"I will be back in some form," President Donald Trump pledged as he departed Joint Base Andrews for Palm Beach on his last Air Force One ride. Instead, in recent weeks, Trump has shared weird, listless, and overly-long web video statements — too unfocused to shift attention and change the conversation. Trump is very unpopular, and Republicans will call a continued focus on him "divisive" because it will divide the Republican party. And while Trump could re-center himself by running for president again, I don't think he will. But even if he avoids criminal trouble, Trump is already mightily resisting the label that he is a loser.

The second impeachment of President Donald Trump has concluded, not with a bang, but with a whimper. What is needed, rather, is criminal prosecution. Trump previously suffered impeachment for deploying unlawful means to remain in power — using his office to leverage Ukraine to investigate then-Democratic opponent Joe Biden’s family. That impeachment did not deter Trump from abusing his power again, nor should we believe that this one will deter anyone else. By imposing a personal and direct punishment upon Trump, criminal prosecution will force future leaders to think twice about threatening that essential precondition of any functional republic: the peaceful transfer of power.

Had Trump once stepped out of character on something big and hard that challenged his base and surprised us on the upside, like on climate or immigration, I’d have praised that, too. Too bad, because as journalists and as citizens, we live for surprises on the upside from our leaders. I have been watching Mitt Romney repeatedly put his oath to defend the Constitution ahead of his party and personal political interests. Liz Cheney just totally surprised me on the upside last week by putting country and Constitution before party and personal ambition and voting to impeach Trump. It is your duty to fortify your own house so that you may be a house of refuge in times of organization.

President Donald Trump retains overwhelming support from Republican voters in the final days of his term, an NBC News poll conducted after a mob of his supporters stormed the U.S. Capitol shows. Eighty-nine percent of Republicans said they approved of Trump before the election, compared to 87% in the most recent poll. The numbers show that Trump continues to have a strong hold on the loyalty of Republican voters even on his way out the door. Among Republicans who primarily support Trump, his job approval stands at 98%. While Trump's support among voters remains essentially constant, a growing number of prominent Republicans have publicly broken with him since the attacks on the Capitol.

Republican senators who voted to acquit Trump in February — in a hollowed-out trial without witnesses — misread the president, completely seemingly convinced that impeachment alone might temper his actions. Trump’s Senate enablers allowed Trump to escape the consequences of his abuse of power by their near-unanimous vote to acquit last February. If the Senate convicts Trump, a simple Senate majority can bar him from ever again holding any federal office. And unlike Trump, Nixon resigned when Republican congressional leaders told him that he would likely be convicted in a Senate impeachment trial. Duty demands that he be convicted by the Senate and, by a Senate vote, barred from ever again holding the power of the presidency.

But that debate turned into a rout — 197 House Republicans opposing Trump’s impeachment, versus 10 voting for it. Now 10 House Republicans supporting their president’s impeachment wasn’t insignificant: It’s more than the House Democratic defections in Bill Clinton’s impeachment (five) and House GOP defections in Trump’s first impeachment (zero). But as impeachment moves to a Senate trial, the question we have: Are 10 House GOP defections worth 20 Senate GOP defections? Eight out of 10: The number of House Republicans voting for impeachment whose congressional districts were won by Donald Trump. 1: The number of House Republicans voting for impeachment who also objected to certification of the electoral votes last week.

Senate Majority Leader Mitch McConnell, a Republican, rejected Democratic calls for a quick impeachment trial, saying there was no way to finish it before Trump leaves office. That raised the prospect of a bitter trial in the Senate during Biden’s first days in the White House, something he urged Senate leaders to avoid. SENATE TRIALUnder the Constitution, impeachment in the House triggers a trial in the Senate. McConnell has said no trial could begin until the Senate was scheduled to be back in regular session on Tuesday, the day before Biden’s inauguration. In an emotional debate before the 232-197 vote, 10 Republicans joined the majority Democrats in supporting impeachment. Multiple Republicans defended Trump’s remarks as protected by the First Amendment of the U.S. Constitution, which defends free speech. The swift impeachment, one week after the riot, is very unlikely to lead to Trump’s ouster before Biden takes office on Jan. 20. But even if he has left the White House, the Senate could convict Trump and then vote to ban him from running for office again. “The party is going to be totally broken” if it abandons Trump, Foster says, predicting Trump loyalists will spin off into a new third party. And the choice confronting party leaders as they ponder a renewed impeachment effort – whether to continue backing Trump or make him a pariah – will almost certainly cost the party voters it needs to win future elections, Republican party officials and strategists say. ‘GET OVER IT’Trump has at times been defiant amid the blowback from the Capitol riot. “The president defeated the Republican establishment in 2016 – the Republican Party, in terms of the voters, the movement, is very representative of the president’s agenda,” says Boris Epshteyn, a strategic advisor to Trump. Widen After Impeachment Vote Some House Republicans have called on Representative Liz Cheney to resign from her leadership post after she voted to impeach President Trump. Representative Liz Cheney had issued a scathing statement the day before the impeachment vote repudiating President Trump. Mr. Biden will detail his proposal, which he and his economic team have been honing for weeks, in an evening speech in Delaware. “This nation also remains in the grip of a deadly virus and a reeling economy,” Mr. Biden said Wednesday. Far more of a party institutionalist, Mr. Biden has promised to rebuild state parties and deepen investments in the committee.

That means the trial will not effectively start until after Mr. Biden is sworn in on Wednesday, officials involved in the planning said. Speaker Nancy Pelosi of California has discretion over when to transmit the article of impeachment, formally initiating the Senate proceeding. With Republicans fractured after the president’s bid to overturn the election inspired a rampage, many of them were trying to gauge the dynamics of a vote to convict Mr. Trump. Ms. Cheney had joined nine other members of the party who voted with Democrats to charge the president with “incitement of insurrection.”Most Senate Republicans stayed publicly silent about their positions. But Senator Lisa Murkowski, Republican of Alaska and one of the president’s leading critics, signaled on Thursday that she was among a small group in her party so far considering convicting Mr. Trump.

Senate Majority Leader Mitch McConnell, R-Ky., told his GOP colleagues in a note Wednesday afternoon that he remains undecided whether he'll vote to convict President Donald Trump at his coming impeachment trial. In a statement following the impeachment vote, McConnell said there is no chance the Senate could have a trial before Trump leaves office Jan. 20. He added: "Even if the Senate process were to begin this week and move promptly, no final verdict would be reached until after President Trump had left office. "A Senate trial can begin immediately, with agreement from the current Senate Majority Leader to reconvene the Senate for an emergency session, or it will begin after January 19th," he said in a statement. The official said the White House has "minor concerns" about the Senate's convicting Trump given news reports that McConnell is privately supportive and expressed that that scenario is unlikely.

The top House Republican, Kevin McCarthy, declined or ignored reporters’ questions about Cheney’s move on Wednesday. As the House debated whether to impeach Trump, Cheney explained that her beef with the president was not merely around a difference of opinion over legislation. Republican Representative Andy Biggs, a Trump ally, nonetheless sought retribution against the leader of the House Republican Caucus, a position that her father, former Vice President Dick Cheney, once held when he served in Congress. But Cheney, from the deeply Republican state of Wyoming, had no such hesitation in announcing her intention on Tuesday to vote for Trump’s impeachment.
