Hinkle of Federal District Court in Tallahassee sided with advocacy groups and three families who had said that the law stripped them of parents’ rights to make medical decisions for their transgender children. In a 105-page order, Judge Hinkle said that “gender identity is real” and that a “widely accepted standard of care” includes puberty blockers and hormone treatments that Florida unlawfully banned. “The state of Florida can regulate as needed but cannot flatly deny transgender individuals safe and effective medical treatment — treatment with medications routinely provided to others with the state’s full approval so long as the purpose is not to support the patient’s transgender identity,” Judge Hinkle wrote.

But as legal challenges have been mounted to new restrictions on transition care that have been enacted across the country, Judge Hinkle’s ruling exemplifies the kind of chilly reception that the bans may receive from judges. “Gender identity is real,” Judge Hinkle wrote, adding that “proper treatment” can include mental health therapy followed by puberty blockers and hormone treatments. “Florida has adopted a statute and rules that prohibit these treatments even when medically appropriate.”

In a statement posted on Twitter, DeSantis' office lauded the ruling without addressing those nuances. By suspending Warren, DeSantis also elevated the Democrat’s political profile in his own party. And no one in Hillsborough County was charged with violating that state law when Warren was the county prosecutor. Court testimony from DeSantis administration officials showed that the abortion letter was the major cause of Warren's suspension. Abortion was the only issue mentioned in the first draft of DeSantis' suspension order.
