On May 16 the Justice Department formally moved to reclassify marijuana from Schedule I of the Controlled Substances Act to Schedule III. It is, however, the biggest step yet toward abolishing the legal fiction that cannabis is as dangerous as heroin. And it puts marijuana — used more than any other illicit drug in the world — on a pathway for fully legal recreational use, which a majority of Americans support. It also offers an opportunity to start ironing out the details of what federal cannabis oversight ought to look like if the time comes — both to redress past harms and protect public health. Learning from the experiences of states that have legalized marijuana is essential.

But a new study suggests that an additional demographic is at risk: seniors. The study, published Monday in JAMA Internal Medicine, found that after Canada legalized marijuana, the number of emergency room visits for cannabis poisoning rose sharply among people ages 65 and older. Poisonings doubled after Canada legalized sale of the cannabis flower, and then tripled just 15 months later, when Canada legalized the sale of edibles. Barack Obama notably opposed same-sex marriage when he ran for president as a Democrat in the 2008 election and, as public opinion was rapidly shifting, changed his tune in 2012 to support same-sex unions. A new study by researchers for the RAND Corporation to assess two decades of same-sex marriage in the US argues marriage rates actually increased among opposite-sex couples as same-sex couples were granted the ability to marry in certain states. A key difference between support for same-sex marriage and support for abortion rights, according to Lundry, is that support for abortion rights has remained positive for decades, in contrast to same-sex marriage, which saw a complete turnaround.

A flicker of hope for the weed businessFor years, the dreams of the cannabis industry looked like they might go up in smoke, with the U.S. government classifying marijuana as a drug as dangerous as heroin. But the multibillion-dollar industry now has some hope that could change. The bet is that this will give the industry a new lease on life — though it shouldn’t expect big changes immediately. Shares in Tilray, a giant in the industry, jumped 39 percent on Tuesday, while those in Canopy Growth leaped nearly 79 percent. The US Department of Justice is expected to recommend that marijuana be rescheduled as a Schedule III controlled substance, a classification shared by prescription drugs such as ketamine and Tylenol with codeine. The standard rulemaking process is lengthy, is subject to a public comment period, and could take months to complete. However, rescheduling marijuana will not solve that federal-state conflict, the Congressional Research Service noted in a January 16 brief. States with medical marijuana programs do currently have some federal protections in place via appropriations legislation that restricts the Justice Department from interfering in those programs. The FDA’s scientific and medical evaluation of marijuana did not address products containing plant-derived cannabidiol, commonly known as CBD.
