CNN —Donald Trump’s attorneys on Friday ridiculed special counsel Jack Smith’s gag order request in the former president’s classified documents case in Florida, calling it an unconstitutional attack on the 2024 Republican candidate and a ploy to help Joe Biden keep the presidency. “In Jack Smith’s most recent shocking display of overreach and disregard for the Constitution, the Special Counsel’s Office asks the Court to enter an unconstitutional gag order as one of the release conditions on the leading candidate in the 2024 presidential election,” Trump’s attorneys wrote in a new filing, repeating their previous arguments against gag orders. The former president was in New York at the time. Prosecutors’ original ask for a gag order was thrown out by Federal Judge Aileen Cannon, who determined that they had not fully conferred with Trump’s attorneys before filing the request. Trump’s false claims “invite” threats and harassment against law enforcement agents involved in the case, prosecutors wrote, similar to those “that have occurred when other participants in legal proceedings against Trump have been targeted by his invective.”

Former Transportation Secretary Elaine Chao called out former President Donald Trump amid his racist broadsides aimed at her and his other anti-Asian rhetoric. Trump, who is ramping up his 2024 presidential campaign, has repeatedly made racist attacks against Chao, who served in his administration, in recent months. Chao’s latest statement comes in the wake of several high-profile shootings targeting Asian Americans. Other Republicans, such as Sen. Rick Scott, R-Fla., have stopped short of condemning Trump’s attacks, often equating them to the former president’s penchant for using nicknames. She later served as Transportation secretary for the Trump administration.

The newest set of pages were discovered by White House lawyer Richard Sauber on Thursday in a box initially uncovered by the president's personal lawyers on Wednesday. The White House revealed earlier this week that Biden's lawyers had discovered one document with classified markings in a room adjacent to the garage of his Delaware home. "The President’s personal attorneys discovered one document with a classified marking consisting of one page in a room adjacent to the garage. At that point, the President’s personal attorneys stopped searching the immediate area where the document was found," Sauber said.
