show.

On Tuesday, President Biden issued a proclamation that gives the Department of Homeland Security the authority to temporarily block migrants from seeking asylum between ports of entry at the United States-Mexico border. The president’s decree echoes a 2018 Trump-era policy that invoked the same powers to deny protections to people seeking asylum between ports of entry. Mr. Biden may think that shutting the border to asylum seekers will improve his standing with voters. Rather than reduce unauthorized migration, his policy will likely push people to cross at more dangerous areas along the border. Though there’s little to be done now about this recycled immigration policy, Mr. Biden has a moral obligation to use his legal authority to protect the communities he promised to defend four years ago while on the campaign trail.

Plaintiffs in some high-stakes, high-profile cases have found that in some of the country’s federal courts, it’s not hard to cherry pick a sympathetic judge. Such judge shopping, particularly in cases challenging abortion rights and immigration policy, has been drawing increasing scrutiny. Last month, the federal judiciary’s policymaking body called for colleagues to curb the practice by making the assignment of the biggest civil cases random in the 94 federal district courts. Each says that the goal of their respective bills is to eradicate the pursuit of sympathetic judges by savvy litigants.
