☆ KFC sues Church’s over ‘Original Recipe’

Last week, KFC accused Church’s Texas Chicken of violating its trademark rights when its fried chicken competitor began using the words “Original Recipe” in its advertising and promotions. KFC claimed in a lawsuit that beginning September 30, it noticed Church’s “abruptly” began using the phrase and ignored KFC’s October 24 letter objecting to the ads. In the disputed promotions, Church’s posted photos of its fried chicken deals with text above reading: “our original recipe is back.”The phrase, which KFC has been using for over half a century, “is likely to create confusion in the marketplace and dilute the ORIGINAL RECIPE® Mark,” the lawsuit, which was filed in US District Court in Texas, said. But when it comes to fried chicken, KFC also has to compete with Church’s Texas Chicken, Popeyes, Raising Cane’s, Zaxby’s and more. KFC’s “Original Recipe” trademark, which it says is a secret blend of 11 herbs and spices, has long been part of the company’s branding.

New York CNN —Fast food giant Yum Brands is going all in on value — but only Taco Bell is performing well enough to immediately bring back inflation-weary customers. But Gibbs said Taco Bell is outperforming its rivals in the fast food industry. “I think we’re really seeing Taco Bell stand out from the crowd,” he said to investors. Of the three, only Taco Bell’s US same-store sales grew in the second quarter of 2024, at 5%. The earnings call highlighted how fast food and fast casual chains are struggling to retain customers who believe it is cheaper to just eat at home.

New York CNN —Taco Bell, KFC and Pizza Hut’s parent company is facing the same problem as its rivals: Fast food is getting too expensive and consumers are pushing back. Yum Brands, which owns all three chains, reported Wednesday weaker-than-expected sales in the fourth quarter. Meanwhile, Pizza Hut’s US sales slid 4% in fourth quarter and KFC sales were flat, with both brands’ numbers also coming in below analysts’ expectations. Yum Brands is the third fast food company to report a disappointing earnings report as consumers more closely examine where they’re spending money. That’s putting pressure on lower-income consumers, a vital base for fast food chains.

New York CNN Business —KFC Germany apologized for an “unacceptable” message sent to customers on Wednesday, which appeared to tie a sales promotion to the annual commemoration of Kristallnacht. KFC app users in the country received a message encouraging them to mark the day with crispy chicken and cheese from KFC, according to Twitter users who shared screengrabs of the message in German. “Earlier today an automated push notification was accidently [SIC] issued to KFC app users in Germany that contained an obviously unplanned, insensitive and unacceptable message,” KFC Germany said in a statement emailed to CNN Business. KFC Germany didn’t confirm the language used in the alert. KFC’s message resulted in similar outrage among some German customers and has been widely criticized on social media.

KFC is the second biggest chicken chain by U.S. sales behind Chick-fil-A. Rising interest rates are adding to companies’ borrowing costs and triggering higher credit-card bills for consumers. At KFC, they are driving a turnover in senior management. In a battle of restaurant chain drive-throughs, a new survey says KFC’s is the quickest and Chick-fil-A’s is the slowest. Chick-fil-A customers spent on average about 8.5 minutes waiting in line in their cars, while drivers at KFC waited just over 5 minutes, according to a survey of 10 U.S. restaurant chains by Intouch Insight a customer-experience management company. The firm surveyed more than 1,500 drive-through locations in June and July.
