Now the article of impeachment moves to the Senate for a trial, with conviction carrying the penalty of removal from office and possible disqualification from future federal office. Both arguments are dangerously misguided, and both misunderstand the vital role of impeachment in protecting our constitutional order. For the American founders, the story of Charles I was a paradigm case for why presidents had to be removable from office via impeachment. The Senate can begin to undo some of that damage by repudiating the seditious last act of a lawless presidency.

The vice president had already indicated that he was unlikely to act to force the president aside, and no one in either party expected Mr. Trump to step down. With that in mind, Democrats had already begun preparing a lengthier impeachment report documenting the president’s actions and the destruction that followed to accompany their charge. They were confident they had the votes to make Mr. Trump the first president ever to be impeached twice. The impeachment article invoked the 14th Amendment, the post-Civil War-era addition to the Constitution that prohibits anyone who “engaged in insurrection or rebellion” against the United States from holding future office. Brian Babin of Texas expressed on Saturday that "history will be unforgiving" to any congressional Republican who doesn't back a challenge to the Electoral College certification of President-elect Joe Biden's win on Jan. 6. In December, Babin co-signed a letter requesting that Congress hold hearings to "probe all allegations of illegal conduct concerning the November 3, 2020 elections." Notable signatories of the letter included Reps. Mo Brooks of Alabama and Paul Gosar of Arizona, who early on stated that Trump won the election despite Biden's clear victory. Since the aftermath of the November election, Trump has steadfastly claimed, without evidence, that he won the presidential race and that fraudulent votes were added to statewide tallies.
