Manhattan prosecutors on Tuesday said they were “actively pursuing” additional allegations of sexual assault against the disgraced movie mogul Harvey Weinstein ahead of a new trial that was likely to begin in the fall. Nicole Blumberg, an assistant district attorney, said in Manhattan criminal court that her office had identified allegations of rape and sexual assault against Mr. Weinstein that had occurred within the statute of limitations, and that prosecutors planned to ask a grand jury to indict him. She said they were working in a “trauma-informed” manner with his accusers. “In 2020, there were women who were not ready to proceed with the legal process,” she said. “Some of those women are now ready to proceed.”When the judge in the case, Justice Curtis Farber, pressed for a date when a grand jury could hear new charges, Ms. Blumberg could not give one, but she said prosecutors could be prepared to go to trial by the fall, at one point indicating November.

NEW YORK CNN —A Manhattan prosecutor said Wednesday a new indictment against Harvey Weinstein is possible as additional accusers have come forward with claims against the powerful Hollywood producer whose downfall became a symbol of the #MeToo movement. That trial similarly used “prior bad acts” witnesses and has also been appealed. In addition, three other women testified at trial as “prior bad acts” witnesses. They argued the “prior bad acts” witnesses should not have been allowed to testify and the court should not have given prosecutors the ability to question Weinstein about instances of verbal abuse and bullying on cross-examination. In sexual assault cases, their testimony can turn a difficult “he said, she said” case into a more convincing “he said, they said” case.

Harvey Weinstein will be retried in New York, the Manhattan District Attorney's Office said on Wednesday, a week after the state's highest court threw out his 2020 rape conviction. Weinstein, 72, had been serving a 23-year sentence in a prison in upstate Rome, New York. The conviction included charges of first-degree sexual assault and third-degree rape. Weinstein was also sentenced to 16 years following his separate rape trial in California.
