Now Republicans are making similar arguments in calling for her to not hear the congressional redistricting challenge. The current congressional maps in Wisconsin were drawn by Democratic Gov. Tony Evers and approved by the state Supreme Court. The U.S. Supreme Court in March 2022 declined to block them from taking effect. The Wisconsin Supreme Court is under an extremely tight deadline to consider the challenge.

MADISON, Wis. (AP) — There should be no effort to impeach a liberal Wisconsin Supreme Court justice based on what is known now, a former justice advised the Republican legislative leader who asked him to review the issue. On Friday, she declined to recuse herself, and the court voted 4-3 along partisan lines to hear the redistricting challenge. One of those three, David Prosser, sent Vos an email on Friday, seemingly just before Protasiewicz declined to recuse, advising against moving forward with impeachment. “To sum up my views, there should be no effort to impeach Justice Protasiewicz on anything we know now,” Prosser wrote to Vos. She also noted that she never promised or pledged to rule on the redistricting lawsuit in any way.

But removal would allow Governor Evers to appoint another liberal jurist, which is why Republicans don’t plan to convict and remove Protasiewicz. If, instead, the Republican-led State Senate chooses not to act on impeachment, Justice Protasiewicz is suspended but not removed. If successful, Wisconsin Republicans will have created, in effect, an unbreakable hold on state government. Wisconsin Republicans might, for the first time, show an ounce of restraint and refrain from taking this radical step against self-government. Wisconsin Republicans might then face an angry and mobilized electorate in a presidential year.

Republicans in Wisconsin are coalescing around the prospect of impeaching a newly seated liberal justice on the state’s Supreme Court, whose victory in a costly, high-stakes election this spring swung the court in Democrats’ favor and threatened the G.O.P.’s iron grip on state politics. The drama over Republican threats to impeach and possibly remove Justice Protasiewicz could raise new questions about democracy and the legitimacy of elections in a state where G.O.P. For Republicans, the liberal Supreme Court majority serves as an existential danger. If the court, as expected, invalidates Wisconsin’s legislative maps, it would strip Republicans of what now amounts to permanent majorities in the Legislature. But removing a newly elected justice could prompt a backlash in 2024 from Democrats and moderate Republican voters who abandoned the G.O.P.
